Wharton versus Tily.

Upon reading the Petition of William Wharton Esquire and Eunice his Wife, Respondents to the Appeal of Sir Joseph Tily and Dame Deborah his Wife; shewing, "That he was served with an Order of this House Yesterday, for hearing of his Cause on Tuesday next; and he, having been lately sick, cannot in so short a Time be ready, or instruct his Counsel; and praying a further Day may be appointed for hearing of the said Cause, and that the Lord Chief Justice of His Majesty's Court of King's Bench do attend at the Hearing thereof:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Friday the Seven and Twentieth Day of this Instant February, at Eleven of the Clock in the Forenoon; and that all the Judges of His Majesty's Court of King's Bench do then attend.
