Hatfield Level.
Ordered, That the Business concerning Hatfeild Levell, which should have been heard this Day at the Bar, shall be put off till Thursday come Fortnight.
E. of Derby and his Purchasers.
Ordered, That the Earl of Derbye's Business, between him and his Purchasers, shall be taken into Consideration on Saturday next, peremptorily.
Bill of Indemnity:
The House was adjourned into a Committee during Pleasure, to proceed further into the Consideration of the Bill of Indemnity.
The House resumed;
Lyster to be exempted;
The Lord Robertes reported to the House, "That the Committee taking into Consideration the Petition of Thomas Lyster Esquire, and hearing his Repentance at this Bar, for having once sat upon the Trial of His late Majesty, and his declaring upon his Knees at this Bar his Sorrow for offending His Majesty and this House therein, and his Promise to be faithful to His Majesty's Kingly Government for the future; the Opinion of the Committee is, That the said Thomas Lyster be exempted out of the Bill of Indemnity."
Which this (fn. 2) House approved of, and of his Submission now made; and ordered the same accordingly.
After this, the House was adjourned into a Committee during Pleasure, to proceed in the Bill of Indemnity.
The House was resumed again.
and Sir G. Pyckering.
And the Lord Robertes reported, "That the Committee was of Opinion, That Sir Gilb't Pyckeringe Baronet shall be exempted out of the Bill of Indemnity, as he now stands excepted."
Which this House confirmed, and ordered the same accordingly; and that he make the like Acknowledgement as Mr. Lyster hath done.
The Question being put, "Whether Sir Gilb't Pykeringe shall be totally left out of the Exception in Bill of Indemnity?"
It is Resolved in the Affirmative.
Persons to be punished who were concerned in the Death of the late E. of Derby.
The Earl of Pembrooke reported, "That the Committee for Privileges have examined the Business concerning the Trial of the late Earl of Derby; and their Lordships do find, that he was tried by a Council of War, and executed after Quarter given: Whereupon the Committee is of Opinion, That those who sat and gave Judgement upon him may receive such Punishment as this House shall think fit, excepting Colonel Twisleton and Colonel Delves."
Private Provisos in the Bill of Indemnity.
The House was again adjourned into a Committee during Pleasure, to proceed further in the Bill of Indemnity.
The House being resumed;
The Lord Robertes reported, "That the Opinion of the Committee was, That all Provisos whose Matter is of Private Concernment shall be left out of this Bill; and that no new Bill shall hereafter be exhibited to this House, to take off the Benefit of the Bill of Indemnity from any Person, excepting such Bills as are now depending before the Lords for the same Matter; and also excepting the Marquis of Newcastle, Lord of Lexinton, Duke of Bucks, Lord Craven, Lord Langdale, Earl Berks, and Lord Gerrard of Brandon, who have Liberty to exhibit their Bills to this House for the same."
Which this House confirmed; and ordered the same accordingly.
Judges in the late High Courts of Justice.
Ordered, That the First Business To-morrow Morning shall be, to take into Consideration those Persons that sat upon the Peers in the High Courts of Justice.
Ld. Leigh, Leave to be absent.
Ordered, That the Lord Leigh hath Leave to go to The Bath, for Recovery of his Health.
