To the dean of Kilmacduagh (Duacen.), John de Burgo, a canon of Kilmacduagh, and the official of the same. Mandate, as below. The pope has been informed by Cornelius Macardagan [sic], priest, of the diocese of Annaghdown (Anathonen. [sic]), that Maurice Macardagan [sic], perpetual beneficiary, called the rector in the sanctuary, in the parish church of Cilfarsa in the said diocese, when holding the perpetual benefice, called the rectory in the sanctuary, in the said church, which is of lay patronage, (fn. 2) obtained a mandate of provision to him by papal authority of the perpetual vicarage of the said church, then void, and gave and paid for a certain corrupt purpose a sum of money to the executor of the papal letters, thereby incurring simony and the sentences of excommunication etc. against simoniacs, and, being under the said sentences, got provision made to him of the said vicarage by the said executor, under pretext of which he obtained possession, and has detained it for about four years with the said benefice; and that, being under the said sentences he has celebrated masses and other divine offices. The pope, therefore, hereby orders the above three, if the said Cornelius, who on account of the said Maurice's power dares not meet him within the city and diocese of Annaghdown (Anactonen.), will accuse the latter before them, to summon him, and if they find the foregoing to be true, to deprive and remove him from the said vicarage, and in that event to collate and assign it, with cure and value 4 marks sterling, and also the said perpetual benefice, without cure and value 1 mark sterling, so long void by the obtaining of the said vicarage that its collation has lapsed to the apostolic see, to the said Cornelius; whether the vicarage be still void by the death of William Yeyndaelagin (fn. 3)extra R.c., or howsoever they be void. To the archbishop of Tuam. Mandate to make provision to Eugenius Omadagayn alias Seys, a canon of SS. Mary and John the Evangelist, Gill Abbey (de Antro Fymbarri), O.S.A., in the diocese of Cork, who is of noble birth, and has with licence of the apostolic see transferred himself from the order of Friars Preachers to that of St. Augustine, the monastery of St. Mary de Portu puro, Clonfert, O.S.A., value 40 marks sterling, void by the death of William Omadagayn extra R.c.; summoning and removing Charles Omadagayn, a canon of the said order, who intruded himself, without any title, and has with the support of lay power detained possession for between about sixteen and twenty years, and from fear of whose power the said Eugenius cannot safely meet him in the city or diocese of Clonfert. The pope hereby grants him faculty to be blessed by any catholic bishop of his choice in communion with the said see; without prejudice to the bishop of Clonfert. Sollicite considerationis. To the bishop of Kilfenora (Finoboren.), the treasurer of Kilfenora, and John Oflangayn, a canon of the same. Mandate, as below. The pope has been informed by Thomas Maigillauanath (recte Macgillauanach), clerk, of the diocese of Kilmacduagh (Duacen.), that after provision had been made to William Olocnayn by papal authority of the perpetual vicarage of Mearayd in the diocese of Annaghdown, of lay patronage, and after he and the late Donald Maigillauanach [sic] had for some time contended before a certain judge delegated by apostolic authority, he made a bargain with the said Donald that the latter should give up to him his possession of the said vicarage, and that the should pay Donald yearly for life a certain part of the fruits etc., after which Donald gave up the said possession, and William took it, and has detained the said vicarage for about ten years, and has paid the said part as long as Donald lived, thereby incurring simony and the sentences of excommunication etc. promulgated against simoniacs, lying under which sentences he has celebrated masses and other divine offices in contempt of the Keys, thereby contracting irregularity. The pope, therefore, hereby orders the above three, if the said Thomas, who is illegitimate, being the son of unmarried nobles related only in the simple fourth degree of affinity, and who from fear of the said William's power cannot safely meet him in the city and diocese of Annaghdown, will accuse the latter before them, to summon him, and if they find the foregoing the be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value 5 marks sterling, to Thomas. To the bishop of Killaloe (Laonien.), Theoderic Obryen, a canon of Killaloe, and the official of the same. Mandate, as below. The recent petition of John Yfflannygayn, a canon of Kilfenora (Fynaboren.), contained that Paul II, upon being informed by the late Donatus Obryen, a canon of Killaloe, that the said John had committed certain crimes, then confessed, ordered a certain judge, if Donatus would accuse John before him, to summon the latter, and, if he found what was stated to be true, to deprive John of the rectory of Ybrathayn in the diocese of Killaloe (which is of lay patronage, and was canonically united to the prebend, commonly called the prebend of Disertbracayn, which he was holding in the said church of Kilfenora, (fn. 4) of which union no mention was made by the said Donatus), and to remove him, and in that event to collate and assign the said rectory to Donatus; that the abbot of the monastery of Bullseany [sic], O.S.A., [sic], in the diocese of Kilfenora, the judge deputed in the letters of the said pope, wrongfully proceeding in the suit between Donatus and John, promulgated and unjust definitive sentence by which he deprived and removed the latter, and, within the lawful period for lodging an appeal, inducted the former; that within the said period John appealed against the said sentence and induction to the archbishop of Cashel, the metropolitan, who gave him letters patent, called letters of protection (fn. 5); that during the said period the parties agreed to arbitration, and that the bishop of Killaloe and the other arbitrators awarded that the proceedings of the said abbot were bad, that John's appeal was good, and that he ought to be restored to possession of the said rectory, as before the said sentence, and reserved to Donatus a yearly pension on the fruits etc. of the said rectory, to be paid to him by the said John, which reservation was null; that the said John and Donatus accepted the award, (fn. 6) and that the former, seeing that the latter was powerful and of a race of dukes, paid him the said pension, once only. The said petition adding that Donatus has died extra R.c., and that John fears lest he has incurred simony and the sentences etc. therefor, and lest the title which he had in the rectory has been weakened (fn. 7) by the said accusation and sentence, etc., the pope hereby orders the above three to absolve him (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a canonry and the prebend of Disertbratayn in Kilfenora, and the said rectory) from such sentence of excommunication, simony, and other sentences, etc., as he may have incurred, enjoining a salutary penance, and rehabilitate him, and, if they find the foregoing to be true, to unite anew the said rectory, for his lifetime only, to the said prebend of Diserbratayn, value 16 and 3 marks sterling respectively, so that he may take possession of the rectory, and retain it for life, without requiring licence of the ordinary or any other. To the prior of the secular and collegiate church of Ynischay in the diocese of Killaloe (Laonien.), and Dermit Ochaccllay and Theoderic Obrien, canons of Killaloe. Mandate, as below. The pope has learned that the rectory, commonly called the rectory of Drumdryb (or Drumdeyb, recte Drumcleyb) [and] Kymalle, in the rural fee of Ycormayt [sic], (fn. 8) in the diocese of Killaloe, of lay patronage, is void because Donatus Metrahy [sic], when holding it, obtained the deanery of Cloyne, a dignity with cure, collated to him by authority of certain letters of the present pope; and that Matthew Obreyn, clerk, of the said diocese, has resigned in the Roman court, before Robert Dondon, clerk, of the diocese of Limerick, notary by imperial authority, and witnesses, the perpetual vicarage of the parish church of Drumcleyb in the said diocese, of the possession of which, after he had held it in peace and canonically for some time, he was despoiled by Gilbert Omyer (?), priest, of the said diocese, who was supported by lay power. (fn. 9) The pope, therefore, hereby orders the above three, if they find the said resignation lawful, to admit it by the pope's authority, and, after summoning the said Donatus and Gilbert and others concerned, to collate and assign the said vicarage, value 10 marks sterling, void by Matthew's said resignation, and the said rectory, with cure and value 12 marks sterling, provided that its patrons consent, to Thady Macormayn, clerk, of the said diocese of Killaloe, who alleges that the said Donatus has detained the said rectory for about three years, and Gilbert the said vicarage for about a year, without any canonical titles; removing the said Donatus and Gilbert. To the abbot of St. Mary's, Monasteranenagh (de Maio,) in the diocese of Limerick, Maurice Macdayrivi [sic], a canon of Limerick, and the official of the same. Mandate, as below. The recent petition of Robert Stondun, priest, of the diocese of Limerick, contained that on the voidance of the rectory of Crom(n)a in the said diocese, of the patronage of Thomas Fizmoris, earl of Kildare (Kayldarie), by the resignation to William, bishop of Limerick, of Maurice Ym[u]lcorkara, who desired to become a layman, (fn. 10) the said earl, within the lawful time, presented the said Robert to the said bishop, who instituted him, in virtue of which presentation and institution he obtained possession. The said petition adding that the said Robert doubts whether the said presentation and institution he obtained possession. The said Maclanki, priest, of the said diocese (to whom he had by other letters ordered provision to be made of the said rectory), has this day resigned all right, without having had possession, etc., hereby orders the above three to collate and assign the said rectory, with cure and value 20 marks sterling, to Robert. The pope has been informed by William Macaedan, clerk, of the diocese of Annaghdown (Enachdunen.), that Amlavus Macaedre, perpetual vicar of Cyllenana in the said diocese, has committed perjury and has dilapidated the fruits etc. and other goods of the said vicarage. He, therefore, hereby orders the above three, if the said William, who is of noble birth, and who from fear of the power of the said Amlavus cannot safely meet him in the city or diocese of Annaghdown, will accuse him before them, to summon the said Amlavus, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, with cure and value 4 marks sterling, to the said William. To the prior of St. Mary's, Monaincha (de Insula Viventium), in the diocese of Killaloe (Laon[i]en.), the precentor of Killaloe, and Mathew Ocuyrch, a canon of the same. Mandate, as below. The pope has been informed by Cornelius Obanayn, clerk, of the diocese of Killaloe, that Donald Obanayn, perpetual vicar of Dundrarin in the said diocese, has committed and repeated perjury, has committed adultery, begetting offspring, (fn. 11) has alienated and converted to evil uses and dilapidated the tithes etc. of the said vicarage, and is utterly without learning and unfit for the rule of souls and the administration of the sacraments. (fn. 12) The pope, therefore, hereby orders the above three, if the said Cornelius will accuse the said Donald before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, with cure, and value 8 marks sterling, to Cornelius. Mandate to collate and assign to [Donatus] (fn. 13) Omorchw, rector of Moille in the diocese of Cloyne (Clonen.), value 4 marks sterling, the treasurership of Cork, a nonmajor dignity, value 12 marks sterling, so long void that its collation has lapsed to the apostolic see, although Patrick Lamles (recte Laules), priest, who is to be summoned and removed, has without any title detained it for between about twelve and thirteen years. To the abbots of Holy Cross de Othyrland and the Rock of Cashel (de Rupe Cassellis), in the diocese of Cashel, and the chancellor of Lismore. Mandate, as below. The recent petition of John Yhedian, dean of Cashel, contained that after the renewal by Martin V and Eugenius IV and Paul II of the sentences of excommunication etc. against simoniacs, he (in accordance with the ancient custom by which the dean of the said church has been wont to receive gifts, even in money, for inducting to canonries and prebends and perpetual vicarages and dignities in the said church (fn. 14) ) has, from the time of his obtaining the said deanery, received gifts, even in money for such inductions, thereby incurring simony and the said sentences; and that although it was provided in the synodal or provincial statutes of those parts that any one in the province of Cashel who should keep a concubine in his house, after the lapse of a month from monition canonically made to him, should be eo ipso deprived of his benefices, he kept a certain unmarried woman and had offspring by her, and has converted the fruits etc. of the said deanery (fn. 15) to her maintenance and other evil uses. The said petition adding that the said John (who for the sake of indulgences and remissions has come to Rome) desires to purify his conscience, and that in virtue of the said statute he fears lest he may be molested in regard to the said deanery, and seeing that, as the pope has learned, it is void on account of the foregoing, the pope hereby orders the above three to absolve the said John (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to receive and retain the said deanery, if collated to him in virtue of papal letters) from all sentences of excommunication etc. incurred on account of the foregoing, enjoining a salutary penance, dispense him on account of irregularity contracted, and rehabilitate him, and moreover to collate and assign him the said deanery, a major elective dignity with cure, value 24 marks sterling. The recent petition of David Pindragras [sic], priest, of the diocese of Tuam, contained that the rectory of the parish church of the rural lands of Rathcurnayn in the said diocese, of lay patronage, having become void by the death of John Prindagas [sic] extra R.c., and having been so long void that its collation had lapsed to the apostolic see, the patrons, after the said lapse, (fn. 16) presented de facto the said David, then in minor orders only, to the archbishop of Tuam, who admitted the said presentation, and instituted the said David, likewise de facto, under pretext of which presentation and institution he obtained possession of the said rectory, and detained it for more than a year, without, moreover, having himself ordained priest, and has continued to detain it for five years after the lapse of the said year. The said presentation and institution being therefore null, and the rectory being still void, as above, the pope hereby orders the above three to collate and assign the said rectory, which is without a church, and the cure of which is exercised in a certain other church by the perpetual vicar thereof, (fn. 17) and the value of which does not exceed 8 marks sterling, to the said David Prindragas [sic], who is of noble birth; whether it be void as above, or by the death of Maurice Ycuillynayn, or by the non-promotion of David Plemen’, or be void in any other way. To Fyntanus Olealur, a canon of Leighlin. Mandate, as below. The pope has been informed by James Omallchayl, clerk, of the diocese of Dublin, that John Ociretean, prior of St. Thomas the Martyr's, Haty, of the order of Cruciferi, in the said diocese, has allowed the house and church of the said priory to fall into ruin, and neglected to repair them, so that the ruin of the greater part of the buildings is to be feared, and has dilapidated and alienated its goods, even its immoveable goods, and has committed grave excesses and crimes for which he has been excommunicated by authority of the ordinary, and, being under such sentence of excommunication, has celebrated masses and other divine offices in contempt of the Keys, and otherwise taken part therein. The pope, therefore, hereby orders the above canon, if the said James (who has been dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be made a clerk, after which he was made a clerk), will accuse the said John before them, to summon the latter, and if he find the foregoing to be true, to deprive and remove him, and in that event to cause the said James to be admitted as a brother in the said priory, give him the regular habit, and receive his profession, and thereupon to collate and assign to him the said priory, conventual and with cure, and value not exceeding 20 marks sterling, (fn. 19) and induct him, first receiving from him the usual oath of fealty according to the form enclosed. Mandate to collate and assign to John Machagyrr, priest, of the diocese of Clogher (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and receive and retain the perpetual vicarage of Termuncommuyn in the diocese of Armagh, if he obtained it in virtue of papal letters by which provision thereof was ordered to be made to him, after which he was so promoted and obtained the said vicarage, of which he is not in possession) a perpetual chaplaincy in the church of Clogher, with cure and value 5 marks sterling, so long void that its collation has lapsed to the apostolic see, although John Occullen, priest, of the said diocese, who is to be summoned and removed, has detained possession for between two and three years after the said lapse, without any title or right.
