3 Non. May. Avignon. (f. 298d.)	To the archbishop of Canterbury, and the bishops of London and Norwich. Mandate, on petition of Thomas de Holand, knight, stating that his wife Joan, daughter of Edmund, earl of Kent, to whom he was married upwards of eight years ago, was given in marriage to William, son of William de Monteacuto, during the absence from the realm of Thomas, then in Prussia, and that the said William and Margaret, Joan's mother, opposed Thomas in recovering his conjugal rights. The cause was, at the instance of Thomas, brought before the pope, and a suit of nullity of marriage against William and Margaret and Joan was ordered to be heard by Aymar, cardinal of St. Anastasia's, but Joan was caused by William to be detained in England, and kept in custody. She is to be enlarged so as to be able to appoint a proctor, and carry on the cause.

Confirmation, with exemplification, of the appropriation by Roger, bishop of Lichfield, to the prior and convent of Maxtoke, founded fourteen years ago by William Clinton, earl of Huntingdon, of the church of Filingley, in the diocese of Coventry. The bishop of Coventry's letters, and those of the prior and chapter, are dated at Brewode, 5 Sept. 1345, and at Lichfield, 7 Oct. 1345.

Mandate to induct Geoffrey, bishop of Ferns, into that see, to which, being reserved to the pope, he was appointed on the death of Adam; Hugh de Saltu, canon of Dublin and chaplain of archbishop Alexander, who was intruded into the said see, being cited to appear before the pope.

Mandate to publish the excommunication for contumacy against Philip de Weston, who under pretext of king Edward's presentation, procured himself to be intruded into the deanery of York on its voidance by the consecration of William, archbishop elect, the same having been given by the pope to Talairand, cardinal of St. Peter's ad Vincula; Philip having disobeyed the papal citation to appear within ninety days.

1347. 2 Kal. Aug. Avignon. (f. 322d.)	To the archbishop of Canterbury, and the bishops of London and Chichester. Mandate, on petition of Edmund de Arundellis, to cite Richard, earl of Arundel, Isabella, daughter of Hugh de Dispensariis, and Eleanor, wrongly called Joan de Bellomonte, touching the following matter:— Earl Richard and Isabella married and begot Edmund, but Robert, bishop of Chichester, under pretext of papal letters, surreptitiously obtained, pronounced sentence of divorce between them, thus bastardising Edmund. Richard thereupon married Joan de Bellomonte, daughter of the uncle of Isabella. Papal commission was issued to William, cardinal of St. Stephen's, to cite the said Richard, Isabella, and Joan, Edmund being then eighteen years old, Master Walter de Segrave and Geoffrey de Borgeys being proctors of Richard. After divers acts, it appeared that Joan should be called Eleanor, and that she was not daughter of Isabella's uncle (soror patruelis), but daughter of Isabella's aunt (neptis ex amita). Edmund was by this time twenty years old, and the pope was petitioned to relax the impediment of age touching the taking of an oath, upon which the cardinal was commissioned to proceed in the cause, Edmund being present, and Richard and Isabella by their proctors, Geoffrey de Burgeis and Simon de Sagio. Appeal was made against the citation of Richard, Isabella, and Eleanor, and was heard before Imbert, cardinal of the Twelve Apostles, Edmund and Geoffrey being present, and Bartholomew de Bononia being proctor for Isabella. Cardinal Imbert supported the action of cardinal William, and condemned the appellants in costs. Appeal against this was made by earl Richard and Isabella, upon which the pope issued this mandate, viz. to cite them within twenty-three days, to appear in person or by their proctors at the papal court within sixty days.
