To Henry, archbishop of Canterbury. Faculty as below. The pope has learned from his letters that in a synod lately celebrated by him at London, the clergy of his province of Canterbury complained that a number of abbots and priors of England, overstepping the bounds which their want of dignity and of wealth prescribes, (fn. 2) wear the mitre and pastoral staff and publicly bless the people like bishops, without other cause than, perhaps, to be deemed by the onlookers the equals of bishops; wherefore the archbishop has, on behalf of the said clergy, petitioned the pope not to grant similar graces in future, and to revoke any which he may have already granted. The pope, therefore, who intends not to diminish, but to increase the pastoral dignity, signifies to the archbishop that he has always abstained from such grants and intends to do so in future, for it seems to him unworthy that they who cannot use the office and function of a bishop, should use his insignia, the which in their case savour of ostentation rather than produce the good of souls (fn. 3). The pope has moreover learned that certain non-exempt priors of cathedral and conventual churches, and masters and provosts of collegiate churches in the said province, of divers orders, do not pay due reverence, alike in the matter of processions and of the ringing of bells, according to custom, at the time of the coming of bishops to their churches, walk side by side with them, (fn. 4) and make themselves equal to them in honour. Considering therefore that, where the order of dignities is not kept, confusion must follow, and that it is meet (honestum) that each be content with his rank and vocation, the pope grants faculty to the archbishop to exhort, monish and require all such non-exempt priors and masters and provosts, especially in those churches of which bishops were the founders or are the patrons, to show due reverence to their bishops alike in the said processions and bell-ringings, at the time of their arrival, etc., compelling obedience by ecclesiastical censure etc. without appeal. After he had been dispensed by papal authority, as the son of a married man and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and had obtained the parish church of Marwyal in the diocese of St. Asaph, and had held it for some time, upon the voidance of the parish church of Modburley in the diocese of Lichfield by the deprivation of William Symnel by a definitive sentence of the ordinary, the patrons thereof, John Trotebek, donsel, of the said diocese of Lichfield, and Margery his wife, pre- sented him (who had obtained no other dispensation on account of the said defect) to bishop William, who instituted him, under pretext of which presentation and institution he is still in possession, having resigned Marwyal. The pope hereby rehabilitates him, decrees that the said presentation and institution hold good, and dispenses him to retain the said church, value not exceeding 26 marks sterling, and to receive and hold two other benefices with or without cure, compatible with one another and with Modburley, and to resign all three, simply or for exchange, as often as he pleases. At his recent petition (containing that when holding the perpetual vicarage of Seckworth in the diocese of Salisbury, he obtained, collated to him by authority of the ordinary, the above rectory, and held them together for some time, believing that the said vicarage was without cure on the ground that the church itself of Seckworth was collapsed, that the houses and inhabitations in the parish were uninhabited and exposed to ruin, with the exception of two only, and they distant from the said church and from one another, and that, with this exception (alias), the said church had no parishioners) the present pope by other letters decreed that the said church of Seckworth (as long as it should be without parishioners otherwise than in the said two and in future portable or temporary houses, huts or shelters (fn. 9) ) should be deemed to be and should be without cure, and could be held, without any dispensation, together with any other benefice with cure or otherwise incompatible. At his present petition the pope hereby rehabilitates John, who is of noble race, on account of his having held the said two benefices together, decrees that the said collation of the above rectory holds good from the date of these presents, that he has not incurred the penalties of John XXII's constitution 'Execrabilis' by having held together the said vicarage and rectory, value not exceeding 3 and 20 marks sterling respectively, and that he can and shall retain them together, even without dispensation, as long as the said church is without parishioners otherwise than as above. On the voidance of the church of Killaloe by the resignation of the late Eugenius, made by his proctor William Ohedyan, a canon of Lismore, to the late Jordan bishop of Sabina, then of Albano, and by Martin V's admission of the resignation, that pope made provision to James, [now] bishop of Killaloe. Subsequently, on its being set forth to the present pope on behalf of the said bishop James that some alleged that the said church had become and was still void, not as above, but by the death of the said bishop Eugenius, and that therefore bishop James, who had meanwhile had himself consecrated, doubted the validity of the said provision, the pope granted that the same and its consequences should hold good howsoever the said church became void. At the recent petition of the said bishop James (containing that before the said provision, and after Martin V had renewed, and had reserved to himself absolution from, all sentences etc. of excommunication etc. promulgated by his predecessors against simoniacs, he committed simony, and that, whilst bound by the said sentences, he was consecrated and has celebrated masses etc., has administered the said church, and taken fruits etc. of its episcopal mensa) the pope orders the above archbishop to absolve the said bishop from the said sentences etc., imposing penance, rehabilitate him and dispense him to act as a bishop; the pope ratifying hereby, in that event, the acts of his administration, and granting that the said provision and its consequences shall hold good as if he had not committed simony, and had not been bound by the said sentences. To Master Peter de Monte, doctor of canon law, an apostolic notary and collector in the realm of England. Mandate as below. The recent petition of Walter Meone, priest, of the diocese of Winchester, contained that when in or about his eleventh year he was induced, or rather seduced, by the suasions and blandishments of a certain Thomas, the abbot of the Premonstratensian monastery of SS. Mary and John Baptist, Dureford, in the diocese of Chichester, (fn. 13) to enter that monastery; that compelled by threats and fear of the said abbot he within the year of probation, after taking the habit against his own will and the will of his parents, made his regular profession, and remained thereafter in the said monastery, under diligent care and very watchful observation for about seven years against his will, and, having by order of the said abbot been meanwhile promoted to all minor and holy orders, short of the priesthood, ministered therein; that, nevertheless, he seized the first opportunity and left the said monastery, put off the said habit and returned to the world, and ministered in the said orders; and that subsequently, desirous of being ordained priest, and unable to do so on account of having put off his habit, he (after having protested before the said abbot and divers other persons that he did not intend, by resuming it, to be bound in any way to the said order) resumed the habit, which he put aside once more after he had been ordained priest, returned to the world, and has ministered in a secular habit and in the said orders and the priesthood. The said petition adding that Walter desires to remain in the world and minister in his orders, the pope orders the above Peter, if he find the above to be true, after absolving Walter from excommunication etc. incurred, and after rehabilitating him, to declare that he is not bound to the regular observance of the said order. The pope lately, upon learning that John Clerici, then rector of the parish church of Irwyn in the diocese of Glasgow, a papal chaplain, proposed to resign that church, ordered the abbot of Neuwbotyl in the diocese of St. Andrews to admit the resignation, and to collate and assign the said church to the above William. At William's recent petition—containing that the said John held, not the rectory, but the vicarage of the said church, and that William, before execution of the said mandate was proceeded to, under pretext thereof and without any other title, took possession of the said vicarage and detained it for some months, and subsequently (after, under the same pretext, the resignation [of John] had been admitted and the vicarage, thereby void, had been collated to William) detained possession for several more months, as he still does—the pope rehabilitates him, but requires him to resign. After Martin V had dispened him to hold for seven years with the parish church of Wynepole (sic) in the diocese of Ely any benefice with cure or otherwise incompatible, even if a parish church etc., and to resign them, simply or for exchange, as often as he pleased, he, in virtue thereof, resigned Winepole (sic) and obtained the parish churches of Baynthon (sic) and Hugate, in the diocese of York, value not exceeding 100 and 30 marks sterling respectively; and the present pope dispensed him to hold the said two churches even after the approaching end of the said period, and to do so for life, and to resign them, simply or for exchange, as often as he pleased, and hold instead two other incompatible benefices, even if parish churches etc. The pope hereby grants that his said dispensation shall hold good from the date thereof, notwithstanding that it contained no mention that Robert was then holding a canonry with the prebend of Barmtisburi in the collegiate church of Wyntorne (sic) in the diocese of Salisbury, value not exceeding 24 marks.
