(f. 31.)		 Confirmation of the foundation of a chantry in the church of Tormerton and the appropriation thereto of the church of Acton, the income of the chantry amounting to 100 marks. Exemplifying letters—
(1) of John de la Ryvere, knight, lord of Tormerton and patron of the church, dated the last of April, 1344, granting to the warden of the chantry stock, value 20l., on condition that he hands over the same value to his successor;
(2) of the same person and date, granting to the same warden half an acre of land near the church of Acton, and the patronage of the same church;
(3) of Wulstan, bishop of Worcester, dated at Hertlebury, 1 May 1344, reciting the grant made with the consent of king Edward and of William, rector of Thormerton, of a messuage and two carucates of land in Thormerton, and establishing in that church a warden, four chaplains, and two clerks, who shall serve as deacon and sub-deacon, and three choristers. These shall every day sing matins and a mass of the Blessed Virgin, and say a mass for the dead, and sing a third mass. On the usual days before singing vespers, they shall say a solemn funeral mass for the souls of John, the founder, Margaret his wife, king Edward, queen Philippa, Wulstan, bishop, and John de Evesham, prior, of Worcester, the ancestors of the founder, and all other patrons and benefactors, as also on the days of burial and anniversaries of the founder and his wife, and of the patron for the time being. The warden shall be resident, provide board and lodging, and pay the chaplains 24s., the clerks 6s., and the choristers 3s. 4d. each a year, and shall on death or resignation hand over the same quantity of stock or money as he received to his successors. The warden is to swear to observe these rules under penalty of 100s. each to the cathedral and bishop of Worcester, the archdeacon of Gloucester, and the patron;
(4) of John, prior, and the chapter of Worcester, dated at Worcester, 2 May 1344, confirming and exemplifying (3);
(5) of Wulstan, bishop of Worcester, to the warden and chaplains of Tormerton, dated at Hertlebury, 3 May 1344, appropriating to them the church of Acton Torvylle, of their patronage upon the death or resignation of William de la Sherde, a vicar's portion being reserved, and 6s. 8d. per year paid to the prior and chapter of Worcester;

Mandate to inform themselves touching the complaint made by William, bishop of Norwich, whose citation the abbot and convent of St. Edmunds refused to obey, and sent Richard Freysel, knight, to the king or his chancellor, pleading that by royal letters they were exempt from episcopal jurisdiction, and asking for letters prohibiting the bishop from attempting anything against the said exemption. On this the bishop excommunicated Richard, who returned to the chancellor, pleading that this had been done in contempt of the king's majesty, and that the bishop and the prior of Kersey, Hamo de Betlere, D.C.L. rector of Benere (Bunny), Simon de Sudbiria, D.C.L. rector of Wikambrok, and James, rector of Wrabbenose, in the dioceses of York and Norwich, and other commissaries, had published the excommunication; whereupon he obtained letters citing the bishop and commissaries before the king's justiciars, before whom the said bishop and commissaries took exception that the justiciars could not and ought not to take cognisance of the excommunication, and referred to the archbishop as judge ordinary in the case. The justiciars nevertheless ordered the commissaries to be imprisoned, and the said James was put in the prison of the abbot in the town of St. Edmundsbury. The prior and Hamo lay in hiding, Simon got away privily to the apostolic see, and the justices, the king being abroad, ordered all the goods of the bishop to be seized and remain in the king's hands until the bishop revoked the excommunication, and made satisfaction to Richard, who claims 10,000l. damages. The justices then sent royal letters to the sheriffs of Norfolk, Suffolk, Essex, and Middlesex, ordering them to seize all the temporalities of the bishop and of the see, and to answer to the king for the same. The bishop, fearing he should be taken, betook himself, with his household, to his cathedral church, and shut himself up therein. If these things are so, the abbot and Richard are to be cited to appear before the pope within three months to receive what justice requires for their excesses and wickednesses.
