William Lowndes to Mr. Borret to state the case of the several contracting brewers [brewers who are contractors to the Victualling] now under prosecution by order of the Queen upon the Address of the House of Commons: they having (for avoiding the charge and trouble of the said prosecutions) petitioned my Lord Treasurer acknowledging their offences and submitting to his determination what satisfaction shall be given. Thereupon you are to advise with the Attorney General of the best method for satisfaction to be given. Ibid., p. 193.

And in order to ease the Government as it ought to be of the charge of repairing damages and losses hereafter by any encampments within her Majesty's dominions for the future you are to take care that the method proposed by the said Comptrollers be put in practice, to wit to have it enquired into and settled by proper officers appointed by the Commanding Officer before they leave such place of encampment, and that for the future orders be given to the Governor to notify such Commanding Officer that whatsoever damages or losses may accrue by the soldiers the same is to be borne by all the Regiments on the spot and not fall upon the charge of the Government, "which may cause the Officers to be more strict in their discipline and the offender sooner discovered."
Prefixing: report by Sir Philip Meadows and Ja. Bruce, Comptrollers of the Accounts of the Army, dated Comptrollers' Office, Privy Garden, 5 Sept. 1711, on the demands of said Col. Morgan and Col. Holmes. The six Regiments did receive the things as in said account as by certificate of Col. Markham, the Quarter Master General. For preventing damage claims in future we propose as above. May 22. Same by same to the Trustees for paying allowances for salt and for fish and flesh cured with salt imported into Scotland before 1 May 1707, to make up their accounts and to pay the balance thereon into the Exchequer: it appearing by the report of the Barons of the Exchequer, Scotland, that no part of the said balance is applicable to the payment of the Commissioners' demands for pains and services in and about their trust. Letters patent by same appointing Alexander Wedderburn, John Whetham, David Ross, Alexander Forbes and James Boyle as Commissioners for the receipt and management of the Duties on soap, paper, chequered and striped linens &c. in Scotland [under the Act 10 Anne, c. 18], with such salaries and rewards as the Lord Treasurer shall think reasonable. May 23. Money warrant for 8,800l. to the respective Paymasters of the 1,500,000l. Lottery anno 1711 [as by the Act 9 Anne, c. 6] and the Two Million Adventure [as by the Act 9 Anne, c. 16]: and is to pay rewards and incidents attending the execution of the Acts concerning same, viz. 3,771l. 8s. 10d. to Bernard Hutchins, Paymaster of the said Lottery, and 5,028l. 11s. 2d. to Charles Blunt, Paymaster of said Adventure: being respectively three sevenths and four sevenths of said total: and to be satisfied in the same proportion out of the funds respectively of said Lottery and said Adventure. May 23. Warrant by Treasurer Oxford to B. Hutchins and C. Blunt to pay 8,800l. to the 44 Managers and Directors of the abovesaid Lottery and Adventure respectively, being 200l. a piece in reward for their labour and pains in executing the Acts for the same.

William Lowndes to the Commissioners of Striped Linens. The Lord Treasurer directs you to employ the persons certified as follows.
Appending: certificate by William Lowndes [Secretary to the Treasury] that John Eddows did on 15 Dec. 1710 deliver to me [Lowndes] a proposal to charge the goods (chequered and striped linens, silks, calicoes, linens and other goods printed, painted, stained or dyed, which several Members of the House of Commons, including the said Lowndes, were directed in the present Session to prepare a Bill for laying a Duty thereon).
Further, Charles Boyle has been very instrumental in discovering to me [Lowndes] the nature and values of the said goods and how they are manufactured, vended or disposed, and how the charge thereon might be laid with most certainty and least interruption to the course of trade.
And John Spelman, Robert Wood, James Dargent, Thomas Thwaytes and Thomas Willmott have been serviceable in the premises. Out Letters (General) XX, p. 196.
Same to the Comptrollers of Army Accounts to report on the enclosed memorial [missing] of Major General Holmes, Major to the Coldstream Regiment of Foot Guards, desiring furniture for the Guard rooms at St. James's, Windsor and the Tiltyard. When were same last furnished and how was the charge defrayed and are the things necessary and the prices reasonable? Ibid., p. 194.
Letters patent by Treasurer Oxford constituting John Williams as a Queen's waiter, Bristol port, loco Joseph Whetham as below, they having agreed to exchange their places and the Customs Commissioners having certified the Lord Treasurer that such exchange will not be any ways detrimental to her Majesty's service. Warrant by same to the Customs Commissioners to employ Joseph Whetham as Commander of the Customs sloop at Bristol loco [the abovesaid] John Williams. Ibid.
Treasury reference to William Blathwayte of the petition of Mr. Duport, merchant, in behalf of Ralph Willett, shewing that Walter Hamilton, Lieut. Gen. [Gov.] of the Leeward Islands, granted said Willett certain lands in St. Christopher; therefore praying the Queen's confirmation thereof. [For the report hereon see infra, p. 296, under date May 28. In the present entry there is the following note in the margin of the petition "This petition and Mr. Blathwaite's report thereupon were referred to the Commissioners of Trade to consider and report if they have any objection to the confirming the grant."] Reference Book IX, p. 66.

Same to the Auditors of Imprests of the petition of John Howe, Paymaster General of Guards and Garrisons, for allowance of 43l. 0s. 4d. and 19l. 16s. 6d. in his accounts, for fees on passing his preceding year's accounts for Guards and Garrisons and for Chelsea Hospital respectively. May 24. Letter of direction for 10,000l. to James Brydges, Paymaster of the Forces Abroad: out of loans now in the Exchequer on Land Tax anno 1712: and is to be paid over by said Brydges to Sir John Lambert towards answering what is due to him on bills of exchange drawn from Spain for the subsistence of prisoners there. Disposition Book XXI, p. 267.
Same for 13,217l. 5s. 9¼d. to John How, Paymaster of Guards and Garrisons: out of loans as above: and is upon account for the Guards and Garrisons. Ibid.
J. Taylor (in the absence of the Treasury Secretaries) to Mr. Lynn. I have read to my Lord Treasurer yours of this day proposing that (as the reduction of the Troops in Great Britain, if now ordered, could not take place before June 24 next) the stop to the musters commencing April 25 last and ending June 24 next may be taken off. My Lord agrees that the Commissaries do proceed in mustering the Troops and Garrisons to the said 24th June. Out Letters (General) XX, p. 194.
Treasury reference to the Customs Commissioners of the petition of Mr. Page shewing that he married his daughter to Mr. Cawsey and gave 3,000l. for her fortune and for payment thereof mortgaged certain lands in Harrow and borrowed 500l. of Tho. Perrin and was persuaded to become surety for Perrin for tobacco bonds in 3,400l., who is since broke and the Queen claims the said mortgage: therefore praying that the Queen will accept such sum as, he Page, can pay. Reference Book IX, p. 66.
Warrant by Treasurer Oxford to Sir Edward Northey, Attorney General, signifying said Lord Treasurer's approbation (on her Majesty's behalf) of Henry, Earl of Rochester, and William, Lord Berkeley of Stratton, to be trustees [for the Duchess of Buccleuch] for the purposes following, provided the Cestique Trusts [cestui que trust] do, at their own charge, cause the indenture in this case to be enrolled before the Auditor for Co. Lincoln.
Prefixing: abstract of the case of said Duchess, plaintiff, against the Attorney General and Sir Richard Bellings, defendants, with the statement of opinion by said Northey thereon. This abstract is a true state of her title under the grant of Charles II. By patent of 13 August 1629 Charles I. granted to Henry, Earl of Holland, et al. the manors of Spalding, Holbech Abbatis &c. in trust for Queen Henrietta Maria. The surviving trustee, Sir Thomas Hatton, by command of Charles II. dated 1660 Oct. 20 and by warrant from said Queen Henrietta Maria dated 1660 Oct. 26 and by a decree in the Exchequer did assign to Henry, Earl of St. Albans, et al. in trust. By indenture dated 31 July 1672 between Charles II. said Earl of St. Albans and Sir Richard Bellings the King appointed said Earl to assign to Lord Holles et al. in trust for Queen Catherine with remainder to the King. By indenture dated 1673 Aug. 13 between the King and the said Queen's trustees a further term was granted in the premises. Afterward the interest of Lord Holles et al. therein became vested in the Earl of Clarendon and William Mountague. By indenture dated 1687 April 26 between James II. of the first part and said Queen Catherine of the second part and the Earl of Chesterfield, Earl of Clarendon et al. of the third part and the Earl of Faversham et al. of the fourth part the King appointed said Earl of Clarendon for the remainder of the term in trust.
By patent of 28 Jan. 1684–5 (reciting the grants of 13 Aug. 1629 and 13 Aug. 1673) Charles II. granted to Sir Stephen Fox et al. the said manors of Spalding and Holbeach in reversion of the Queen [Cattarina of Braganza] in trust to attend the inheritance and further granted to Anthony Row et al., trustees for the plaintiff, the Duchess, and James Scott, called Earl of Doncaster and Dalkeith, son and heir to the Duke of Monmouth, and Lord Henry Scott, second son of the said Duke, the said manors for the life of the said Duchess, afterwards to the Earl of Doncaster in tail male, remainder to Lord Henry Scott in tail mail, remainder to heirs male of said Duchess, remainder to heirs general of said Duchess.
By indenture dated 1709 May 4 between Sir Stephen Fox, surviving trustee, of the first part, the said Duchess and the Earl of Dalkeith of the second part and the said Lord Henry Scott, now Earl of Deloraine, and Henry, Lord Hyde, now Earl of Rochester, of the third part, the said Fox assigned said manors to the Earl of Deloraine and Lord Hyde, to attend the inheritance as above.
The bill is to compel the defendant Sir Richard Bellings to assign the remainder of the first term to such trustees as the plaintiff shall appoint; viz. Henry, Earl of Rochester, and William, Lord Berkeley of Stratton. The Lord Treasurer is desired to declare his approbation of the said trustees.
Followed by: statement of opinion by said Northey as Attorney General dated May 22 last. I have no objection against the trustees named if my Lord Treasurer shall be pleased to approve of them and give me order to consent thereunto. Warrants not Relating to Money XXI, pp. 411–12.
May 26. Royal warrant dated St. James's to Sir Edward Northey, Attorney General, to discharge the 177l. 10s. 0d. in the Exchequer Court, being the Queen's moiety (beyond the Duty for Customs) on a parcel of French wines seized in London port by Samuel Grice, an officer of the Customs there. Same to Treasurer Oxford to pay 408l. 7s. 6d. to Thomas Baker, whereof 390l. 17s. 6d. is to be by him laid out in a present from the Queen to the Regency of Tunis, and 17l. 10s. 0d. for Exchequer fees on the receipt thereof. May 26. Same to Spencer Compton to pay 150l. per an. pension to Alice Grahme, relict of William Grahme, late Dean of Wells: as from 1711 Xmas during pleasure. Queen's Warrant Book XXV. p. 203.
Same to the Attorney General to discharge the fines of 13l. 6s. 8d., 13s. 4d. and 13s. 4d. set upon William Ogden at the Assizes at Kingston 1710–11 March 22 for trespasses and assaults: for which he remains a prisoner in the Marshalsea and is a proper object of her Majesty's charity. Ibid.
Money warrant for 50l. to Leonard Child and John Nuthall towards repairing the damage they sustain by paying into the Receipt 90l. or thereabouts in discharge of a super depending (in their accounts as Receivers of the late Duties on Marriages, Births and Burials for Co. Surrey) upon John Lucas, then Surveyor of the said Duties, who intermeddled with the receipt thereof, having no authority to do so, and possessed himself by that means of the money, the said Lucas having nevertheless equitable pretence to the sum of 50l. (hereby directed) for salary for 1¼ years 1702 Lady day to 1703 Midsummer. The present sum is to be paid out of the money they shall pay in discharge of said super. J. Taylour (in the absence of the Treasury Secretaries) to the Customs Commissioners to report on the enclosed letter [missing] signed Charles Mackamtosh (Mackantosh) relating to the running of some brandy. Out Letters (General) XX, p. 194.
Royal warrant dated St. James's to the Lord Lieutenant of Ireland to pay 500l. per an. to John Wogan and Judith his wife in part of the arrears due on the annuity of 150l. granted by Charles II. 1675 Nov. 25 to the said Judith, then Judith Moore, out of the revenue of Ireland until she be paid 2,000l. at one entire sum for the "wares" and mills of Kilmainham, which she conveyed to the said King and which have ever since continued in the Crown: the said annuity having been paid up to the Revolution, but was [then] left out of the [Irish] Establishment. May 26. Royal warrant dated St. James's to the Clerk of the Signet for a privy seal for passing accounts in Scotland as follows, viz. By a representation from the Barons of the Exchequer, Scotland, they think it necessary that the said Barons of the Exchequer, Scotland, be empowered by privy seal to order payments and discharges of all moneys which the Queen by warrant shall direct to be paid or discharged to any persons and to allow to accomptants all payments made by such warrants; and that where in the course of accounts some irregularities or defects may happen in vouchers by defect or unskilfulness of officers but without fraud or prejudice to the revenue the Barons of the Exchequer, Scotland, be empowered to declare and pass such accounts notwithstanding such irregularities and defects. The Queen hereby directs, authorises and empowers the Lord Treasurer accordingly.

Same to same for a same for payment of 210l. per an. to the University of Aberdeen as from 1712 Lady day, viz. 20l. per an. to the Principal of the Marshall's College there; 20l. per an. to the Professor of Divinity; 65l. per an. to the Professors of Greek, Mathematics and Medicine there, to be equally divided amongst them; 20l. per an. to the Principal of King's College; 12l. per an. to the Professor of Divinity there; 73l. per an. to the three Professors of Philosophy, the Professors of Greek, Medicine, Humanity and the Civil Law there, to be equally divided between them: all to be deemed and reckoned as in full satisfaction of all manner of claims or demands which the said University or the Principals or Professors thereof may or can anyways make, claim or pretend to out of any part of her Majesty's revenue that they have not enjoyed since the Union: all out of the Queen's pious and princely zeal for the good and flourishing state of said University. May 27. Christopher Tilson to [the Principal Officers of the Works]. The Lord Treasurer is inclinable to permit the Paymaster of the Works to receive from the Exchequer the 33,387l. 8s. 8½d. in tallies and orders on tin which were struck 1710 July 26 for the service of the Works and to allow interest thereon from April 26 last, provided my Lord has some assurance from you that when they are so delivered they shall not be carried to market or if the necessity of the artisans receiving same be such as to require the selling thereof that they be put into the hands of some one person to dispose of and in such small sums at a time that the credit of tallies may not suffer by unreasonable discounts. J. Taylour (in the absence of the Treasury Secretaries) to the Auditors of Imprests. The Lord Treasurer has lately referred back to the Ordnance Office the accounts of Major John Webb of moneys received and paid for fortifications at Gibraltar, which accounts have been long depending through his own omissions or defects by not complying strictly with the Earl of Galway's instructions for his guidance as Commissary of the Garrison and Works of Gibraltar; particularly in not having regular muster rolls of the workmen employed, nor persons' hands to receipts for money paid. The Board of Ordnance have reported this 13th inst. that Webb has produced certificates from the Earl of Galway, Col. Elliott and several affidavits to supply those defects. Please revise [review] the whole proceedings relating to these accounts and make a state thereof with your opinion whether those defects may reasonably be admitted to be supplied by certificates, affidavits &c., and how the accounts may best pass. May 28. Treasury reference to Auditor Jet of the petition of Henry Bower shewing that his father purchased of Sir Walter Long a perpetuity of 5l. per an. granted by James I. to said Sir Walter in lieu of a certain corrody taken from him on dissolving the Abbey of Malmesbury, Co. Wilts, and that same was duly paid at the Exchequer till Midsummer 1681. Reference Book IX, p. 67.
Same to the Taxes Commissioners of the petition of Joseph Pake, one of the securities of Samuel Pacy, late Receiver General for Co. Suffolk, shewing that he with his co-sureties obtained an Act of Parliament [Private Act, 7 Anne, c. 25] to compound and in pursuance thereof the Lord Treasurer fixed the respective sums for each surety to pay, but through a misrepresentation of petitioner's circumstances his quota was more than he is able to pay: and upon laying his case before Parliament he obtained an Act [Private Act, 10 Anne. Report to Treasurer Oxford by William Blathwayt, Auditor General of the Plantations, on the petition of Mr. Duport, merchant, in behalf of Ralph Willet, Esq., ut supra, p. 290. The Queen by royal letters dated 1705 Nov. 30 directed Col. Parke, then Governor of the Leeward Islands, to grant leases not exceeding 2½ years of any part of the island of St. Christopher which had been taken from the French. It appears by the copy of an entry taken from the books of said Warden and Minor Canons, attested by the oath of William Washborne, Warden of the Minor Canons of said Cathedral, that in or about the year 1555 Dr. John Fecknam, then Dean of the said Cathedral, did contract with the Master and Corporation of the Savoy in consideration of 100l. then paid by the said Fecknam that the said Master and Corporation should pay to the Warden and Minor Canons of St. Paul's for ever 40s. a year by quarterly payments; with covenants of distress.
