April 12. Warrant by Treasurer Godolphin to the Receipt to draw orders for certain bankers' annuities in accordance with a certificate (not detailed) of the same from the Auditor of the Receipt: being rectifications of former like certificates concerning bankers' annuities, owing to changes of ownership by sale, inheritance or any other form of assignation or transfer. Approval by same of the 1708 Lady day quarter's salary bills of the Customs for respectively London port (total 6951l. 16. 6) and the outports (total 9430l. 8. 9 viz established salaries 8165l. 3. 9 & additional salaries 1265l. 5. 0). Ibid.

Same by same to the Customs Commissioners to pay Brigadier Geo Carpenter 625l. 10. 0 to be paid by him to the Officers & soldiers of 3 Troops of Dragoons belonging to the Queen's Regiment formerly under command of Brigadier Lloyd & now of Brigadier Carpenter which in 1698 marched to Canterbury, Ashford & other places in Kent & thence to Folkestone, Romney & other towns on the sea coast in order to assist the civil magistrates, when desired by Henry Baker, in executing legal powers &c for hindering the exportation of wool & importation of silks & corresponding with the French: in which service the said three Troops continued on those coasts from 26 July & 1 Aug 1698 to 30 Aug 1703 (when they were relieved by Troops from the Earl of Essex's Regiment) & are by order in Council entitled to an allowance of about 2d. a day for each Dragoon & in proportion to the Officers to a total not exceeding 200l. per an: the abovesaid sum representing the balance due to them over & above what has been already paid them.
Prefixing: three reports from Henry Baker, Treasury Solicitor, as follows:
(a) On the memorial from Brigadier Carpenter, Lieut. Col. Francis Gore & Major Walter Leveson praying payment for services as above.
(b) By order in Council of 1698 June 9 the then King directed a report on the proposals for suppressing exportation of wool from Romney Marsh &c. The Privy Council had several meetings thereon & heard the Customs officers et al thereon & the King approved a method proposed by Mr. Blathwaite, Secretary at War, & said Baker for the employment of troops as above. I have paid the said Troops the agreed allowance as above up to 20 May 1700.
(c) Giving instances of the services of said Dragoons in supporting the officers upon the landing of the French from their sloops in their small boats in the night time which they frequently did & especially since the war, still continue to do: and other similar services particularly in March 1699 when a desperate gang of owlers well armed with 7 or 8 horses loaden with combed wool in the night going from Canterbury towards the sea were met by the officer then on duty at which time one of the owlers was shot dead by one of his own side & some of the wool & horses seized: & in August following when 6 packs of wool & 2 horses were seized in the Marsh near the sea: & in Dec 1702 when a party of French landed near Dungeness in the night & made great firing upon the officers. Treasury reference to the Customs Commissioners of the petition of Richard Whaley innholder shewing that he entrusted Oliver Peirson, a landwaiter London port, with receiving several sums of money for him & that Peirson owes him 400l. but petitioner is poor & cannot carry on a prosecution against him. Same to same of the petition of Archibald Cockburn, one of the Baillies of Edinburgh, shewing that in April last [1707] he shipped on board the Angel Gabriell of Leith 5 tons of brandy at Rotterdam designing to have brought home the same before the 1st May 1707 but by reason of contrary winds she arrived not at her intended port till the 2nd May: whereupon he applied to the Customs Commissioners in North Britain to admit same to entry on the usual Duty: which they refused: therefore praying for same to be so admitted. Warrant by Treasurer Godolphin to her Majesty's Receiver General of Salvage Money to comply with (a) infra.
Prefixing: (a) Order of the Queen in Council dated St James's March 26 last for the payment to Sir William Whetstone, Admiral of the White, & to the Commanders & companies of several of her Majesty's ships as follows, five eighth parts of the salvage of four Dutch ships (the Young Isaac, the Crowne (Crane) dogger, the Land's Welfare & the Jonathan of Amsterdam) retaken from the French by the said Admiral on his late return from convoying the Russia Fleet, being richly laden & worth several thousand pounds, which ships have been since appraised by the Admiralty Court & restored to the owners on payment of one eighth part for salvage: Capt. Mighells & Capt. Allen in the Dreadnought & Montague having the only pretensions to the Young Isaac & the Crane dogger & Capt. Aldred & Capt. Kempthorne in the Rochester & Tyger having the only pretension to the Land Welfare & Jonathan. The sums ordered to be paid as salvage as above for the said 4 ships respectively are 418l. 9. 9, 16l. 17. 6, 397l. 18. 7 & 389l. 2. 9 all which sums belong to the Lord High Admiral but Sir Charles Hedges, Judge of the High Court of Admiralty, having reported that frequently an allowance of some part of such salvage has been heretofore granted to re-captors, Commanders of her Majesty's ships, as a reward. April 12. Entry of a Treasury caveat in favour of the Principal Commissioners for Prizes against payment of any money that shall appear to be due from her Majesty to Mr. Goddard as Consul at Tunis in regard the sum of 900l. is due from him for the prize ship Angell Gabriel taken by Capt. Swanton in her Majesty's ship Exeter & carried into Tunis & sold and delivered to the said Goddard for that sum, taking his bills of exchange upon merchants in London who refusing payment caused them to be protested. April 13. William Lowndes to the Customs Commissioners to report on the enclosed letter relating to a demand by the Collector at Glasgow by way of prizage of the tenth given upon a cargo of wine lately brought into that port.
Appending: letter from Robert Radgers, John Bowman & Thomas Smith, provost & magistrates of Glasgow, to Treasurer Godolphin dated Glasgow April 7. We thank you for the favourable sentiments in your letter of the 25th ult. There are 2 or 3 small vessels arrived here from the Canaries. Those concerned in them complain of the hardship they meet with in having the tenth pipe taken from them for prizage for so [much of a hardship] it falls out from the smallness of their burthen. They allege that we in North Britain cannot be subjected to the prizage because of no law tying us thereto & that seeing there is an imposition of 4l. 3. 4 which that wine pays to the town of Edinburgh where the most of our sales are, this supervenient burden of prizage will be a great discouragement to our trade to the Canaries, which is the chief place for exporting of our manufactories: and further that it's hard to take it from them in kind seeing that in places where it is taken in South Britain it is compounded for at very easy rates. We pray your Lordship to give such directions in this matter that none may have just cause to complain & that your Lordship would have regard to the smallness of our vessels which are in proportion to our consumption. Col. Austin's Company & Lieut. Col. Wakelin's Company amounting to 400 G. [guineas] “& all his own plate amounting to 600l. after the battle of Almanza he put the same on board Sir Cloudesley Shovell as appears by a note under the hand of the said Admiralty [Admiral's] secretary: but the said Admiral being unfortunately lost he is thereby disabled from paying for the recruits of the said Companies”: therefore praying consideration of his case and compensation for his losses. April 14. Treasury reference to Mr. Borrett of the petition of Martha Coates widow for a grant of the forfeited lands of her husband James Coates who was executed for robbery on the high way; she being in a very poor condition with two small children. Ibid.
Warrant by Treasurer Godolphin to the Barons of the Exchequer to swear William Downing & Charles Downing gent into the office of Comptroller of Customs in the port of London, they having a grant of said office dated 1674–5 Feb 2 in reversion of Edward Backwell & John Backwell who are both now deceased. Same by same to the Excise Commissioners to pay 50l. to William Chainy appointed about 2 years since to be principal gauger & principal officer in London port for imported liquors as reward for his industry & integrity in his several trusts, he having (since his appointment to take care of the Duty of imported liquors) discovered very great quantities of rum & arrack amounting to 4017l. “and sometimes in prudence the Excise Commissioners have obliged him to quit seizures that in strictness of law perhaps he might have retained with some profit to himself.”

April 17. Same to Sir Thomas Littleton, Treasurer of the Navy. The Bank of England has for the public service agreed to advance 20000l. on a deposit of so much in tallies & orders on the eleventh 4s. Aid which were put into your hands for services of the Navy. Please deposit same accordingly & apply the money to the payment of seamen's wages.

The soil is so boggy, of the nature of quicksand, as will require a great quantity of gravel with wood &c to support it or otherwise will be swallowed up for want of a firm bottom. Prefixing: (a) The Excise Commissioners in North Britain [to said Lowndes] dated Edinburgh April 10. Having nothing material to present the Lord Treasurer with this week we earnestly entreat you'll favour us with a line whether there has been anything done in relation to the difference betwixt the English & Scots measures & distillery here, for want of which we are put to very great inconveniences. April 19, 20, 27. Same to Sir James Montague, Solicitor General, to report on the letter ut supra pp. 203–4 from the Provost &c of Glasgow complaining of the demand of Prizage wine out of three vessels there. The Lord Treasurer desires your opinion whether wines imported into that part of Britain called Scotland are liable to the Duty of Prizage or not. Out Letters (North Britain) I, p. 344.
Followed by: (a) the said Solicitor General's report dated April 20. I am of opinion that the Duty of Prizage is equally payable in Scotland as in England, for though before the Union it was demandable only of English merchants for wines by them imported into England & is an ancient Duty claimed by prescription to be due to the Crown of England & not given by any Act of Parliament yet it hath always been placed under the head of Customs payable to the Crown, as appears in Sir John Davis's Reports in the great case of the Customs, where he says there are 3 kinds of Duties payable to the Crown called Customs (1) Magna et antiqua Custuma; (2) parva et nova Custuma (3) Prizage & Butlerage. And in divers other law books it is said that Prizage is a Custom taken of wines imported. Therefore since Prizage is not only a Duty claimed upon wines imported but is looked upon anciently to be under the denomination of Customs, I conceive it falls under the sixth Article of Union which makes all parts of the United Kingdom liable to pay the same Customs &c. Nevertheless the Lord Treasurer being willing to show all favour & ease to the Corporation of Glasgow is pleased to allow that in case the said Corporation think fit to try that matter at law in the Court of Exchequer in Scotland you may in the mean time permit them [the three ships] to unlade their wines on your taking bond from them to abide by the judgment of the said Court.
