Mandate (the pope having been informed by Thomas Ocellachan, clerk, of Armagh, that Donald Ocassalayg, perpetual vicar of D—(de Darennis) in the diocese of Armagh, has dilapidated the goods thereof, converting them to improper and unlawful uses (fn. 4), and, being by authority of the ordinary under sentence of the greater excommunication and publicly proclaimed excommunicate, has celebrated masses and other divine offices, in contempt of the Keys, incurring irregularity) if and after Thomas (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) accuses Donald before them etc., to summon Donald, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 3 marks sterling, to Thomas. To the archbishop and the dean of Tuam, and Thomas Obrayn, canon of the same. Mandate, as below. The pope has been informed by Matthew [son] of Laurence (Laurentii) Maccommara, clerk, of the diocese of Killaloe (Laonien.), that formerly, a dispute arising between Matthew Jacobi and Matthew [son] of Thady (Tathei) Donati, [both] called Maccommara, clerks, of the said diocese, about the rectory of the parish church of Bunrate alias Tradry in the said diocese, the said Matthew Jacobi bargained with the said Matthew [son] of Thady Donati that the latter, in order that he might leave the former in peace (fn. 5), should have part of the fruits etc. of the rectory yearly, simoniacally dividing the fruits etc. of the rectory by means of certain laymen and without the authority of any ecclesiastical superior. The pope therefore orders the above three, if and after the said Matthew Laurentii (who is by both parents of a noble race of dukes, and who from fear of the power of Matthew Jacobi cannot safely meet him in the city or diocese of Killaloe) accuses Matthew Jacobi before them etc., to summon the latter, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said rectory, of the patronage of laymen and value not exceeding 30 marks sterling, to the said Matthew Laurentii; whether it become void by such deprivation, or be void by the non-promotion of the said Matthew Jacobi to the priesthood, or by the death of Donald Maccommari (sic), clerk, or be void in any other way, and notwithstanding that the pope recently granted provision to him of a canonry of Killaloe and the prebend of Tomgrene therein and the perpetual vicarage of Cwne (rectius Quin) in the said diocese, value altogether not exceeding 26 marks sterling, which grant of the vicarage shall be null and void upon his obtaining the said rectory. Mandate (the pope having been informed by Patrick Ostyngun (fn. 6), perpetual vicar of Ardcarne (de Ardcarna) in the diocese of Elphin, that John Magillaruayd, perpetual vicar of Gyllmacgnagyn in the said diocese, has dilapidated the goods thereof, committed perjury and, besides otherwise leading a very dissolute life, has, being excommunicate and publicly proclaimed excommunicate, celebrated masses and other divine offices, even in the presence of excommunicate and interdicted persons, knowingly and in contempt of the Keys, incurring irregulairty) if and after Patrick (who was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted) accuses John before the above canon (seeing that, on account of the inordinate favours which John has in the city and diocese of Elphin, Patrick has no hope of obtaining justice therein), to summon John, and if he find the above to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 8 marks sterling, to Patrick; notwithstanding that he holds the said vicarage of Ardcarne, value not exceeding 6 marks sterling, which, as he has offered, he is to resign upon obtaining that of Gyllmacgnagyn. To Philip Machenagh, Cormac Ocuynn and Thomas Macabrethim, canons of Achonry (Akaden.). Mandate to collate and assign to Bernard Oheagra (fn. 7), clerk, of the diocese of Achonry (who has studied canon law for several years in a place which is not an university (fn. 8), and lately, notwithstanding his illegitimacy as the son of a bishop (fn. 9) and an unmarried woman, nobles, related in the third and fourth degrees of kindred and in the double third and the third and fourth degrees of affinity, had himself made a clerk, was afterwards dispensed by papal authority to be promoted to all, even holy orders and hold a benefice even with cure, and was subsequently, upon the present pope ordering provision to be made to him of the deanery of Achonry, a major elective dignity with cure, value not exceeding 10 marks sterling, of which he is not in possession, dispensed by the same letters to receive and hold it) the rectory of the rural lands of Dachorann and Muta in the said diocese, with cure and value not exceeding 25 marks sterling, void because Bernard Macdonnochayd (sic), having obtained it, collated to him by papal authority, held it for more than a year without having himself ordained priest; summoning and removing the same Bernard Macdonnchayd (fn. 10), [now] priest, of the diocese of Elphin, who (after the lapse of the said year, and without having acquired any new canonical title, but under pretext of certain papal letters which he neglected to have presented to the executors thereof within the statutory time, namely a year from their date) has unduly detained possession for about four years; whether it be void as above, or by the death of Donald Macdonnchayd, priest, or in any other way. The said Bernard Ocheagra (who alleges that the buildings of the said church of Achonry, which in some places is threatened with ruin, are in need of very great repairs, the greater part of which the holder of the deanery has been accustomed to make) is hereby dispensed to receive the said rectory and deanery, and to hold them together for life, notwithstanding the said illegitimacy, and notwithstanding the pope's late ordinance forbidding the holding together of a major cathedral dignity and a parish church [see above, p. 5]. To the official of Glasgow. Mandate, as below. Eugenius IV (upon being informed by Richard Broun, priest, of [the diocese of] Glasgow, that William W[i]schiare (fn. 11) (rectius Wischiart), perpetual vicar of Carnwithe in the said (fn. 12) diocese, had, without consulting his diocesan, buried within the sanctuary and in the cemetery of the said church the body of William Ade, a parishioner of his, who had hanged himself with a rope in his own barn, and that, on account of the said vicar's negligence, many of the parishioners had died without the administration of the sacrament of Eucharist, although he had been very often asked to administer it to them) granted on 5 Id. Feb. (9 Feb.) anno 16 [1447] a mandate addressed to a certain judge, if and after Richard accused William (who had been in possession of the vicarage for more than seven years) before the said judge (fn. 13), to summon William, and if the found the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 5l. sterling, to Richard; whether it should become void by such deprivation, or were void by the resignation of the said William, or in any other way. Inasmuch as pope Eugenius died before his said letters were drawn up, the pope hereby decrees that the said grant etc. shall nevertheless take effect from the said date, and that these presents shall be sufficient proof thereof, and orders the above official to execute the said mandate. Mandate to collate and assign to Cornelius Chedersegyoll (rectius Ohedersegoyll), dean of Ross, who is a priest, has studied for some time canon and civil law, and is illegitimate, being the son of a priest and an unmarried woman [both] of noble birth, the perpetual benefice called the rectory of the ecclesiastical fee of the parish church of Glanberchian in the diocese of Ross, which has habitual but not actual cure of souls (fn. 16), value not exceeding 3 marks sterling, void by the death of Donatus Chollachyan (rectius Ohollachyan), perpetual beneficiary in the said church, called rector; whether it be so void, or by the non-promotion to the priesthood of Ymarus Ydonnuayn, or in any other way, and notwithstanding that the present pope recently made him provision of the said deanery, a major dignity with cure, of which he is not in possession, value not exceeding 5 marks sterling. Cornelius (who alleges that the cure of the said church of Glanberchyan has been wont to be exercised by its perpetual vicar alone) is hereby dispensed, notwithstanding the said defect etc., to receive the said benefice and hold it for life together with the said deanery. Reservation to the pope's gift, for collation to him (who, whilst litigating in the Roman court about the perpetual vicarage of Fores in the diocese of Moray, of whose possession he has been despoiled, has followed the said court for about four years) of the perpetual vicarage of Erseldon’ in the diocese of St. Andrews, value not exceeding 8l. sterling, to become void by the promotion, made by the present pope, of Robert, elect of Dunblane to that church, and by his consecration, which is to take place; notwithstanding that he is litigating about the said vicarage of Fores, value not exceeding 4l. sterling, and that the pope has granted him provision of a canonry of Glasgow, with reservation of a prebend and dignity etc. even elective and with cure, and of a benefice with or without cure, even if a canonry and prebend, other than cathedral, in the collation etc. of the bishop and the dean and chapter of Dunkeld. (20 Aug.) anno 16 [1446], a mandate to certain judges [not here named] if and after Thomas (who had lately been dispensed by papal authority on account of his illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) accused Nicholas before them, to summon Nicholas, and if they found the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 3 marks sterling, to Thomas, notwithstanding that the said pope had ordered provision to be made to him of a benefice with or without cure, even if a canonry and prebend in a cathedral church, in the collation etc. of the archbishop and the dean and chapter of Armagh, which provision was to become null and void upon his obtaining the said vicarage.
