Bailing of Prisoner.

THE humble Petition of John Fussell, in the Serjeant's Cu...., was this Day read: And

It is Resolved, upon the Question, That the said Mr. John Fussell be forthwith bailed, upon such Security as shall be approved of by this House.

Affairs at Marleborough.

A Letter, from Marleborough, of the Second of December, from Mr. Francklyn, relating the Attempt upon that Town, was read.

Resolved, That the Town of Marleborough be injoined and required to keep the Persons of the Lady Seymour and her Daughter, and Mr. Vincent Goddard, in safe Custody, till the House take farther Order: And that the Lords Concurrence be desired herein.

Assurance

Ordered, That Mr. Jenner and Mr. Smyth do write a Letter to the Deputy Leiutenants of the County of Wilts; to require them to issue out so much Monies, upon Account, out of the Proposition Monies of that County, to those in Marleborough, as they shall think fitting; and to inform all such Persons as shall deliver fitting Provisions, upon Ticket, to the Soldiers, shall have the Assurance of this House for Repayment of the same.

Waggon stayed at Ware.

Ordered, That Sir Tho. Dacres do write a Letter to those Men of Ware, that stayed the close Waggon that came through the Town of Ware; and return them Thanks for their Care: And that the Men that guided and drove the Waggon be sent up hither, with their Letters and Warrants: And that the Waggon be safe kept in the mean time.

Sufferers by Plunder.

Mr. Whittlocke presented an Ordinance for Reparation to be made to those that have been plundered by the King's Army, out of the Estates of those that bear Arms in the King's Army: Which was read; and recommitted to the same Committee, with the Addition of Mr. Wheeler, Mr. Rigby, Mr. Lane, Mr. Grimston, Mr. Hobby, Mr. Wynwood.

Lords to sit.

Sir H. Mildmay is appointed to go up to the Lords, to desire them to sit awhile.

Instructions for Sussex.

Mr. Pym presented, from the Committee for the Safety of the Kingdom, some Additions and Alterations to the several Instructions for the Counties, to fit them for the County of Sussex: The which were read; and, by Vote

Message to Lords.

upon the Question, assented unto: And carried up unto the Lords, by Mr. Pym; together with the Vote, concerning the Lady Seymour and her Daughter, and Mr. Vincent Goddard, Prisoners in Marleborough; the Votes concerning the Master of the Rolls.

Chapel, &c. of the Rolls.

Ordered, That Mr. Rigby, Mr. Strode, and ... Hill, or any Two of them, do forthwith repair to the Chapel of the Rolls; and to lock and seal up the Doors thereof; and to deliver the Keys to the Speaker of the House of Commons: And likewise to take Possession of the House belonging to the Master of the Rolls; and to leave some fit Person to keep the same, for the Use of Mr. Speaker.

Complaint against Love.

Ordered, That Mr. Holles, Sir Henry Mildmay, Mr. Hill, and Mr. Bond, do send for Istrand Love, an Attorney, and examine the State of the Complaint made by Wm. Knollis, a Soldier, against the said Istrand Love, concerning a Bond fraudulently made by the said Love.

Escape of Bamfield.

Ordered, That it be referred to the Committee for the Gatehouse, to examine the Matter of the Escape of Serjeant Major Bamfeild out of that Prison.

Watford Lecturer.

The humble Petition of Cornelius Burgess, Vicar of Watford, concerning the Lecturer there, was this Day read: And.

It is Ordered, That the whole Matter of the said Petition be referred to the Consideration of the Committee for Dispatches, where Mr. Prideaux has the Chair: Who are to consider of the whole Business; and to report their Opinions to the House.

Answer from Lords.

Mr. Pim brings Answer, That the Lords do agree to the Men nominated to be Committees in Sussex; and to the Additions and Amendments to the Instructions for Sussex: And, as to the Business concerning the Master of the Rolls, they will send Answer hy Messengers of their own.

A Message from the Lords, by Serjeant Glanvile and Dr. Aylett;

Assessors in London.

The Lords have sent down the Names of some Persons which they have thought fit, to be Assessors of the Monies to be collected in London, by virtue of the late Ordinance; and desire the Concurrence of this House.

Saltpetre.

They have likewise sent down an Order, concerning Saltpetre and Brimstone; to which they desire the Concurrence of this House.

The Order was read, in hæc verba; and assented unto.

Ditto.

"Ordered, by the Lords and Commons, in Parliament assembled, That the Committee of Citizens, appointed for Powder, may have Power and Authority to search for, seize, store up, and provide, Brimstone and Saltpetre, in as large and ample Manner as before they had, by the late Order for Powder."

The Names were all read; and, by Vote upon the Question, assented unto.

Mr. Vassall and Mr. Spurstoe are appointed to quicken the Execution of the Orders concerning Gunpowder, Brimstone, and Saltpetre.

Answer returned by the same Messengers.

The House doth concur in the Names for the Collectors and Assessors; and in the Order concerning Saltpetre and Brimstone: And are likewise resolved to quicken the Execution of these Orders, by a Message.

Marchioness of Hertford's Goods.

The humble Petition of Frances Lady Marchioness Hertford, concerning some Goods of hers, seized by Capt. Swanley, at her Jointure House at Netley, was this Day read: And,

It is Ordered, That the Goods belonging to the Lady Marchioness Hertford, and now in the Custody of Captain Swanley, be delivered into the Custody of the Earl of Essex; to be disposed of as his Excellency shall think fitting.

Seizing Barley, &c.

Ordered, That Mr. Robert Marriott, Thomas Redgrave, and Jonathan Bisse, be required to seize and stay the Parcels of Barley, and other Grain, brought up about Beaudly, in the County of Suffolk: And not to be shipped and transported over Sea, without Order from this House: And that ... shall likewise take on shore the Two hundred Quarters already shipped in two Bylanders ... Flanders; and not suffer it to be transported.

Persons committed, &c.

Upon the Report from the Committee for Informations, made by Mr. Corbett;

It was Resolved, &c. That Sir Francis Williamson, and the other Twelve Gentlemen taken at Farnham, and brought up in safe Custody, be committed forthwith Prisoners to Winchester House, King's Bench, and the Lord Mayor's Prison, in Southwark: And the Names of them to be brought to Mr. Speaker, and by him to be disposed of to the several Prisons.

Ordered, That the Irish Papist, taken among the Prisoners at Farnham, and by the Committee committed Prisoner to the Gatehouse, do remain there Prisoner, till the House take farther Order.

Ordered, That Mr. Hooke, taken Prisoner at Farnham, be disposed as Mr. Pym shall think fit.

Carisbrook Castle.

Resolved, &c. That Twenty Men shall be put into the Castle of Carisbrook, into the Isle of Wight, to have the Entertainment of Eight Pence per Diem, to continue till the House shall take farther Order.

Portesmouth Garison, &c.

Resolved, &c. That the Committee for the Safety of the Kingdom do grant forth their Warrants to the Treasurer at Wars, speedily to send down to the Governor at Portesmouth One thousand Pounds, for the Pay of the Garison: And that the Monies aud Plate sent thither from Chichester be speedily sent up hither by Sea.

Commissioners for Counties.

Ordered, That the Gentlemen that serve for the several Counties, do bring in the Names for the Commissioners for the several Counties to the Committee, as they will answer the contrary to the House.

Irish Affairs.

Ordered, That Mr. John Goodwin do To-morrow make Report concerning the Affairs of Ireland.

Message to Lords.

Sir H. Vane junior carried up to the Lords the Order concerning raising Two thousand Horse in the Counties of Essex, Herts, Norfolk, Suffolk, &c.: The Order for the Payment of the Soldiers that come in from the several Counties: The Order for Provisions to be sent into Ireland from Barnstaple, Exon, &c: The Order concerning Members, and others, well affected, being proclaimed Traytors by the King: The Order concerning the next Summer's Fleet: The Votes concerning the Prince's Children: The Vote concerning the Lord Mayor appointing Assessors, &c.: The Votes concerning the Dragooners to be levied in the Western Counties: The Order of Additions to the Ordinance concerning assessing Monies in the Cities of London, Westminster, &c.

Master of the Rolls.

Resolved, &c. That a Person shall be nominated by both Houses to be Master of the Rolls:

That whosoever is put into that Place without the Nomination of both Houses, shall be displaced by Authority of both Houses:

That this House doth nominate and appoint William Lenthall Esquire, their Speaker, to be Master of the Rolls:

That the House in Chancery Lane, belonging to the Master of the Rolls, and all the Records there kept, shall be delivered into the Possession of Mr. Speaker: And all the Clerks there are required to be obedient to Mr. Speaker's Commands.

The House doth farther Resolve, That all the Profits, Advantages, Emoluments, and Incidents, belonging to the said Office, be invested in the said Mr. Speaker.

Beresford's Powder Mills.

Whereas John Beresford, Citizen and Grocer of London, is willing to serve the Kingdom with what Powder he hath, or shall make, at Temple Mills, near unto Hackney; It is this Day Ordered, That the said Mr. Beresford shall bring the Powder he makes, from time to time, unto such Place of Safety in London, as the Committee for the Militia in London shall think fit. And it is farther Ordered, That for the better Safeguarding of the said Mills from any sudden Assault or Violence, that may be attempted by any malignant Persons, That the said Mr. Beresford shall have Power and Authority from this House, to take up Bridges leading to the said Mills from Layton Highway.

Additional Instructions for the County of Sussex.

Instructions for Sussex.

WHEREAS his Majesty, for the Furtherance and Prosecution of this unnatural War against his Subjects, hath appointed Edward Ford Esquire, Son of Sir Wm. Ford, to be Sheriff of the County of Sussex; who, by Pretext thereof, hath raised the Power of the said County; and, strengthening himself with other Forces, seized the City of Chichester, and, in a violent Manner, spoiled divers of his Majesty's good Subjects, and forced them to forsake their Dwellings: For the more speedy Suppression of these, and all other such Traytors and Rebels,

You shall seize upon the Person of the said Ford, and upon the Persons of all other who are aiding and assistant unto him, and shall send them up in safe Custody to the Parliament: And you shall seize the Houses, Lands, Rents, and other Goods and Chattels of the said Person, and all other that have taken Arms against the Parliament; and shall send up to the Speaker of the Commons House a perfect Schedule of such Houses, Lands, Rents, Goods, and Chattels; and shall put the same into such Hands as shall be answerable and accountable for the same.

You shall take away the Arms and Horses of such as shall refuse to contribute Horsemen or Arms upon the Propositions: And you shall force all Papists, and Persons disaffected to the Parliament, to contribute towards the Maintenance of your Army.

And you shall take Care, that the Army be governed according to the Laws and Ordinances published by his Excellency the Earl of Essex; and to pay them out of such Monies as shall be paid in upon the Subscriptions, or otherwise levied upon the Contributions, and upon the Estate of such as are in actual Service against the Parliament, or have sent or contributed any Supply for the Maintenance of it.

You shall have Power to take into the Protection of the Parliament, such as shall forsake the Party of the said Sheriff, so as they be not Papists, or Delinquents, declared by both, or either of the Houses of Parliament.
