PRAYERS.

Clerk versus Moore.

The House being moved, "That a Day may be appointed, for hearing the Cause wherein Sir Robert Clerk is Appellant, and George Moore Respondent:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Monday the Tenth Day of February next, at Eleven a Clock.

E. Clanriccard, &c. versus Bourke & Ux.:

After hearing Counsel, upon the Petition and Appeal of John Earl of Clanricarde, and Michael Lord Dunkellin his Eldest Son; complaining of an Order of the Court of Chancery in Ireland, made the Twenty-second Day of February 1714, on re-hearing the Matter of a Plea, in a Cause there depending, wherein the Appellants were Plaintiffs, and Thomas Bourke Esquire and Hellen Countess Dowager of Clanricarde his Wife Defendants; which Order allows the said Plea, against performing an Award made the Seventeenth of July 1688; and praying, "That the same may be set aside:" As also upon the Answer of the said Thomas Bourke and the Countess Dowager of Clanricarde put in to the said Appeal; and due Consideration of what was offered thereupon:

Judgement reversed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Order of the said Court of Chancery be, and is hereby, reversed: And it is further Ordered, That the said Plea do stand for an Answer, with Liberty to except, according to an Order of the said Court of Chancery, of the Twenty-fifth of June 1714.

D. Devon's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for settling the Estates of the most Noble William Duke of Devonshire, and William Cavendish Esquire, commonly called Marquis of Hartington, Son and Heir Apparent of the said Duke, on the Marriage of the said Marquis of Hartington with Katherine Hoskins Spinster, only Child of John Hoskins Esquire, deceased."

Ordered, That the Consideration of the said Bill be committed to the Lords following:

L. Bathurst's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for establishing the Disposition of the Personal Estate of Sir Benjamin Bathurst deceased, and the Settlement on his Three Sons, under his Will; and exchanging Ground-rents in Wapping, in Middlesex, for another Rent of like Value; and other Purposes therein mentioned."

Ordered, That the Consideration of the said Bill be committed to the Lords Committees aforenamed.

Their Lordships, or any Five of them; to meet on the same Day, and at the same Place.

Sir G. Downing's Petition referred to Judges.

Upon reading the Petition of Sir George Downing Baronet, and Dame Mary Eldest Daughter of Sir William Forrester; praying, "That Leave may be given to bring in a Bill, for making effectual certain Articles of Agreement, bearing Date the Twenty-seventh of February 1715; whereby the Petitioner Sir George hath agreed to be debarred of any Claim he may have to the Petitioner Dame Mary's Fortune therein mentioned, and for other Purposes in the said Articles expressed:"

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to Mr. Baron Mountague and Mr. Baron Fortescue; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

D. Newcastle's Petition referred to Judges.

Upon reading the Petition of the most Noble Thomas Holles Duke of Newcastle, Lord Chamberlain of His Majesty's Household, and the Bailiffs and Freemen of the Town of Kingston upon Thames, in the County of Surrey; praying, "That Leave may be given to bring in a Bill, for vesting the Manor of Esher Waterville, alias Waterfield Esher, and Premises in the Petition mentioned, belonging to the said Bailiffs and Freemen, in the said Duke and his Heirs; and for vesting Rent-charges, in the Petition also mentioned, in the said Bailiffs and Freemen, according to an Agreement between them, therein set forth:"

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to Mr. Justice Dormer and Mr. Justice Prat; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Shipperdson's Bill.

The Lord Archbishop of York reported from the Lords Committees, to whom the Bill, intituled, "An Act to enable Ralph Shipperdson Esquire to make Sale of his Estate in Studley Roger, in the County of York, freed from the Uses and Trusts in the said Ralph Shipperdson's Marriage Settlement, and to settle his Estate at East Mourton, in the County of Durham, to the same Uses," was committed: "That they had considered the said Bill, and found the Allegations thereof to be true; that the Parties concerned had given their Consents; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Adjourn.
