Queen Anne's Civil List Lottery

Introductory Note.
The general subject of the constantly accruing Deficiency of Queen Anne's Civil List revenues has been explained in each volume of this Calendar from 1702 onwards. See in particular the Introduction to Vol. XVIII, pp. v–xviii, and to Vol. XIX, pp. xxviii to xxxix.
In 1713 the Deficiency amounted to nearly two years of the full service of the list and the position of the Queen's servants and pensioners had become unbearable. It was impossible for the Ministers or the House of Commons to shirk any longer the responsibility for making good the supply for the royal State and Household and the Civil Government.
As a preliminary to the investigation of the problem, and in pursuance of an Address to the Queen of the 30th June 1713 (Commons' Journals XVII, p. 446), William Lowndes laid before the House on the 6th July 1713 a detailed statement of the income of the Civil List for the first ten completed years of Anne's reign. This account is printed in the Commons’ Journals XVII, pp. 433–5, and in skeleton form is as follows:

The Act for the Civil List (1 Anne, c. 1, repeating the Act 9 Wm. III, c. 23) had virtually, though not in so many express words, guaranteed an income of 700,000l. for the Civil Government or Civil List: so that for the above period of 102/3 years the total Civil List revenue should have been 8,790,000l.
The shortage of income therefore over the whole period arose to 1,229,317l. 5s. 3¼ d.
In order to make up the Deficiency no less than that full sum was required. But instead of voting the full sum and cheerfully finding supply for it the House passed an Act for a Civil List Lottery (12 Anne, c. 11), by which the Queen was authorised to raise a loan not exceeding 500,000l. by pledging the revenues of Civil List to the extent of 35,000l. per an. for 32 years to come. That is to say, no supply whatever was granted by Parliament to relieve the distress of the Crown, its servants and creditors. The Queen was simply given permission to borrow 500,000l. by pledging for 32 years the Civil List revenues in which she had only a life interest.
This amazing Act contains no express guarantee clause. It nowhere contains a promise that Parliament would meet or make good any Deficiency in the interest fund, nor does it anywhere provide for the continuation of the fund itself in case of Anne's death.
The fund upon which this 500,000l. was to be charged for redemption is defined by the Act as “all the revenues, Duties and branches which were appointed for the support of her Majesty's Household and the honour and dignity of the Crown as well those which are hereditary in the Crown as those which were granted during her Majesty's life” That is to say the Redemption Fund was the total corpus of the Civil List. It was obvious even to the Parliament which passed this Act that it could not pledge any succeeding Parliament to re-grant the Civil List at Anne's death in the same form or indeed in any form. It therefore could not guarantee a life-period of 32 years for repayments out of the total Civil List funds, for that composite fund would and did expire at Anne's death save as for the Hereditary portions of it. The Parliament therefore fell back upon an illegality. The Act decreed that in case of Anne's death any unpaid remainder should be charged upon and be paid and payable out of the Hereditary revenues, Duties and branches of the Crown and with preference to all other payments thereout.
It cannot be too clearly understood that this clause was ultra vires. Parliament had not the right to touch or appropriate or hypothecate the Hereditary revenues save as an Act of usurpation or rebellion. To have acted so as it did in this instance was mockery under the garb of loyalty expressed merely in words. In the same spirit the recital in clause XXIX of this Act speaks of the Civil List debt as occasioned by extraordinary expenses— a statement which was simply not true. The failure was due entirely to the deficit in the Civil List Supply and Parliament was bound in honour to make up the deficit by fresh supply which would bring the Crown's income to the promised 700,000l. per an.
The only effect of creating a 32 years’ charge on the existing Civil List revenues was certain to be a decrease in the net yield of that revenue for the whole of those 32 years.
As to the method of operating the Act the Queen was left to raise the money on her own funds (or rather on funds in which she had only a life interest) in any way she liked; and as she was in the hands of the Earl of Oxford as Lord Treasurer it was a foregone conclusion that the money would be raised by way of a Lottery, the gambler's only resource. It was actually raised in this way, and the account of the receipts from it and of the repayments by way of annuities runs through a long series of annual Declared Accounts.
Two of these accounts may be cited to show the total of money raised and the method of repayment. Sir William Fazakerley, Lancelot Burton, Lionel Herne, Samuel Edwards and John Grainger were constituted 22 Oct. 1713 by commission from Treasurer Oxford to raise 500,000l. by way of a Lottery pursuant to the power given in the above Act. The money raised from contributors by 50,000 tickets came to 499,900l. and was paid ambulando into the Exchequer (Declared Account: Pipe 2,023).
The course of repayment (i.e. of the annual payments to the contributors) was in the hands of the successive Paymasters, of whom the first was William Wenman, appointed by letters patent of Treasurer Oxford 26 March 1714; and his first account ran from 26 March 1714 to 19 Jan. 1714–15.
In this account he is charged with 37,500l. of money received out of the Exchequer: and per contra he is allowed 14,420l. for repayment of principal of 13,640 blank and benefit tickets and 20,963l. 17s. 5¼ d. for interest on tickets drawn in the 50 several courses of payment (Declared Accounts Audit Bundle 1547, roll 66). The figures will give an adequate idea of the utterly ruinous, usurious, prodigal rate of interest which the transaction involved. For it must be understood that the money with which the Paymaster himself was fed came out of the Crown revenues and acted as a yearly sum in diminution thereof up to the point of liquidation. If Parliament had found the money itself for liquidating the annuities the extravagance might have been condoned. But Parliament did nothing of the sort.
The question of repayment of the contributors by way of their annuities only formed one side of the question.
The other side of it concerns the actual distribution of the 500,000l. (or 499,900l.) among the servants of the Crown, the Civil Administrators, Ambassadors, pensioners, Civil Service clerks and tradesmen who had been waiting for their money for years. These payments were made in quite the ordinary way by warrant from the Lord Treasurer to the Exchequer for payment of particular sums to particular individuals on such and such an account. The general idea or purpose was to pay 1¼ years’ arrears to each.
The Treasury kept a separate Entry Book for these warrants drawn on the Civil List 500,000l. Lottery. The official reference to it is T 56/34.
This Entry Book is here calendared separately as an Appendix because of its distinct separate testimony to Queen Anne's Civil List Establishment. But it furnishes evidence only of payments on account; not of total Civil List debts outstanding.
The Book opens with two abstracts of accounts of which the first is as follows:

The second account is a detailed list of the parts of the Household Establishment which came under the Board of Greencloth and were paid by the Cofferer and those which were paid by the Treasurer of the Chamber and Wardrobe and Stables: with an estimate of the sum requisite for paying 1¼ years’ arrears to each officer and servant.
This account occupies pp. 495 to 514 of the present volume and is succeeded by the separate individual money warrants for payments as here printed from p. 515 onwards.
