Declaration etc., as below. The petition of John Bothe, clerk, of the diocese of Coventry and Lichfield, son of Roger Bothe. esquire, contained that although the poor hospital of St. Andrew, Denwall’ in Wyrall', to which the parish church of Bourton in the said diocese is annexed. was on its voidance in a certain way [not stated] collated to him, by his ordinary authority, by William, then bishop of Coventry and Lichfield, now translated to the church of York. whose nephew he is, and that although he was by the said authority deputed its perpetual warden or governor, and obtained and at present holds the said hospital and church, as a compatible benefice, nevertheless, inasmuch as the said hospital is, especially on account of the said church, called by some an incompatible benefice, he (who, when the said hospital was collated to him, was in minor orders only and in or about his fourteenth year) doubts whether he can hold the said hospital without a scruple of conscience, or whether he may be molested in respect thereof or of its administration or of the said church. At the petition, therefore, of the said John, who alleges that the said hospital has been for fifty years by divers persons held as a compatible benefice and reputed as such, and that it is alleged by many to be compatible and by many to be incompatible, the pope hereby declares that the said hospital and church (whose values etc. he wills to be sufficiently expressed by these presents) are a compatible benefice, that the said bishop had full power to collate the said hospital and church to the said John, even being in the said age. just as in the case of other benefices compatible and without cure in his gift, and that the said John could, being in the said age, and can, without any dispensation, receive and retain the said hospital and church. To James, earl of Douglas, and Margaret also de Douglas, noblewoman, of the diocese of Glasgow. Dispensation to marry, as below. Their recent petition contained that although the late William, earl of Douglas, James's brothergerman, contracted marriage per verba de presenti with the above Margaret (who was related to him in the second and third degrees of kindred, was below the marriageable age and her twelfth year, and was not ignorant of the said relationship), and although the said William (who cohabited with Margaret for some time) perhaps attempted to consummate the marriage, which was impossible, because he had not obtained a papal dispensation, although he had duly taken steps to do so, nevertheless they, who are related in the like degrees, desire, in order to put an end to wars etc. between their respective families and friends. to be united in marriage, but, inasmuch as James (fn. 7) has committed fornication with a certain other woman related to Margaret in the second and third degrees of kindred, cannot do so without obtaining a papal dispensation on account of the impediments arising from quasi-affinity, kindred [and] affinity. (fn. 8) The pope therefore, at their said petition and that of James, king of Scots, whose kindred they are, absolves Margaret from the sentence of excommunication which she has incurred on account of the aforesaid, and dispenses them to marry, notwithstanding the said impediments and impediments of any other like or more distant degrees of kindred and affinity. To Charles Flem(i)ng. prior of the Augustinian monastery of Wyrkesopp’ in the diocese of York, bachelor of canon law. Indult, as below. His recent petition contained that the said monastery is midway (fn. 9) from London to York, so that there are few wayfarers who do not receive hospitality, but that, the territory where its possessions are situate being almost barren, so that no grain ripens except fine wheat and oats, (fn. 10) the prior is obliged for the maintenance of the canons and the reception of guests to buy wheat. (fn. 11) the cost of which is heavy and at the present time intolerable, especially on account of the devastation of the churches from which he used to pay 40l. sterling a year, but from which he now receives little or nothing. (fn. 12) so that, unless a remedy be forthcoming, the number of canons will be diminished and it will no longer be possible for wayfarers to be received and lodged. Confirmation etc., as below. Eugenius IV, at the petition of Henry, king of England, exempted the Cluniac priory of St. John [the Apostle and Evangelist], Pontefract. in the diocese of York, from its primeval subjection to the Cluniac monastery of la Charité[-sur-Loire] (Caritaten.) in the diocese of Auxerre, and decreed that, upon voidance of the priorship, instead of appointment by the prior of la Charité the convent of St. John's might elect or postulate a prior, and that such election or postulation should be confirmed by the apostolic see, that the prior should admit the professions of those wishing to join the order, and confer the regular habit etc. [Cal. Lett., IX, p. 205]. At the recent petition of the present prior [not named], stating that some doubt the validity of the said letters and their contents, the pope, who has caused them to be inspected in the Register of his said predecessor, hereby confirms them, and further, for greater safeguard (fn. 17), exempts anew (fn. 18) as above the said priory etc. and takes it under the protection of St. Peter and the said see, and grants the right of election etc. as above of the prior, who shall be ipso facto deemed to be the true prior etc. as if the election were confirmed by the said see, adding that whenever in future the prior wishes to resign, the collector of the camera or the abbot or prior of Sylbi, (fn. 19) of the said order and diocese, may receive and admit such resignation, and collate and assign and make provision of the priory to the fit person who shall seem good to him, etc. The prior has hereby faculty to admit monks, confer the regular habit and receive professions, and the prior and convent shall, as they have offered, pay 1 mark, viz. 13s. 4d., every year to the papal camera or its collector as a token of their said freedom. Confirmation of the motu proprio statutes, which the pope recapitulates, whereby Boniface IX abolished the useless and expensive feasts, which, costing as much as 150 and 200 marks sterling, were formerly wont to be given by canons of Wells as a condition of beginning residence, and substituted the payment, of 100 marks in the case of a canon with a prebend, and 150 marks in the case of a canon with a prebend and a dignity, to the dean and chapter in aid of the fabric and the other burdens of the chapter and church [Cal. Lett., V, p. 400]; which statutes the dean and chapter have interpreted by distributing 10 marks to the fabric and 10 marks to the vicars [choral] of the said church, and the rest to the canons residentiary who bear the burden and heat of the day, relying on the words of the said statutes ‘the other burdens of the chapter and church,’ which burdens of the chapter and residentiaries are very heavy and almost intolerable on account of hospitality, which is very burdensome in those parts, and the cost of litigation, repairs of houses, manors etc., non-resident canons being free from such burdens, although they often have better prebends. Inasmuch as some allege that the said sums paid by canons beginning residence ought to be devoted to the fabric alone, and that nothing thereof ought to be distributed to the chapter and its burdens or to the residentiaries, the pope hereby confirms the said statutes of pope Boniface, and ordains that the said mode of distribution by the dean and chapter shall continue, namely 10 marks to the fabric, 10 to the vicars and the rest to the residentiaries for their burdens.
