April 1673, 16-30

April 16 Entry of the reference to the Surveyor General of Crown Lands of a petition of Col. Villers for a new patent for the custody of the lighthouse of Tynemouth with three roods of ground more added to his grant. The referee to report the King's rights in said ground, and whether it may not interfere with the rights of succeeding Governors [of Tynemouth Castle] to have a house within the castle. Out Letters General III. p. 283.
Same of same to the Customs Commissioners of the petition of John Knap concerning Red Saunder Wood belonging to him and seized by a Custom House official as forfeited by the Navigation Act. Ibid, p. 284.
Same of same to Sir R. Long et al. of the petition of William Allington concerning 1,700l. assigned to him on an order charged on the Customs by the administratrix of John Colvile which Sir Rob. Long directed to be paid by Mr. Squib, one of the Tellers of the Exchequer, who has not paid same ; and also concerning another sum of 600l. with interest assigned to him out of an order for 1,000l. which is not paid. Treasurer Clifford's warrant to the Receipt to issue 20,000l. upon orders [remaining unsatisfied in the Exchequer] to the Treasurer of the Navy for payments of the Yards. The said 20,000l. "will be lent into the Receipt" by Anthony Stevens, gent., and orders are to be drawn for his repayment out of the first quarter of the Eighteen Months' Assessment, viz. 10,000l. thereof after 60,000l. Treasurer Clifford's warrant to Auditor Phelips or his deputy. Alderman Edward Backwell's accounts of moneys imprested to him by His Majesty are now before you for a speedy dispatch thereof. In stating same you are to cause such interest and gratuity, as you find allowable on the same, to be made principal money at the end of every six months. Ibid.

April 16 Treasurer Clifford's subscription of a docquet, dated 1673 March, of a pardon to Mary Lenthall, one of the daughters of Dr. Thomas Lenthall, one of the Physicians in ordinary to the Queen Consort, of a fine of 40 marks and finding security for her good behaviour for a year imposed upon her in the King's Bench, being convicted with one Henry [erased] Story and others of a riot in endeavouring to take Elizabeth Gilburne from the custody of Mary Gilburne, her mother. April 17 Treasurer Clifford's warrant to Charles Smith, Receiver of Hearthmoney for co. Gloucester, and to Anthony Parsons. Auditor for said county, to pay and allow in account to Philip Dorney, Clerk of the Peace for said county, for his allowance of 1d. per for engrossing the views [surveys] of the Hearthmoney of said county for three half-years ending 1670, Sept. 29 (in order to the making up of Nath. Whetham's account as late Receiver of said duty), and transmitting same to the King's Remembrancer's Office ; the said Whetham not having paid him said allowance and being now displaced for his neglect and misdemeanour in that service. Entry of the reference to the Customs Commissioners of the petition of Peter Barr, of London, merchant, concerning a ship called the "Clessurer" [Chasseur] alias the Hunter of Honfleur, France, Jaques Sanson master, belonging to the Royal West India Company of France, being seized with her cargo, the petitioner being necessitated to unlade the goods here, the ship being found defective, and praying to pay only Customs as from the English Plantations. April 21 Sir Ro. Howard to Sir Lionell Jenkins to send tho Lord Treasurer his opinion whether the duty on Appearances (as by the late Law Duty Act) be not payable in Ecclesiastical Courts as well as others. Out Letters General III. p. 283.
Treasurer Clifford's warrant to the Receipt for the delivery of orders to Sir Stephen Fox for 3,413l. 16s. 8d. in full of the arrear of 31,438l. 13s. 11d. (being orders formerly signed for said Fox for interest for moneys borrowed by him, but said orders being by Treasury direction to remain in the Exchequer until directed to be delivered to him, and there having been so delivered to him by several Treasury warrants 28,024l. 17s. 3d. being the total of several interest accounts) : and further for the drawing of fresh orders for 3,874l. 5s. 5d. Southampton, that upon the assignment of a lease of a park called Moore Park by the present lessee to Simon Smyth, Esq., the present Receiver there [i.e. of Crown Revenues, co. Southants], for His Majesty's use, they pay to the Duke of Albemarle 300l. per an. by half-yearly payments until the said Duke can make a final conveyance of the premises, at which time the King has ordered him [to be paid] 7,000l., being the purchase money thereof : and further to pay the said Duke 22l. Same of same, dated 1673, April, of a grant to Sir Walter Vane and Sir Philip Honiwood of the estate of the late Robert Honiwood, Esq., deceased, forfeited to the King by his not coming in upon proclamation according to the Act of 17 Car. Royal warrant for a privy seal for a grant to George Viscount Grandison and Edward Villiers of the rents and arrears of rents arising by licences to retail wines due at any time between Lady Day last and the date hereof and any rents or arrears thereof which shall at any time become due on the same revenue before Sept. 29 next : to be received and enjoyed by them without account. Treasurer Clifford's warrant to Auditor Aldworth. The yearly fee of 26l. 13s. 4d. due to the chief warden of His Majesty's honor and castle of Barnard, commonly called Bernard Castle, in the bishopric of Durham, is payable by Lady Frances Vane. For some time she has refused payment but has now agreed to pay 150l. in lieu of all arrears thereon, and the Earl of Carlisle, Chief Warden of said Forests, has accepted same in full thereof. By the privy seal of Mar. 29 last said 150l. is granted to said Earl to his own use without account and said Lady Vane is discharged thereof. On payment of said sum you are hereby to cause all said arrears to be absolutely discharged. Warrants Not Relating to Money III. p. 367.
Report from Treasurer Clifford to the King on the petition of William Burnet. The Surveyor General of Crown Lands reports that it may be no disservice to reward petitioner's industry with a grant for seven or ten years of all such Crown rents as he shall discover in England and Wales as not being in charge since 1660, June 24, and also of all such Crown rents as being in charge have not been answered since 1637, with the arrears thereon since 1660, June 24, with a reservation to the Crown of a sixth part of such rents and arrears. Apr. [? 21] Treasurer Clifford to the Customs Commissioners to obey an order of the King that all such clothes, vestments, scenes, ornaments, necessaries and materials directly designed for the proper use of a company of Italian comedians lately arrived here should be admitted to entry as neither contraband nor prohibited and should be free of Customs. Ibid, p. 360.
April 21 Instructions from same to same. In cases of ships and goods brought in as prize and restored by judgement of the Admiralty Court you are to observe the adjudication of said Court and to proceed to the discharge of said ships and goods. You are to take order that His Majesty's order in Council about Nuremburg wares be obseryed. I approve your proposed change in the manner of paying the watchmen, viz. : 2s. a night when on duty, and 6l. 15s. 0d. per an. instead of a salary of 25l. per an. "I cannot remit the duty upon wines upon any occasion, and therefore in this particular cannot comply with the Lord Widdrington's request for bills of store." As for privateers taken as prize the buyers both of ship and goods ought to pay the Custom. Ibid.

Same of same, dated 1673, April, of a grant to Lord George Fitzroy and his heirs male of the reversion of all the receipts, revenues, yearly profits, &c., &c., arising by the sealing of writs, exemplifications, or other things with the seals of the Court of the King's Bench and Common Pleas, together with the office of Receivers General of said revenues and Comptroller and overseer of all writs or other things to be sealed with said seals or either of them, and of the ensealing thereof and of the money payable for same : in reversion after the grant of same to James, Earl of Suffolk as by indenture dated 1660, Aug. 7. In case of death of said Lord George Fitzroy without heirs same is to be granted to Charles Earl of Southampton and his heirs male, and failing such then to the Earl of Euston and his heirs male. Treasurer Clifford's warrant to [the Trustees of the late Queen Mother] to discharge Thomas Walsingham of one year's rent in arrear which he owes upon a lease of several parcels of land in Marshland, co. Norfolk, granted in trust to his use by the late Queen [Mother] of which you now stand entrusted for His Majesty : in view of his expense in the repair of breaches made upon his land by an inundation of the saltwater in Sept., 1671, which if he had neglected to do he allegeth the Crown might have lost the inheritance, besides the land is very much impaired to his great damage : the King having granted petitioner a similar allowance of one year's arrear of rent for the same reason. Report to the King from Treasurer Clifford on the petition of Sir Robert Wiseman, King's Advocate General and Dean of the Arches Court of Canterbury, as by the order of reference of Dec. 19 last : said petition praying that he may be appointed a Commissioner of Excise, but without salary, till the death of any present Commissioner. The number formerly employed was five, but has been lately increased to six by the addition of Sir John Davies : and by a clause in the renewal lease of the London Excise your Majesty has covenanted that any fresh Commissioner of Excise shall be to the liking of the London Farmers. [which] is to be assigned to said Spragg on said orders or either of them, the said 300l. being so much due to him by the privy seal of Jan. 11 last for his expenses in his journey into France. Treasurer Clifford to [? the Customs Commissioners]. I approve of your proposals as to putting in execution the Act for the better securing the Plantation trade and appointing Head Collectors in each of the Plantations for collecting the duties granted by said Act. To your proposed instructions for such collectors there is to be added a direction to them to send over their accounts once every six months, commencing them from a quarter day. That there may be a check over the action of the Collectors I think fit that a Surveyor should also be appointed at each Plantation to be allowed a sixth part of the salary proposed for the Head Collectors, the remaining five-sixths to go to the said Head Collectors for their own pains and the charge of under officers.
