Gift of an annual pension for life of 10l. payable every quarter day between 8 and 11 a.m. at the font in St. Paul's cathedral, London; pain of 33s. 4d. for arrears, with right of distraint on donor's manors of Eltham, Hakynton, Whytstable, Herne and Reculver co. Indenture between John Pole gentleman and John Rooper gentleman: whereas Pole married Rooper's mother Margery and Rooper pays them 20l. each yearly by two deeds, one of 13l. 6s. 8d. for term of 20 years and one of 26l. 13s. 4d. for term of her life, it is agreed between the two parties by mediation of John Fynex knight, chief justice of England, that before Easter next Rooper shall grant an annuity of 10l. to Pole and also discharge him of the finding of Margery and of such debts as he should be charged with by occasion of her, with right of distraint on the abovenamed manors, which are not to be so charged as to make them of less than 10l. a year clear value; the annuity to be paid 'in groteys, half groteis or gold other then V s' of laufull money curraunt in England yf it be so axed or requyered'; Pole to discharge Rooper of the annuity of 13l. 6s. 8d. and deliver to the prior of Seynt Bertilmews in Smethefeld, London, the deed of grant of annuity of 26l. 13s. 4d. and an obligation for performance thereof, to be kept there to the use of Margery during her life and delivered to her if Rooper die before her or to Rooper if she die before him; Pole to suffer her during his life peaceably to have 24l. yearly of the 26l. 13s. 4d., to be paid by the discretion of the chief justice; 'if a laufull devorse be hadd at any tyme herafter bytwene the seid John Pole and Margerie . . . whereunto the seid John Pole be personably callyd wherby the same John Pole may be by the lawe spirituell clerely discharged in conscience of the seid Margerie and to be att lyberte to mary with any other woman,' then the annuity of 10l. to be void and Margery to have the annuity of 26l. 13s. 4d. to her own use; bond for performance in 200 m. by Pole. Indenture of sale of Bebeton manor with the advowson of the church and all his lands etc. in Sussex; before the Ascension next he is to enfeoff John Barnes of Wrytyll co. Essex, esquire, and John Bedell of the same, Thomas Coke of Rustyngton co. Sussex and John Palmer of Angemaryng, gentlemen, with the premises to the use of Edward from Easter next for the 3 years then ensuing, subject to a yearly rent of 7l. 13s. 4d. payable to Humphrey, the 'reparacyons of the housyng' to be at the charges of Edward; if Humphrey or his heirs do not pay Edward 100l. in gold or groats within 3 years of the date of this indenture, and if Edward or his heirs pay Humphrey 100l. within a quarter of the year next ensuing the end of that term or Humphrey or his heirs refuse such payment lawfully 'tendyd,' then the feoffees shall be seised to the only use of Edward and his heirs for ever; Edward to take the whole profit of the premises till Humphrey pay him the 100l.; after payment of this 100l. the feoffees are to be seised of the premises to the use of Edward for life and a year over and thereafter to the use of Humphrey and his heirs for ever, except lands to the yearly value of 20s. only whereof they are to be seised to the use of Edward and his heirs for ever; Edward to keep the courts of the manor twice a year; delivery to a person to be appointed, dwelling in London, of evidences, 'scrowes,' etc.; premises to be discharged; Edward to pay 126l., viz. 70l. Nov. 8. Memorandum that Thomas Waren, a Chancery clerk, came before the king in Chancery and duly requested of Henry archbishop of Canterbury, keeper of the Great Seal, the assignment of a term within which he offered to prove that Richard Asshilworth, who was then prosecuting him by means of exception before the said archbishop in the Star Chamber at Westminster in a cause of riot, was an apostate from religion (religiosum apostatam) involved in a greater sentence of excommunication and, what is worse, a breaker of his rule (irregularem), and humbly desired that this his lawful petition be testified by judges, clerks and ministers of Chancery and enrolled or filed. A term of one year was assigned accordingly.
