June 1. William Lowndes to the Auditor of the Receipt to issue 300l. to Richard Whitworth out of loans made at the Exchequer for the use of the Civil List. Disposition Book XIV, p. 222.
Same to the Customs Commissioners. I have read to my Lords your memorial of the 16th May last concerning money paid by the several [outport] collectors of customs, viz. for imprest, conduct and subsistence money to seamen. Treasury subscription for the execution of a warrant dated May 10 from Peregrine Bertie [Vice-Chamberlain of the Household] to the Master of the Jewel House for the delivery to the Honble. Sir William Beeston, Governor of Jamaica of [plate for the Chapel Royal there viz.] two little flagons, one chalice, a paten and a receiver to take the offerings in; not exceeding 60l. in value: all which the bishop of London has certified to have been lost in the late earthquake at Jamaica. Treasury reference to the Principal Commissioners of Prizes of the petition of Capt. James Moodie shewing that he sold the hulls of 2 prizes at a public sale at Scanderoon and Smyrna which prizes were taken by Capt. Rigby and bought by Mr. Cha. Gibson for his [Capt. Rigby's] use, who when he came to pay for same stopped a third part as due to him and his ship's company by Act of Parliament as Captain: and when the ships came home "they" seized the same, for which reason petitioner was arrested in an action of 6000l. until he could sell the two prizes; which he could not do but was necessitated to give bond for the whole value which amounted to 470l. 4s. 0d.: that he offered to pay the tenths and other two-thirds but "they" insist to have the whole of petitioner's bond "unless your Lordships will be pleased to order us to deduct what is due to the said Capt. Rigby as captain": therefore praying the Treasury Lords' order to the Prize Officers to take the said two thirds with the tenth which are due [respectively] to the King and the Navy Treasurer [for the chest] at Chatham and to allow the captor's third according to Act of Parliament. In reply to your petition praying to be heard and that the process issued against you may be stopped, my Lords do not think fit to recall the same unless you forthwith consent to try the issue. Treasury warrant to the Surveyor General of Crown Lands for a particular of the office of Havenor of the Duchy of Cornwall in order to a new lease thereof to John Worth for 99 years terminable on the lives of John Worth, Thomas Herle and Robert Corker: at the former rent of 30l. per an. and fine of 1600l.
Prefixing: (a) said Worth's petition for same ut supra p. — (b) said Surveyor General's report thereon. I reported in Sept. last on the petition of Nicholas Morice for this office and rated a fine of 1600l. but he refused it. I still consider the lease deserves such a fine. William Lowndes to the Earl of Ranelagh to report on the enclosed petition [missing] of William Sawle, clerk, praying payment of 30l. or 40l. in part of the arrears due to him as Chaplain in Col. Stanley's Regiment. Out Letters (General) XV, p. 441.
Treasury reference to the Customs Commissioners of the petition of Thomas, Lord Wharton shewing that one Hugh Watson whom he employed to manage his affairs and lead works in the north did get together a considerable quantity of lead and sent it off to Holland and afterwards withdrew himself thither; since which time a ship of the said Watson's coming to Newcastle the petitioner has laid hands on her and entered and paid the Duties but upon some question on the Navigation Act the officers there have laid their hands on her likewise: therefore praying that the ship may be delivered and a noli prosequi entered as to the King's part in the seizure. Same to same of the petition of Roger Laming to the King shewing that for many years he has been a hoyman between Margate and London; that in Oct. 1693 one Child, "then an officer there" put on board petitioner's vessel some goods to be carried to London, which goods on arrival proved to be French silk and lace and were seized and condemned in the Exchequer Court: "that there is a verdict against him for 760l."; that the goods were put on board without his privity by petitioner's servant and he had no more for carrying same than for other carriage and if the fine be levied 'twill be his utter ruin: therefore praying that the Attorney General may enter satisfaction upon the said judgment. Ibid.
Treasury warrant to the Surveyor General of Crown Lands for a particular of 3 tenements, parcel of the manor of Bonyalva and Duchy of Cornwall (now in lease to Mary Rose and upon her surrender): in order to a lease thereof to Isaac Garner for 99 years terminable on 3 lives: at the old rents and fine of 80l.
Prefixing: (a) note of said Garner's petition. (b) said Surveyor General's report on said petition. The premises were granted to Mary Ross, spinster, by Exchequer lease 1686–7 Mar. 10 see supra Cal. Tr. Bks. Vol. VIII p. 572 viz. Kekewich's three tenements (valued to her at 40l. per an.) and 2 other tenements (valued to her at 23l. per an.). The first three are not now worth above 35l. per an. and the other two not above 20l. per an. As petitioner and Mris. Ross live in London 'tis no wonder if their lands have been impoverished by their tenant or agent in Cornwall. I rate the exchange of lives at 100l. fine unless regard be had of Garner's misfortune, he having lent more money thereon than he can sell it for and has lately lost the life [term] of Kekewich "who being committed to Newgate for coining, made away with himself there." June 8. Royal warrant under the King's sign manual dated Kensington to the Earl of Ranelagh, as Paymaster of the Forces, to take off the respits on Major John Lowther's Company in the Regiment of Col. Edward Dutton Colt amounting to 272l. 19s. 8d. as follows; and in pursuance thereof in making out the debentures for the pay of said Regiment to compute the pay of the said Company complete according to the establishment from 1 Sept. 1692 to 31 August 1695 notwithstanding any muster rolls wanting for that time: all on the petition of Sir William Lowther, father and administrator to the said Major Lowther.

Same to the Attorney or Solicitor General for a great seal for a grant to the Mayor and Burgesses of Newcastle-on-Tyne of the office of Tronor and Peisor of the port of the said town and the members and creeks thereto belonging for the lives of William Davyson of Grays Inn gent., (son of Timothy Davyson late of Newcastle-on-Tyne merchant deceased), William Ramsey of Newcastle merchant and Robert Tod of Kenton Co. Northumberland: with a clause that the Corporation shall not constrain any person to weigh his goods at the public scale: the said Corporation having represented that the said office is now void and in the gift of the Crown and that though they built the houses and warehouses where the said office is kept the persons who lately had the office have nevertheless exacted great Duties which tended to enhance the price of commodities to the great discouragement of trade and have therefore prayed a grant of the office to the intent that all the King's subjects trading to the said port may be freed from the said inconveniences: to which petition the Customs Commissioners offer no objection. Same to the Clerk of the Signet for a privy seal for 1200l. per an. to Francis Bond, President of the Council of the Island of Barbados, to wit for the period during which he took upon him the execution of that government on the death of Col. Francis Russell late Captain General and Governor of said island until the date of the commission to Ralph Grey the present Governor thereof: to be paid out of the Four and a Half per cent. Duty there: all by reason that by the King's instructions only a moiety of said salary is allowed to the Commander-in-Chief during the absence of the Governor but the said Bond has represented that he maintained the dignity of that government under great difficulties in time of war and mortality at his own great expense and charge much above what the said [moiety] allowance will come to, and the neglect of his own private affairs and the impairing both of his health and estate. Treasury reference to the Customs Commissioners of the petition of James Whitwood, collector of Customs at Deal, shewing that the said Commissioners have lately suspended him and restored the surveyor who was accused of the same crime which was that he had beat and discouraged one of the tidesmen in a seizure he had made: which petitioner denies because many boatmen and tidesmen had possession of the seizure: that he has been surveyor and collector for 14 years and never committed a questionable act: "that whereas the Commissioners have proposed that Mr. Ja. Smith, collector of Chichester, might be removed to the petitioner's collection and him to Mr. Smith's, prays to be disposed either way as to their Lordships shall seem meet." Same to same of the memorial of William Hunt shewing that by order of the Treasury Lords the rents of Michaell Wicks were ordered to be stopped till he had made out his account with the King which account was referred to [by] the Barons of the Exchequer to Mr. Eden; that notwithstanding the said order Wickes still receives his said rents and maintains a suit with the King with the money and has not yet made up his accounts: therefore praying Treasury direction herein. Treasury warrants to the Principal Officers and Commissioners for Prizes to appoint John, George and Robert Maxwell to be joint agents for Prizes in the island of Providence: to be rewarded according to the merit of their services, without any standing salary: the said Commissioners having been lately informed of some prizes that have been brought into the said island, where there have been no agents yet appointed.
Charles Thomas and Talbot Edwards as agents for all prize ships and goods brought into the island of Barbados since the beginning of the late war; it being represented that several prizes have been carried thither and disposed of, of which no account has as yet been rendered.
George Heathcote and Josiah Heathcote as agents for prizes at Jamaica: the said Commissioners having represented by their memorial of May 31 last that there hath yet been no account rendered to them by their agents in Jamaica of any prizes brought into that island. Ibid.
Royal warrant under the King's sign manual dated Kensington, to the Lords Justices Ireland to order the payment of 1124l. 3s. 35/8d. to Lawrence Stanyon in repayment of an overpayment on the account made up by Edward Richbell, deceased, and the said Stanyan on behalf of themselves and the rest of their partners in the late farm of the revenues of Ireland all ut supra p. 302–3: the late Lords Justices of England having directed such a repayment as above ut ibid but no part of the said sum having yet been paid. Same to Lord Edward Russell, Treasurer of the Chamber, to pay Theodor Randue, Housekeeper in Windsor Castle, the additional allowance of 57l. 16s. 8d. per an. from 1698 Lady Day to make up his present salary 320l. per an.: he having represented that the daily expense he is at in keeping servants and buying of necessaries as mops, brooms, pails, tubs, scrubbing brushes and several other things used by them in looking after the said Castle, together with the taxes and other charges, exceeds the present yearly allowance of 262l. 3s. 4d. by above 40l. per an. and that he hath no other wages nor board wages. Treasury warrant to Sir Thomas Trevor, Attorney General, to enter a noli prosequi as to the King's part of the forfeiture of the English built ship John and Barbara, Francis Burton master, owned by John Bridge of London merchant et al and of the parcel of pitch on board owned by William Davenport merchant: the said ship having laded at Hamburg in April last for London with pipe staves and piece goods when the said pitch was laded for Davenport by Richard Beale of Hamburg before receipt of the instructions (sent through Mr. Blundell a merchant in London) countermanding the said lading of pitch on learning that the importation of pitch from Germany or the Netherlands on any pretence whatsoever was contrary to the Act of 14 Car. II, c. 11; and the master could not put out the pitch without unlading the ship which the merchants at Hamburg would not permit but told him the wind was fair and being down the river loaden for England if he did not sail they would protest against him and ruin him: wherefore the ship on arrival is seized by Charles Robertson an officer of London port. Same to Sir Thomas Trevor, Attorney General, to enter a noli prosequi as to the King's part of the forfeiture of the ship Fortune of Narva, Jno. Russell master: it appearing from the petition of Rudolph Knipe and Meyer Berenbergh correspondents to and on behalf of Christopher Van Kocken, Johann Clayhills et al natives of Sweden and owners of the said ship, that the said master contrary to the orders of the owners and without their privity agreed with Francis Riggs to go with the said ship to Norway and there load on his account masts, timber boards and other naval stores for Portsmouth for the King's use; but on arrival she is seized as not being qualified as directed by the Navigation Act, being a Swedish ship owned and manned by Swedes: which petition is supported by the affidavits of Sir Benjamin Ayloff and Francis Collins that the said Ayloff (being empowered by the owners) did order the master to proceed in ballast to Narve, instead whereof the master engaged for the said voyage to Norway, which when Ayloff knew he discoursed the said master at the Exchange touching such irregular proceeding and made him sensible that the ship was not qualified for such voyage and offered to free him from an action by Riggs the freighter, whereupon the master promised to go to Narva and thereupon the said Ayloffe and Collins did make considerable insurance for the said master on the ship "from this port [London] to Narve," the premium of which insurance was totally lost by his going to Norway: on which grounds the Customs Commissioners conceive that the petitioners may deserve favour.

Same to same to enter a noli prosequi as to the King's part of the forfeiture of the ship Prudence laden by Hugh Watson in Holland with merchandise for Newcastle and of which Thomas, Lord Wharton has possessed himself &c. ut supra p. 352: the Customs Commissioners having reported that they instructed the officer at Newcastle not to interrupt the delivery of the said goods if the said Lord's agent should possess himself thereof and pay the duties; but that as the ship was forfeit by having a small parcel of prunes on board they were not solicitors to prevent the condemnation of the ship and she had been accordingly condemned: on which report the Treasury Lords are willing to gratify Lord Wharton as to a noli prosequi for the King's part "but will not intermeddle with the property of any persons therein."
