clix. Grant by Martin de Kascumbe (karscumbe, in rubric) to the church of St. Andrew Wells of three marks towards the construction of the new work, and two marks towards the repair of St. Mary's chapel, of the rent of Maperton which his lord H.de Novo Merchato asigned in payment of his debt, to be paid at the rate of 4s. a quarter till the sum be complete, commencing on Michaelmas next in the second year after the king's coronation at Winchester. clx. Gift (*made upon the high altar of Wells) by Richard abbot of Muchelney and the convent to the church of Wells of their church of IIministre in frank almoin, admitting the canons of Wells to their brotherhood, so that on the death of any canon a trental of masses shall be performed in their convent, on the death of dean or precentor of Wells as for a prior ofMuchelney, and on the death of a bishop as for an abbot. *Done at Wellys in the presence of Savaricus bishop of Bath and Glastonbury, Master Alexander the dean, Master William de Sancta Fide precentor of Wells, in full chapter, the morrow of St.Andrew 1201.

clxv. Ordinance of J.bishop of Bath and Glastonbury that ten marks yearly of the church of Chyu (after the decease or cession of Master Hugh de Wilton now parson) and ten marks similarly of the church of Welinton (after the decease or cession of Stephen de Tornaco) be paid quarterly by the parsons thereof at Wells in chapter to the service of the glorious Virgin. Dated Dontereysare, St. Andrew's day 10 bishop Jocelin.

clxvii. Grant by Joscelin bishop of Bath to William de Merton dean of Wells of the houses and site which Peter de Cycestria late dean held in Wells, between that of Richard the chancellor and that of Henry de London canon of Wells, to be held by the said dean and his successors. Dated in the chapter of Wells, xiii kal. Oct. 31 bishop Joscelin, by Master Walter de Maydenestan.

clxviii. Grant by Joscelin bishop of Wells, by consent of Peter dean of Wells and the chapter, that the hospital of St. John of Wells may have their chantry, bells, and a graveyard to bury the brethren of the house signed [with the cross] and living thereunder who resort there, saving to the dean and chapter their jurisdiction in the hospital so far as pertains to parochial right. All whom the said bishop and his successors (having reserved the right of patronage and their episcopal right) shall set over that house shall give canonical obedience and do fealty to the dean and chapter, and all chaplains secular or persons signed [with the cross] likewise.

clxix. Grant by Joscelin bishop of Bath to the dean and canons of Wells, to the increase of their common fund, of the church of Cungresbr' with chapels etc., saving to the bishop and his successors the vicarage thereof, to collate a fit person whenever vacant, the same to consist of one third of all issues of the said church, namely all small tithes, legacies and obventions to the altar, and a certain portion of the tithes of wheat: the court of the parson to remain to the dean and chapter, and another to be assigned to the vicar as near the church as conveniently may be, reserving to the bishop and his successors the assessment of the vicarage: also a grant of ten acres of his wood of Congresbyri, in exchange for two bundles of wood which the parson was wont daily to take therein, provided that the vicar have one third thereof: the vicar of his portion to provide the archdeacon's procuration and pay the cathedraticum other charges ordinary and extraordinary being apportioned, one third to the vicar, two thirds to the dean and chapter. clxx. Award of Joscelin bishop of Bath, in a dispute between W. dean of Wells and H. the subdean touching the jurisdiction of the city of Wells and the suburb; that whenever the dean be present the cognisance and debate of causes shall be his, in his absence when the subdean be present it shall be his, in the absence of both the power of appointing a judge shall remain with the dean; if one of the bishop's household be convened, the bishop or his official or a delegate of one of them shall take cognisance, the plaintiff following the court of the defendant any pecuniary penalty inflicted on any person of the city or suburb immediately subject to the bishop to go to the fabric of the church without deduction, other amercements to the person presiding at the time, deducting the stipend of the common apparitor: a common roll of proceedings to be kept, which each shall cause the other to have in his turn. Sealed by the bishop, dean, and subdean. Done at Wells, on the morrow of St. Philip and St. James 31 bishop Joscelin.

clxxi. Grant by Alexander de Muddesleg' to the church of St. Andrew Wells, Peter the dean thereof and his successors, of all the land, meadow, alder grove and moor lying within the circuit of the park of Muddesl', all the land he had on the east side of the road from Wedmore to Mudesleg', extending in a straight line from the west corner of a croft late of Godfrey eastward to land of the said dean and southward to the road towards the court of the said dean, and half an acre next the land of David eastward; in exchange for all the land which the said dean held in his demense in a cultura called Stanilond, for the meadow, alder grove and moor near the park eastward between grantor's meadow and the said park stretching to the southern corner of the park, a small piece of land of about half an acre lying on the west side of the manse late of Malger, and for two acres of land late of Robert Malherbe lying together in a cultura next la Hethe, and half an acre in Houerelulleg' lying next grantor's land. clxxii. Award of John abbot of Ford, Humphrey prior of Ford, and Baldwin prior of Axem' (nominated by the pope) in a dispute between Alexander dean of Wells and the chapter on the one part, and Ernisius canon of Wells on the other part, touching the land of Bideham which he possessed in the name of a prebend: Ernisius having resigned the same to Savaricus bishop of Bath and Glastonbury, and the bishop having restored it to St. Andrew towards the repair of the fabric, the dean and chapter, by consent of the bishop, delivered the land to Ernisius, not in the name of a prebend, paying yearly 40s. to the said church all the days of his life at Michaelmas and Easter, and granted him in life and death fellowship in the church of Wells, to have a stall in the choir, a place in the chapter, and full commons as other canons, nor need he find a vicar nor perform residence there unless he choose.

clxxv. Ordinance of Joscelin bishop of Bath, by assent of Peter dean of Wells and the chapter, that in place of the church of Everecriz, hitherto of the treasurer of Wells, the treasurer shall have the churches of Mertok, saving to the abbot and monks of St. Michael de Periculo Maris the portion they have therein, and saving that the church of Mertok be subject to W. archdeacon of Wells and his successors as it was before; and the church of Evercriz shall revert to the gift of the bishop and his successors to dispose as he did the church of Mertok before it was a dignity, saving to the dean and chapter the jurisdiction therein until they have such jurisdiction in the church of Mertok, henceforth of the treasurer, by the bishop and his successors with the consent of the archdeacon for the time being, as they had in that of Evercriz when it was his; then the church of Evercriz to be subject to the bishop and his successors.

clxxix. Letter patent of R. prior of Bath and the convent touching a dispute which arose between Peter dean of Wells and the said prior at a synod held by Joscelin bishop of Bath in the cathedral church of Bath in April in the 4th year of Pope Honorius III, which of them should have the first place on the right hand of the bishop, when it was agreed that the said prior should sit in the first place at that synod without prejudice to the right of the dean.

Grant by Robert 'minister of the church of Bath,' by assent of the dean and chapter of Wells, to Hubert de Ivelcestre his clerk, of the prebend of Bidesham, assigned to the proper uses of the church of Wells, to the intent that, if a vacancy occur in his lifetime, the first prebend after that assigned to Robert Pictau[iensis] the archdeacon shall fall to him, and the prebend of Bidesham revert to the church of Wells, and he shall in the meanwhile pay 20s. yearly towards the needs of the church, but have no vicar therein.

†clxxiii. Notification by Richard bishop of winchester to the king's justices that he made an accord with Walerand de Welesleg', his wife, and her sister, who claimed by the king's writ the land of Bidesham held by the church of Wells, giving a sum of money to one, and to Walerand and his wife twenty solidates of land, which their heirs yet hold; and that they by this agreement quitclaimed all right therein.

Statute of Savaricus bishop of Bath and Clastonbury that a solemn mass be celebrated daily in the church of Wells in veneration of the mother of God, and another for his predecessors, the brethren, benefactors, and all the faithful departed in the said church, assigning 10l. for ever in support thereof, namely 100s. of the profits of the archdeaconry which Maurice de Berkeley receives, and 100s. of the church of Cerda to be paid by the parson for the time being: future chaplains to be appointed by the chapter, to receive the stipends assigned to them, and such commons of bread as a canon would receive.

clxxx. Statute of J. bishop of Bath and Glastonbury, by assent of L. dean of Wells and the chapter, constituting 20s. to be paid yearly by the parson of the church of Dokemeresfeld a prebend of Wells (which annual payment Robert prior of Bath and the convent quitclaimed to the said bishop, granting him also the advowson of the same church), and instituting Luke the clerk canon thereof in the church [of Wells.] Done in the chapter of Wells, Easter 9 bishop J[oscelin].

clxxxi. Inspeximus by Richard archbishop of Canterbury and primate of a charter of King Henry II, reciting a plea in his court between R. bishop of Bath and Henry de Tilli concerning the manor of Dogemerefeld which the bishop claimed to have in his demense, and the fee of Dinra which the bishop said Godfrey de Dinra ought to hold of him in chief, and which Henry de Tilli claimed to hold of the bishop; also a fine between them, namely that the said Henry rendered into the king's hand the manor of Dokemeresfeld quit of all challenge by him and his heirs, and the king granted the same to the church of Bath' (as King Henry his grandfather did by his charter inspected) and rendered it to the hand of Reginald bishop thereof to hold in frank almoin, and likewise the fee of Dinra to hold in chief by the service of one knight, which fine was made by 100 marks paid by the bishop to Henry de Tilli; and confirming to the bishop and his successors the manor of Dokemeresfeld with houses in Winchester and all rights granted by the charter of King Henry his grandfather, and the fee of Dinra, so that G. de Dynra and his heirs hold that fee of the bishop in chief by the service of one knight. clxxxvi. (*Henrico), investing the said Stephen with the said vicarage. Consent of Thomas precentor of Wells and the chapter to an ordinance made by Joscelin bishop of Bath while beyond the sea, by assent of Ralph their dean and other brethren then with him, that after the decease or cession of William de Cerda there shall be paid of the manor of Cumba (whereof hitherto was paid 100s. to every prebend) ten prebends each of 10 marks, and one provostship, to be held of the bishop and his successors by one of those ten canons whom he shall elect; and such provost shall receive the said prebends of the manor, and pay yearly 10 marks apiece to the other canons at Wells by quarterly payments, retaining 10 marks for his own prebend, and the residue for his provostship; to his vicar of Wells he shall give yearly 3 marks of his prebend and provostship, the other canons two marks at least to their vicars; and with the manor the said provost shall have the church of Cumba to support these charges: but in order that the number of prebends of their church may be neither more nor less, on the death or cession of Richard the official, who receives yearly one prebend in the church of Wells of the bishop's chamber, namely of the money due from the archdeaconry of Wells, the bishop and his successors shall be quit of the payment of such prebend.

[cc.] Ordinance of Joscelin bishop of Bath, upon the resignation of Richard de Dynam, rector of Merk of the bishop's patronage, on Wednesdat after St. Simon and St. Jude 1242 in the great church of Wells, to put an end to disputes of long standing between the deans of Wells and rectors of Merk, by assent of John Saracenus dean of Wells and the chapter, that the said church henceforth be attached to the prebend of Wedmore, which is the prebend joined to the deanery of Wells, so that manor of Wedmore with the prebend and the church of Merk be a single benefice wherein shall consist the deanery of Wells, and that together with four prebends of 20l. which the deans do and ought to make of the dignity of the denery in the church of Wells belonging to the gift of the bishop and his successors, henceforth every dean shall make a fifth prebend of 4l. of the said prebend of Wedmore and church of Merk, to be joined to a prebend of 20s. payable of the church of Dogmeresfelde by the rector thereof for the time being, the collation as of other prebends being retained by the bishop and his successors, and the prebend following the custom and form of other prebends notwithstanding it is attached to the deanery. [cci.] Ordinance by Joscelin Bishop of Bath, by consent of John Sarracenus the dean and the chapter, whereas he has begun to rebuild and enlarge the church of St. Andrew Wells which was in danger of falling by reason of age, and has increased the provision for those ministering there by conferring upon the common fund lands, churches etc., that the bishop and his successors shall have daily when in residence 8d.for commons and 5d. for bread instead of 6d. and four white loaves: that the five parsons, namely the dean, precentor, archdeacon, chancellor and treasurer, instead of 6d. two white loaves and two black, shall have daily while in residence 8d. and 4d. for bread: all the other canons 4d. and 2d. for bread instead of 3d. one white loaf and one black: each vicar 1d. a day instead of the bread he used to have every other day from the grange, so that he be present at matins and other canonical hours or have lawful cause for absence provided he be in town: that all others instead of full daily commons of bread receive 1d. a day, and instead of half commons (½)d.: that if at any time the revenues of the grange be insufficient, the distribution shall cease until the end of that year, or until other provision be made, but it is believed that there will be enough for the daily commons and a surplus for distribution at the end of the year, and such surplus shall be distributed among the parsons and canons resident, that is to say all canons who have resided whether continuously or not during half the year, and the dean, precentor, chancellor and treasurer if they reside during two thirds of the year, saving other customs of the church of Wells, tam persone quam simplici canonico. Grant by Joscelin bishop of Bath, upon the petition of Peter dean of Wells and the chapter, that their men and all their tenements and fees shall be for ever quit towards him and his successors of murders and amercements which would belong to the king, the sheriffs, or their bailiffs, but for the liberties granted by King John and King Henry[III] to the bishop and his successors, and they shall have the distraint thereof; but if the dean, any of the canons, or the chapter or their successors fall into the mercy of the king, the sheriffs or their bailiffs, they shall answer to the bishop and content him, and he shall have the distraint. ccxxvii.Decree of J.bishop of Bath and Glastonbury, made after consultation with L. dean of Wells and the chapter, that whereas it has been usual for the bishops to take into their hands vacant churches of the archdeaconries of Wells, Bath, Glastonbury and Tanton, to retain two thirds of the fruits thereof, and for the third penny to answer to the archdeacons until the institution of a parson, such two thirds shall in future be applied to the increase of the common fund of Wells, the archdeacons holding the churches oftheir archdeaconries when vacant and answering for the said two thirds at Wells, they and their officials being first sworn to answer truly; and whereas W.de Bardenay archdeacon of Wells and W. de Wrotham archdeacon of Tanton and their officials are already sworn, they shall be content with their penny as before, and the bishop and his successors shall retain the wardships, answering by their official to the common fund for the two pennies belonging thereto, until the said archdeacons be sworn. Charter of William de Herpetre son of William son of John, rendering to St. Andrew and the church of Wells and to Reginald bishop of Bath and his successors the whole fee of Godfrey de Dinra and the service due from him, so that the said Godfrey and his heirs answer not to grantor and his heirs but to the bishop and his successors, abjuring upon the gospels, and resigning the same by a gold ring upon the alter of holy rood in the chapter of Wells, it being understood that the bishop and church of Wells had what is thus rendered: the said Godfrey in presence of grantor did homage to the bishop, and his heirs are bound to do likewise.
