2 Paul II.

De Dignitatibus Vacantibus.

1465.
6 Id. Oct.
(10 Oct.)
St. Peter's, Rome.
(f. 58d.)
To Thomas Offyn, dean of Ardfert. Collation etc., as below. It was set forth to the pope this day on his behalf that on the voidance of the deanery of Ardfert, a major dignity, by the deprivation of Gerard Fizimonis, (fn. 2) made by John bishop of Ardfert, that bishop made collation and provision thereof to the said Thomas (who had obtained no dispensation on account of his illegitimacy, as the son of unmarried parents who, in ignorance of any marriage impediment, clandestinely contracted marriage per verba legitime de presenti, and who were afterwards separated by a judgment of the church because they were related in the fourth degree of kindred, before which separation he was born), under pretext of which collation and provision he obtained and has held possession for five months, taking the fruits, although few, in good faith. The pope has therefore rehabilitated him by other letters, but has required him to resign. The said collation and provision being thus without force, and the deanery therefore still void as above, and also reserved, under the pope's late general reservation of all major dignities, the pope hereby makes to the said Thomas (who has duly resigned the deanery, who, without mentioning the said defect, was made a clerk, has studied letters for ten years, and has resided for two years in a university, (fn. 3) and intends to busy himself with the repair of certain churches belonging to the deanery) collation and provision of the said deanery, elective and with cure, value not exceeding 24 marks sterling; whether it be void as above, or by the promotion of the said bishop to the said church of Ardfert, and his consecration by papal authority, or in any other way. The pope furthermore specially dispenses him to act as a clerk, and to be promoted to all, even holy orders and receive and retain the said deanery, and with it any one other benefice, or otherwise [i.e. without the deanery] any two other benefices, with cure or otherwise incompatible, even if parish churches or their perpetual vicarages, or major or principal dignities, etc., or such mixed, namely, for three years in the case of parish churches or their perpetual vicarages, or in other cases for life, and to resign all such benefices, simply or for exchange, as often as he pleases, notwithstanding the said defect and the pope's late ordinance to the contrary, etc. Vite etc.
Concurrent mandate to the dean of Cashel, and John Ogoband and Eneas Odromoy, canons of Kilmore. Hodie dilecto filio. (P. and Alanus, N. de Castello. | P. xxxx.xx. Pridie Kal. Novembris Anno Secundo. de Varris.) [4¾ pp. In the loop of the ‘P’ of ‘Paulus’ is ‘Her.,’ as above, Reg. Lat. DCXXXII, f. 89.]
Prid. Kal. Nov.
(31 Oct.)
St. Mark's, Rome.
(f. 63d.)
To the abbot of Mothel (Motalia) in the diocese of Lismore, and Walter Juvenis (Young) (fn. 4) and Thomas Oflaheman, canons of Lismore. Mandate, as below. The pope has been informed by Rory Macconmaira, canon of Cloyne (Clonen.), that Nicholas Head, chancellor of Cloyne, has dilapidated and alienated and uselessly consumed the goods of the said chancellorship, and has committed perjury, to the shame of the clerical order. The pope therefore hereby orders the above three, if Rory, who for fear of Nicholas's power cannot safely meet him in the city and diocese of Cloyne, will accuse Nicholas before the said three, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said chancellorship, a nonmajor dignity with cure, value not exceeding 12 marks sterling, to Rory; notwithstanding that the pope has this day granted provision to be made to him of a certain perpetual benefice, called a parcel, (fn. 5) without cure and value not exceeding 6 marks sterling. Vite etc. (P. and M.Amici. P. xx. Residuum gratis pro deo. Tertiodecimo Kal. Decembris Anno Secundo. de Varris.) [32/3 pp.]

St. Mark's, Rome.
(f. 91.)
To the abbot of St. Mary's, Inishlounaght (de Surio), and the prior of Tathir (recte Cachir), in the diocese of Lismore. Mandate, as below. The pope has been informed by Maurice Oronan, perpetual vicar of the parish church of Tybrid in the diocese of Lismore, that Gillacius Okeyt, dean of Lismore, has dilapidated and turned to his own profane and unlawful uses the goods of the deanery, has committed simony and usury, allows its houses and possessions to go to ruin, rules it uselessly and badly, and is commonly reputed in those parts a usurer. The pope therefore hereby orders the above two, if Maurice (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and a married or an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) will accuse the said Gillacius before the said two, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said deanery, a major elective dignity with cure, value not exceeding 26 marks sterling, to Maurice. The pope furthermore specially dispenses him to receive it, and to retain with it for life the said vicarage, notwithstanding the said defect, etc. and the pope's late ordinance to the contrary Vite etc. (P. and A. de Cortesiis. | P. xxxvi. Nono Kal. Junii Anno Secundo. de Varris.) [2¾ pp.]

St. Mark's, Rome.
(f. 98.)
To the abbot of St. Michael's, Maio, in the diocese of Tuam, and Thady Obrain and John Ocaellaidhe, canons of Tuam. Mandate, as below. The pope has been informed by Riscerdus Bremicheam, clerk, of the diocese of Tuam, that Thomas Maraedagan (recte Macaedagan), provost of Tuam, has dilapidated and turned to evil uses the goods of the said provostship, and has committed simony. The pope therefore hereby orders the above three, if Riscerdus (who was lately dispensed by authority of the ordinary, on account of illegitimacy, as the son of unmarried parents, to be made a clerk, after which he was tonsured), will accuse the said Thomas before the said three, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said provostship, a non-major non-elective dignity with cure, value not exceeding 3 marks sterling, to Riscerdus. The pope hereby specially dispenses him to be promoted to all, even holy orders and receive and retain it, notwithstanding the said defect, etc. Vite etc. (P. and A. de Montia. | P. xii. Residuum gratis pro deo. Quintodecimo Kal. Februarii Anno Secundo. de Varris.) [4 pp.]

St. Mark's, Rome.
(f. 144.)
To the abbot of St. Mary's, Ynisschat, in the diocese of Killaloe (Laonien.). Mandate to collate and assign to Richard Micellyohyt, scholar, of the diocese of Ardfert (who has been ordered by papal authority to be dispensed on account of illegitimacy, as the son of a priest of a noble race of knights and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure, and who for fear of Richard's power cannot safely meet him in the city and diocese of Ardfert and obtain justice), if found fit, and after he has been dispensed, as ordered above, and after he has been made a clerk, a certain perpetual benefice without cure (simplex), called the rectory in ecclesiastical fee, in the parish church of Kyllconlla in the said diocese, value not exceeding two gold florins of the Camera, void by the death of Maurice Ohurry, clerk, although James Macstephna alias de Cursey, clerk, has unduly detained it for two years without any title or tittle of right; summoning and removing the said James and any other unlawful detainer. Laudabilia dilecti filii. (N. and N. de Castello. | N. xviii. Expedita Tertio Non. Junii Anno Secundo. de Bonaparte.) [3 pp.]
11 Kal. May.
(21 April.)
St. Mark's, Rome.
(f. 179.)
To Donald Ocailti, canon of Derry (Deren.). Mandate, as below. The pope has been informed by William Okahan, scholar, of the diocese of Derry, that Patrick Ocharmaic, perpetual vicar of the parish church of Achadduchart in the said diocese, an open fornicator, has committed simony and perjury, dilapidated and turned to his damnable uses certain goods of the said church, and perpetrated several other excesses and crimes about which he is defamed in those parts. The pope therefore hereby orders the above canon, if the said William (who desires to enter the clerical estate, and who was lately ordered by papal authority to be dispensed on account of illegitimacy, as the son of a priest and an unmarried woman related in the double and double third degrees of affinity, to be promoted to all, even holy orders and hold a benefice even with cure, and who is of royal race after the fashion of the Irish), (fn. 6) will be a clerk, and will accuse the said Patrick before the said canon, to summon Patrick and others concerned, and if he find the foregoing to be true, to deprive and remove him from the said vicarage and from the rectory of the said church, which are canonically united for his lifetime, and in that event to summon those concerned and, on account of the slenderness of their fruits, to unite the said vicarage and rectory for Patrick's lifetime and, if he be found fit, to collate and assign them to him, value not exceeding 8 marks sterling. The pope furthermore specially dispenses him to receive and retain them, notwithstanding the said defect, etc. Laudabilia probitatis. (N. and A. de Cortesiis. | N. xxv. Expedita Quarto Kalendas Junii Anno Secundo. de Bonaparte.) [5½ pp.]

(f. 221d.)
To John Wyly, perpetual vicar of the parish church of Kelton in the diocese of Whiteherne (Candide case), ‘salutem etc. Vite ac morum honestas aliaque laudabilia probitatis et virtutum meritanos inducunt ut tibi reddamur ad graciam liberales,’ i.e. the proem, with the few following words of the expositio: ‘Dudum siquidem omnia beneficia ecclesiastica cum cura et sine cura.’ (In the left margin at the beginning the usual initial letter is wanting, but in the right margin are two secretaries’ names ‘Alanus’ and ‘P.de Godis,’ showing that there was also a concurrent mandate executory.)

To the abbot of St. Mary's, Yniscat, in the diocese of Killaloe (Laonien.), and Dermit Maogillafadrya (? recte Macgillapadryc) and Donatus Ogradyn, canons of Killaloe. Mandate to collate and assign to Edmund Macellyehyt, canon of Ardfert (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, (i) to be promoted to all, even holy orders and hold a benefice even with cure, (ii) to receive and retain a canonry and prebend of Ardfert, value not exceeding 2 marks sterling, and the [perpetual] vicarages of the parish churches of Galle and Hyseltyn (sic) in the diocese of Ardfert, value together not exceeding 5 marks sterling, provision of which was successively by papal letters ordered to be made to him, and of which he is not in possession; and who afterwards had himself promoted to all, even priest's orders) the wardenship (custodia) of Belycotard in the collegiate church of St. Senan, Yayskaryh (recte Ynyskatyh), in the diocese of Killaloe, a non-elective office without cure (simplex officium), value not exceeding 6 marks sterling, void because Donald Okynnela has lawfully contracted marriage per verba de presenti and consummated it, although the said Donald has detained it for two years since the said voidance, as he still does; summoning Donald and others concerned, and removing him and any other unlawful detainer. The pope hereby specially dispenses the said Edmund to receive and retain the wardenship, notwithstanding the said defect, etc. Vite etc. (N. and A. de Castelio. | N. xviii. Expedita Pridie Non. Junii Anno Secundo. de Bonaparte.) [4½ pp.]

(f. 255.)
To the prior of St. Mary's, Kyllnethe, (fn. 7) in the diocese of Kildare (Daren.), and Thady Omaedna and Maurice Ocrunnylle, canons of Kildare. Mandate, as below. The pope has been informed by Charles (Carolus) alias Culama Oduyud, clerk, of the diocese of Kildare, that David Oduynd, perpetual vicar of the parish church of Kasleaynbreke alias Oregan in the said diocese, is an open [and] notorious fornicator and incestuary, (fn. 8) and, being under sentence of excommunication delivered by authority of the ordinary, and publicly proclaimed excommunicate, has celebrated or rather profaned masses and other divine offices in contempt of the Keys and of Holy Mother Church, thereby contracting irregularity. The pope therefore hereby orders the above three, if the said Charles (who has been made a clerk, notwithstanding his illegitimacy as the son of unmarried parents related in the third and fourth degrees of kindred) will accuse the said David before the said three, to summon David and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 14 marks sterling, to Charles. The pope hereby specially dispenses him to be promoted to all, even holy orders and receive and retain the said vicarage, or without it (fn. 9) any other benefice even with cure, and to resign them, simply or for exchange, as often as he pleases, and receive and retain instead another similar or dissimilar benefice, notwithstanding the said defect, etc. Vite etc. (Hug. and A. de Montia. | Hug.xx.
