Privilege - Arrest of a Member.
Sir Jo. Finch reporteth from the Committee for Privilege, the Case of Mr. Gifford - That it appeared, that 6o Jan. One of the Burgesses first elected, viz. Sir Tho. Jermyn ; and 11o Jan. Mr. Gifford elected; but that the Town Clerk had dated the Indenture 30o Jan. as conceiving it was to bear Date the Day of the next County : So as he was arrested after his Election, but before the Return : his Arrest being 23o Jan.
Sir Jo. Finch also reporteth, that the Committee of Opinion, that Sir Tho. Badger his Man shall be delivered by Habeas Corpus, by Warrant from this House.
Upon Question, Sir Tho. Badger his Man to have Privilege ; and a Warrant under Mr. Speaker's Hand, to the Clerk of the Crown, for an Habeas Corpus, to bring him hither.
The Dispute, and Resolution, concerning Mr. Gifford's Case, to be deferred till To-morrow,
Ordered, That all the Lawyers of the House shall attend the Committee of Grievances this Afternoon; and the Committee to have Power to send for any of them, which shall be then absent.
The House declareth, that, notwithstanding the said Opinion of the Committee, the House hath Power, when they see Cause, to send the Serjeant immediately, to deliver a Prisoner.
