Litchfield Road, Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for amending, altering, continuing, and making more effectual, Two Acts of Parliament, made in the Second and Seventeenth Years of His present Majesty's Reign, for repairing the Roads from Coleshill in the County of Warwick, through the City of Litchfield, to Stone in the County of Stafford, and from thence to the City of Chester, and several other Roads in the said Acts mentioned; and for enlarging the Terms and Powers in the said several Acts."

Manchester Roads, Bill:

Erskine & al. Leave to appeal, though out of Time.

A Petition of Francis Erskine of Kirkbuddo and others, Personal Creditors of Alexander Turnbull of Woodstown, deceased, was presented, and read; setting forth, "That the Petitioners transmitted to London an Appeal against an Interlocutor of the Lords of Session in Scotland, of the 18th of February last; but the same did not come to the Hands of the Petitioners Agent within the Time limited by the Standing Order of this House for receiving Appeals, because, some of the Appellants living at a Distance from Edinburgh, their Concurrence could not be obtained, nor the Appeal prepared and transmitted more early;" and therefore praying, "That their Lordships would be pleased to receive the said Appeal, although the same hath not been presented within the Time limited by the said Standing Order."

And thereupon the Agent was called in, and heard at the Bar.

And being withdrawn:

Ordered, That the said Appeal be received, as desired.

Erskine & al. against Scot.

Upon reading the Petition and Appeal of Francis Erskine of Kirkbuddo, George Turnbull Writer to the Signet, and Jean Turnbull his Spouse, and other Personal Creditors of the deceased Alexander Turnbull of Woodstown Merchant in Montrose; complaining of Two Interlocutors of the Lords of Session in Scotland, of the 22d of November 1754, and 18th of February 1755, made on the Behalf of Colonel John Scott of Commis town; and praying, "That the same may be reversed, varied, or altered; and that this House will give the Appellants such other Relief in the Premises as to their Lordships in their great Wisdom and Justice shall seem meet:"

It is Ordered, That the said Colonel John Scott may have a Copy of the said Appeal; and do put in his Answer thereunto, in Writing, on or before Friday the 3d Day of May next; and Service of this Order upon his Procurators or Agents in the Court below shall be deemed good Service.

Fremeaux's Nat. Bill.

A Message was brought from the House of Commons, by Mr. Hardinge and others:

With a Bill, intituled, "An Act for naturalizing Peter John Fremeaux, Adriana Constantia Fremeaux, Elizabeth Fremeaux, Maria Catherina Fremeaux, and Gertruda Johanna Fremeaux, who are all Infants under the Age of Eighteen Years;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

M'Leod & al. against Sir W. Dunbar & al.

A Petition of John M'Leod Esquire and others, Appellants in a Cause depending in this House, wherein Sir William Dunbar and others are Respondents, which stands appointed for hearing on Friday the 11th Instant, was presented, and read; setting forth, "That, the Extract of the Decree, which must be voluminous, not being yet sent from Scotland, it is impossible for the Petitioners to be prepared for the said Hearing by so short a Day;" and therefore praying, "That the same may be put off for a Fortnight."

And thereupon the Agents on both Sides were called in, and heard at the Bar.

And being withdrawn:

Ordered, That the Hearing of the said Cause be put off for a Fortnight, as desired.

Bramston's Bill.

The House proceeded to take into Consideration the Amendments made by the Commons to the Bill, intituled, "An Act for vesting the settled Estates of Edmund Bramston Esquire and Henrietta Maria his Wife in Trustees, for raising several Sums of Money, for discharging Portions charged upon the same; and for other Purposes therein mentioned."

And the said Amendments, being read Three Times by the Clerk, were agreed to.

And a Message was sent to the House of Commons, by Mr. Edwards and Mr. Lane, to acquaint them therewith.

Witnesses to attend on Dean's Yard Bill.

Ordered, That the Reverend John Downes, John Feary, Henry Panton, and John Waterman, do attend this House, on Wednesday next, as Witnesses, upon the 2d Reading of the Bill, intituled, "An Act to enable the Reverend William Markham Doctor of Laws, and Thomas Salter Esquire, to build Houses, and open a Square, in and upon a certain Piece of Ground called Dean's Yard, Westminster, and several Pieces of Ground contiguous thereto."

Insolvent Debtors, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for Relief of Insolvent Debtors."

Ordered, That the said Bill be committed to a Committee of the whole House.

The Earl of Holdernesse acquainted the House, "That His Majesty, having been apprized of the Contents of the Bill, intituled, "An Act for naturalizing Peter John Fremeaux, Adriana Constantia Fremeaux, Elizabeth Fremeaux, Maria Catherina Fremeaux, and Gertruda Johanna Fremeaux, who are all Infants under the Age of Eighteen Years," was pleased to consent (as far as the Interest of the Crown is concerned) that their Lordships may proceed therein as they shall think fit."

Then the said Bill was read a 2d Time.

British White Herring Fishery, Bill.

With a Bill, intituled, "An Act for further explaining, amending, and rendering more effectual, an Act made in the Twenty-third Year of the Reign of His present Majesty, intituled, "An Act for the Encouragement of the British White Herring Fishery; and for giving further Encouragement for the carrying on the said Fishery; and for other Purposes therein mentioned;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Game Act to explain, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee on the Bill, intituled, "An Act to explain and amend a Clause in an Act made in the Fifth Year of the Reign of Queen Anne, intituled, An Act for the better Preservation of the Game, in relation to the selling or offering to Sale any Game."

With a Bill, intituled, "An Act to enable the Parishioners of the Parish of The Holy Trinity in Guldeford, in the County of Surry, to sell divers Houses, Lands, Rents, and Annuities, in the said Parish, and in Stoke next Guldeford aforesaid; and to apply the Money arising by Sale thereof towards re-building their Parish Church; and for other Purposes therein mentioned;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Game Act to explain, Bill.

Dean's Yard Bill;

Upon reading the Petition of the Inhabitants of the United Parishes of Saint Margaret and Saint John the Evangelist, in the City of Westminster, whose Names are thereunto subscribed, alleging "That the Bill depending in this House, for building Houses, and opening a Square, near Dean's Yard in the said City of West minster, will, in many Particulars, be very prejudicial to the Petitioners;" and praying, "That the same may not pass into a Law:"

It is Ordered, That the said Petition do lie on the Table.

Persons who have omitted to qualify for Offices, Indemnity Bill.

A Message was brought from the House of Commons, by Mr. Stanley and others:

With a Bill, intituled, "An Act to indemnify Persons who have omitted to qualify themselves for Offices and Promotions within the Time limited by Law; and for allowing further Time for that Purpose;" to which they desire the Concurrence of this House.

Dean's Yard Bill:

The Order of the Day being read, for the Second Reading of the Bill, intituled, "An Act to enable the Reverend William Markham Doctor of Laws, and Thomas Salter Esquire, to build Houses, and open a Square, in and upon a certain Piece of Ground, called Dean's Yard, Westminster, and several Pieces of Ground contiguous thereto;" and for hearing Counsel for and against the same:

Counsel were accordingly called in.

And the said Bill was read a 2d Time.

And Mr. Prat was heard, against the Bill, in Behalf of the Petition of the Owners and Occupiers of Houses liable to be pulled down by virtue of the said Bill; and called

William Waite, a Carpenter; who was sworn, and examined as to the Extent of the Ground within the Limits of the Bill, the Number and Condition of the Houses thereon; and also as to their not being empty Houses in the Neighbourhood to receive the Persons whose Houses may be pulled down; as also to the Number of Boarding Houses for the Westminster Scholars, and the Nearness of such Houses to the School.

Cross examined, by the Counsel for the Bill, as to his going about to get Names to the Petition against the Bill.

Then John Waterman, Collector of the Poors Tax in the Parish of Saint John the Evangelist, Westminster, was called in, and sworn; and examined, as to the Number of Houses in the said Parish of Saint John that are within the Limits of the Bill, and liable to be pulled down; and what they pay to the Poor's Rate.

Cross examined, by the Counsel for the Bill, as to several of the Houses being inhabited by poor and mean People, not able to pay the said Rates.

Henry Panton, Collector of the Poors Tax in the Parish of Saint Margaret's Westminster, was sworn, and examined as to the Number and Condition of the Houses in the said Parish that are within the Limits of the Bill, and what they pay to the Poors Rate.

Then Mr. Cox was heard, in Support of the Bill; and called

Thomas Smith Esquire; who was sworn, and examined as to the Number and Condition of the Houses that are within the Limits of the Bill, and how and by what Sort of Persons inhabited; and as to there being Room enough in the Neighbourhood to receive Persons who may be obliged to quit their Houses by the Scheme of the Bill; and as to the Scheme's being generally approved by Persons of Consequence in the Parishes; and as to the Limits of the Plan extended from what it was originally, at the Desire of the Parishes, and for their Convenience.

Then John Bernard was called, and sworn; and examined to the same Points as the former Witness; as also to the State and Condition of the Workhouse; and as to a Proposal for laying out Four Hundred Pounds in enlarging the Workhouse, which, if it had taken Place, must have been done by a Pound Rate.

Next, William Bernard was called, and sworn; and examined as to the Persons whose Names are set to the Petition against the Bill; and what Number of Houses must be pulled down, to form the Square and Street intended by the Bill, and the annual Rents of such Houses; as also what Number of the Petitioners are Owners of Houses, and what Number are only Tenants at Will; and as to some Persons having signed the Petition, whose Houses are not within the Limits of the Bill.

Then John Feary, Vestry Clerk, was called, and sworn; and examined as to a Copy of the Bill, as originally framed, being sent to the United Vestries of the Parishes of Saint Margaret's and Saint John's; and as to a Committee of Gentlemen being appointed by the Vestries to watch the Progress of the Bill in the House of Commons; and as to the several Alterations made in it, and Clauses added at the Desire of the said Gentlemen, as advised and settled by their Counsel; and also as to the Scheme's being generally approved by the said Parishes.

And then he withdrew.

And Mr. Prat having been heard for the Petitioners, in Reply:

The Counsel were directed to withdraw.

And it being proposed, "To commit the Bill:"

The King's Consent signified.

The Earl of Holdernesse acquainted the House, "That His Majesty, having been apprized of the Contents of the said Bill, was pleased to consent (as far as the Interest of the Crown is concerned) that their Lordships may proceed therein as they shall think fit."

Insolvent Debtors Bill.

The Duke of Portland (according to Order) reported the Amendments made by the Committee of the whole House to the Bill, intituled, "An Act for Relief of Insolvent Debtors."

And the said Amendments, being read Twice by the Clerk, were agreed to by the House; and are as follow:

"Press 34. Line 15. After ["stated"], insert the Proviso marked (A)."

"(A) Provided always, and be it Enacted, by the Authority aforesaid, That nothing in this Act contained shall extend, or be construed to extend, to Benjamin Thomas and Richard Beddoes, Two of the People called Quakers, now Prisoners in the Common Gaol of the County of Salop, at the Suit of Joyce Smith, Executrix of the last Will and Testament of Thomas Smith Clerk, deceased, for Tithes, or either of them, so as to oblige the said Benjamin Thomas and Richard Beddoes to deliver in and subscribe a Schedule of their respective Estates and Effects; but it shall and may be lawful for the Justices of the Peace of the said County, upon Application made by the said Joyce Smith, or by any Person or Persons for or on Behalf of the said Benjamin Thomas or Richard Beddoes, to cause the said Prisoners respectively to be brought before them at their next general Quarter Sessions of the Peace, together with a Copy or Copies of their Detainer; and to examine into the Value of the Estate and Effects of the said Prisoners, by the Oath of One or more Witness or Witnesses; and to issue a Warrant under their Hands and Seals, or the Hands and Seals of any Two or more of them, thereby directing and requiring the respective Sums due from them the said Prisoners respectively to the said Joyce Smith, and for which they are respectively charged and detained in the said Prison, to be levied upon their respective Goods and Chattels; and if the Goods and Chattels of the said Prisoners respectively shall not be found sufficient, then the Real Estates of the said Prisoners respectively (if any such there be) shall, by the said Justices, be assigned over to the said Joyce Smith, till such Time as the said Debts shall be respectively paid; and the said Prisoners shall, upon their Appearance respectively before the said Justices, and the said Debts due to the said Joyce Smith being respectively paid, be respectively discharged from their Imprisonment, as to the said Debt or Debts."

At the End of the Bill, add the Proviso marked (B).
