A. 7778. Indenture executed by John Paston, John Wymondham
and Nicholas Applyerd, esquires, brother Henry Wichyngham, professor of
theology; and confessor 'in extremis' of Eobert Clere, esquire, deceased,
Roger Hayles, rector of the church of Takelston, and Roger Ormesby, being
a notification that the said Eobert Clere declared his last will to them of
his manors, lands and tenements as follows, which will he desired should
be written and sealed by the advice of John Heydon and that they should
notify the said John Heydon and his feoffees of it, though from approaching
death or the absence of the said John Heydon it could not be written or
sealed, viz. he willed and declared to them that Elizabeth his wife should
have all his manors, lands and tenements without any exception for term of
her life; for his children he would make no provision nor would have his
wife charged with their maintenance, having full confidence that if they
bore themselves well and humbly to her she would maintain them
(dictos pueros) becomingly (honeste), or if they did otherwise he wished her
to give them naught; and after her decease he willed William his son and
heir should have the manor of Ormesby, the manor and advowson of
Wynterton and the manor of Frethorp, to him and the heirs of his body;
that Thomas his son should have the manor of Stratton Streles to him and
the heirs of his body, with remainder in default to the right heirs of the
body of him, the said Robert, begotten; and that Eobert his son should
have the manor of Kesewyk with the like remainder; provided that if
either Thomas or Robert became priest (presbiterari vellet) he should be
presented to the church of Wynterton on a vacancy and further should
have the manor of Wynterton for life but should lose the other manor
before limited to him, which William should have in recompense of the
manor of Wynterton; he further willed that his heir before obtaining any
estate of the manor of Ormesby should be bound over not to hinder the
performance of his will and not to disturb his brethren; in the event of the
decease without issue of his said sons before they had received estate in the
manor of Ormesby, he willed Edmund his brother should have it to him,
his heirs and assigns, and that the other manors &c. should remain to
Margaret his daughter, for whose marriage he declined to provide, but left
it solely to her mother's discretion. In witness whereof both they and the
said John Heydon have put their seals to the present indentures prepared
by the said John's advice and according to their declaration. Dated
