Persons committed.

RESOLVED, upon the Question, That Mr. Rigby, and the other Two Officers, that were brought from Yarmouth, be committed forthwith to Newgate; there to remain during the Pleasure of the House: And that the Officers that brought them, be discharged of them: And that the Serjeant take them into his Custody, and convey them to Newgate accordingly.

Winchester-house.

The Lords and Commons, in this present Parliament assembled, having taken into Consideration the great Want of a House, to make a Place for the Keeping of Prisoners, in these dangerous and troublesome Times; and being informed, that Winchester-house, in St. Mary Overies in Southwarke, is fit for such Employment; do this Day Order and Ordain, That the said House, and the Backsides thereunto belonging, be forthwith delivered unto Thomas Devenish, who is appointed, by this Order, to be Master of the said House, and Keeper of the Prisoners; and there to keep all such Persons in safe Custody as shall be sent to him, and committed to his Keeping: And, for so doing, this shall be his sufficient Warrant.

Resolved, upon the Question, That this Order shall be sent unto the Lords for their Concurrence.

Committee sent for.

Ordered, That the Serjeant do forthwith repair unto the Committee for the Safety of the Kingdom; and require them, every one of them, to come to the House.

Army Committees.

Sir H. Vane, junior, Mr. Vassall, Mr. Whittlock, Sir H. Mildmay, are appointed to sit, and consult with the Committee for the Militia in London; to receive Intelligence from the Army; and to take Care for supplying the Army, from time to time, with all things necessary.

Sir Jo. Corbett, Mr. Purefrey, are appointed to attend the Army; and, by Advice and Consultation with the Lord General, continually, from time to time, to give Information to the House of the State of the Army; and of what things shall be wanting and necessary for them: They are likewise to take an especial Care, that the Kingdom may not be abused by false Musters. And, to that Purpose,

Sir H. Vane, Mr. Whitlock, Sir Gilbert Gerard, Mr. Pelham, are appointed to prepare Instructions for the Committee ordered to attend the Army: And likewise an Order for the Committee appointed to sit with the Committee of the Militia in London.

Conference-Letter from the King.

The Lords desire a present Conference, in the Painted Chamber, by a Committee of both Houses, presently, if it may stand with the Conveniency of this House; concerning a Letter lately received from his Majesty.

A Message from the Lords by Serjeant Whitfield and Serjeant Glanvile;

The Lords do desire, That, at the next Conference, they may impart unto you a Letter that they have received from the Earl of Stamford; and likewise a Letter, inclosed, from the Lord Herbert.

Conference. Letter from the King.

Mr. Pym reports the Conference with the Lords:

The Lord of Northumberland said, That the Lords had appointed him to make known the Receipt of a Letter from his Majesty, and the Circumstances of the Manner of Receiving of it.

The Lord of Northumberland then said, That coming to Brainford, from the King, they found many Soldiers, both Horse and Foot; so that my Lord General, who gave Order for their Marching thither, could take no Notice of it.

A Committee to be appointed of both Houses, to set forth a Declaration.

Letters from Earl of Stamford, &c.

Mr. Glyn reports the Second Part of the Conference; and said it was managed by the Earl of Holland: That he offered Two Letters to be read, One from the Earl of Stamford, another from the Lord Herbert: The which were read: A Clause likewise in One of his Majesty's Declarations, concerning * * * *.

Declaration of Parliament.

Resolved, That this House doth assent to refer it to a Committee of both Houses to prepare a Declaration, to set forth to the World the Matter of Fact, and the Proceedings that have been used by both Houses for a Peace; and an Answer to his Majesty's Letter lately received; and to present them to the House.

The Lords intend to sit this Afternoon at Three of Clock; and desire this House would do the like, if it may stand with their Conveniency.

Approval of Lord General's Conduct, &c.

Resolved, upon the Question, That this House doth approve of the Act of the Lord General's, in staying the Letter appointed to be sent unto his Majesty, concerning a Cessation.

Ordered, The Lords Concurrence to be desired herein.

Ordered, That it be recommended to my Lord General to pursue the Enemy with all Advantage whatsoever.

Resolved, upon the Question, That Mr. Skipwith be forthwith sent for, in safe Custody, to attend the House.

Pass for White, &c.

Ordered, That Mr. White, and the King's Trumpeter, that came with him, with a Letter from his Majesty, shall have Mr. Speaker's Warrant to transport him to the King's Army.

Resolved, That the Lords be moved, that the Lord, that received the Letter from the Earl of Stamford, may return Thanks to the Lord Stamford, from both Houses, for his good Service.

Imputations on Parliament concerning Papists.

Resolved, upon the Question, That this House doth assent to refer it to a Committee of the Lords and Commons, to clear the Imputations laid upon the Houses of Parliament, in a Declaration of his Majesty's; and a Letter from the Lord Herbert, concerning the Parliament's Employing of Papists, and concerning Promises made by some Members of the House to Papists, to take off the Laws that are prejudicial unto them, if they would give their Assistance to the Service of the Parliament; and likewise to make an Answer to that whole Declaration of his Majesty's.

Impeachment of Lord Herbert.

Resolved, upon the Question, That the Lord Herbert shall be accused of High Treason, for Raising of an actual Rebellion.

Mr. Serjeant Wilde is appointed to prepare an Impeachment of High Treason against him.

Earl of Warwick.

That it be left to the Earl of Warwick to appoint the Rendezvous.

Loan from the City, &c.

Mr. Vassall is appointed to carry up to the Lords the Order concerning the City advancing of Monies, and Paying of Soldiers.

Army Affairs.

Propounded, 1. That Southwark and Lambeth may be the Rendezvous for the Forces now come up, or to be raised.

This to be recommended to my Lord General the Earl of Warwick, for his Direction.

2. That Care be forthwith taken for the Listing and Disposing of all such as are come to offer themselves (of several Counties); and for the Setting of them in Companies and Regiments.

3. That a like Care be taken, and several Orders for such as are willing and able to defray their own Charges; and for such as come up, and are not able.

4. That Victuallers and Sutlers may be appointed to serve the Soldiers; and Prices set by the Officers.

5. That the Earl of Warwick be acquainted with the Particulars, by some Members of the House of Commons.

6. That the Drums of the City may be ordered presently to beat, to cause all that are come up to repair to Grocers-hall To-morrow by Eight in the Morning.

7. And that the like Warning be given, that all Horse brought up by Countrymen, or in the Hands of several Commissaries, may be at the New Artillery Ground, by Two of Clock in the Afternoon, on Wednesday, that they may be listed to their several Uses they are fit for.

8. That some of the House of Commons may be joined with Six of the City of London, to be appointed by the Militia.

Essex Committee, &c.

Sir Tho. Barrington, Sir Wm. Massam, Sir Martin Lumley, Sir H. Mildmay, are the Members of the House appointed for this Service for the County of Essex: And the particular Members that serve for such other Counties, from whence Soldiers shall come, are appointed for the Service of those Counties: And, in the Absence of such Members, that then it be referred to those Six whom the Committee for the Militia in London shall appoint, or any of them, to perform that Service.

Trained Bands.

Ordered, That the Deputy Lieutenants of the County of Middlesex do give Order to the Captains, or in their Absence, to the other chief Officers of the several Companies in Westminster and Middlesex, to seize the Arms of such of the Trained Bands as shall refuse to appear upon their Commands; and to dispose of them to such as they shall think fit: And that the Refusers shall pay such as serve in their Arms.

The like Order to be made for London, and the Counties adjacent.

Officer discharged.

Resolved, &c. That Captain Dalby shall be discharged of his Command, as Captain of the Hamlet Forces.

Seizing Oats, &c. in the Mews.

Resolved, &c. That Power shall be given to Mr. Derley, Mr. Wheeler, and Mr. Holland, to seize all the Oats and Provender in the Mews; to be employed for the Service of the Army raised by the Parliament.

Deserters.

Ordered, That whatsoever Commanders, Captains, or other Officers, shall be found from their Colours, without the particular Licence of my Lord General, shall be sent in safe Custody to my Lord General; to be proceeded with according to the Course of War.

Message to Lords.

Sir Henry Mildmay is appointed to go up to the Lords, and to carry up the Order concerning the Securing the Monies dispended by the Citizens upon the new Levies: The Order concerning the Listing and Receiving the Soldiers that come out of Essex: The Order for making Winchester-house a Prison: And the Votes upon the last Conference with the Lords.

Disposing of Prisoners.

Ordered, That the Committee for Examinations shall have Power to dispose of such Soldiers of the King's Army, of mean Quality, as shall be brought before them, to such Prisons as they shall think fit.

Person committed.

Resolved, &c. That Mr. James Howell be forthwith committed Prisoner to the Fleet, there to remain during the Pleasure of the House.

Sir Henry Mildmay brings Answer, That the Lords do agree to all the Orders and Votes carried up to the Lords by him: And, as to the last Vote, they desire it may likewise.. referred to a Committee.

Southwark, &c. Guards.

Ordered, That Sir Henry Mildmay and Sir John Evelyn do go to the Lord Mayor, and Committee for the Militia in London; to desire that very sufficient Guards may be appointed for Southwark and Lambeth, in regard 'tis thought there will be Alarms from the Enemy's Forces in those Parts this Night.
