Information by Thos. Shelton, that in 1648 and later he acted under commands from the late King of Scots, and the Earl of Ormond, was a pirate at sea, is taken, is within the Ordinances of Sequestration, and is now to be tried for his life. 23

19 July 1653. Order thereon that Jasper Gill, of Bristol, detain linen, cloth, &c., value 250l., in his hands, belonging to Baltazar, the Council of State ordering the Committee for Advance of Money to make fit allowance to Shelton, from the moneys paid in on Baltazar's prosecution. 12 392
22 Feb. 1654. Baltazar being released on bail by order of the Council of State, Shelton is to show cause why the linen stayed 19 July should not be released. 13 76

County commissioners send depositions to prove that he was a major for the King of Scots in Worcester, listed soldiers, sent in provisions, &c., and that his wife, who was a Gerard, was con- veyed out of the city after it was taken. 164 11

Elizabeth, Duchess Of Hamilton, Widow of William, 2nd Duke, and her 4 Daughters.

Petition that she attended the late Parliament till their dissolu- tion, but could not obtain a hearing. That for 10,000l. portion, which she brought to William, late duke, she had lands of 1,000l. a year settled on her in 1639, for a jointure; yet by a declaration of Scotland, these lands were sequestered with her husband's other estate, though her counsel certify that the lands are not sequestrable. That part of the lands were ap- pointed by Parliament to be settled on Gen. Monk, though he declined them as being her jointure. Begs restoration to her jointure, her poverty being so increased by long attendance on the late Parliament for justice, that she and her children have to live on charity and borrowed bread. There is enough beside of the duke's estate to pay Monk's 500l. a year. With reference thereon to the Committee for Advance of Money, to state the matter of fact and the settlement of the jointure. 12 398

The duchess begs a commission to the County Commis- sioners of Hunts to examine John Delavalle on oath, touching his knowledge of an agreement made in 1639, between the Earl of Lanark, afterwards Duke of Hamilton, and Jas. Maxwell, [afterwards Earl of Dirleton,] and to certify. Granted. 164

6 Aug. 1653. They send up his deposition on interrogatories, he being counsellor-at-law to James Maxwell and his daughter, now Duchess of Hamilton, as to the validity of the marriage settlement sent therewith. 164 14

19 Aug. John Pulford, on behalf of the Duchess, requests the delivery of the settlement to him, that he may attend Brereton with it. Noted as passed. 164 16
9 Sept. 1653. The Duchess begs the examination in Scotland of Lord Abergavenny, Sir John Scott, and others, to prove the payment by her father to Duke William, her late husband, of 16,000l., and a special commission to take their examinations. 164 17
