To David Crag, minister of the Trinitarian house of Holy Trinity in the burgh or town of Abirden’ in the diocese of Aberdeen (fn. 3). Dispensation to him (who, before he made his profession of the above order, was dispensed by papal authority, on account of illegitimacy as the son of a priest, professed of the said order and an unmarried woman, to be promoted to all, even holy orders, and hold two benefices, even if one had cure, after which he was so promoted and obtained, collated to him by authority of the ordinary, the above ministership, wont to be assigned as a title of a perpetual benefice, value not exceeding 12l. of old sterlings) to be elected etc. to any dignities etc. of his order, notwithstanding the said defect etc. Religionis zelus, vite etc. (An. and Jo. de Steccatis. | An. xxi. de Adria.) To the bishop of Coron (Coronen.). Mandate, as below. The recent petition of Robert Du[n]donall, canon of the Augustinian house of St. Thomas the Martyr by Buttevant (iuxta Buttoniam) in the diocese of Cloyne (Clonen.), contained that after Martin V and Eugenius IV had reserved to themselves and their successors absolution from all sentences etc. against simoniacs, Rory Oduyn, layman, desiring that the said Robert, then a secular priest, should obtain the perpetual vicarage, then void, of Kylbelada in the diocese of Killala (Aladen.), paid 40d. of the money of those parts to Robert Valensis, then provost of Killala and vicar or commissary general in spirituals of the bishop of Killala, in order that he should collate and assign it to Du[n]donall, who afterwards ratified and approved the payment, paid back the said pence to the said layman, and obtained the making to himself of collation and provision of the said vicarage. Afterwards Du[n]donall made a bargain with Thomas Barred, a canon of the above house and warden of the Augustinian cell or wardenship of St. Mary by Crosmolina in the said diocese, which depends on the said house or is a member thereof, that if Thomas would resign the cell in his favour, he would assign to him yearly for life the same portion of the fruits etc. which he had been wont to receive, as a result of which Thomas resigned to the prior and convent of the said house, and they (to whom Du[n]donall therefore made a present of a horse) received Du[n]donall as a canon of the said monastery and made collation and provision to him of the said cell; under pretext of which collations and provisions he detained for some time the said vicarage and cell (both of which he afterwards resigned), taking their fruits, and assigning to the said Thomas the portion bargained for, thereby incurring the above sentences etc. The pope therefore orders the above bishop to absolve him therefrom, enjoining penance, and to dispense him on account of irregularity contracted, and to rehabilitate him. To the abbot of Lindores (de Londoris) in the diocese of St. Andrews. Mandate, as below. The recent petition of Thomas de Camera, prior of the Augustinian priory of May (de Maya) in the diocese of St. Andrews (to whom the pope has by other letters ordered provision to be made, and him to be appointed abbot, of the monastery of Scone, of the said order and diocese) contained that the late William Scury, and also George Gardenar, formerly behaving as abbots (fn. 4) of Scone, and the convent thereof granted to its great hurt tithes, lands, houses, vineyards, possessions, fruits, rents, cesses, emoluments, meadows, pastures, woods, mills, rights, jurisdictions and other goods of the monastery, to a number of clerks and laymen, to some for life and to certain of them for a long (non modicum) time, on lease, to others by divers titles and to some in perpetuity to farm, or under yearly cess or freely, or otherwise distracted them by the title of alleged donation, obligation or sale, some of whom are said to have obtained papal letters of confirmation thereof. The pope therefore orders the above abbot to annul, after the said provision and appointment have been made, the said grants and donations. and to revoke to the right and ownership of the monastery those of its goods which they find to have been unlawfully alienated and distracted by such grants, donations or obligations, invoking if needful the aid of the secular arm. To Gormelina Yngnyconchar, a nun of the Augustinian monastery of St. Mary de Casta Silva, in the diocese of Tuam. Validation from the date thereof, namely, 5 Kal. Feb. (28 Jan.) anno 16 [1447] of the letters of Engenius IV, which by reason of his death were not drawn up, and of which these presents are sufficient proof, dispensing her, notwithstanding her illegitimacy as the daughter of unmarried parents of noble birth, to hold any dignity, even that of abbess or prioress, wont to be governed by nuns of the said order. To the abbot and convent of the Augustinian monastery of Derley in the diocese of Conventry and Lichfield. Confirmation as below. Their recent petition contained that formerly Gregory Newport, rector of Hambury in the diocese of Coventry and Lichfield, bachelor of canon law (finding, after lawful procedure, that the parish church of St. Michael, Darby, in the said diocese had, together with the chapel of the village (villule) of Alwaston in the same diocese, subject to it or dependent on it as the mother church, been appropriated to the said monastery, and that the said mother church and village had not so many people as to require two priests, as of old, that they were not far distant from one another, that the inhabitants of the village could in wintry and rainy weather go to the mother church without great difficulty or danger, and be present at divine offices there, and that the mother church was so poor that without the profits of the said village (fn. 5) a vicar or minister could not be conveniently maintained therein) consolidated, by authority of William, bishop of the said diocese, the said inhabitants to the said mother church, and ordained that they should be bound in futher to go to the mother church, here divine services therein, and receive the sacraments and sacramentals from its vicar or minister etc. and that the abbot and convent and vicars for the time being of the said mother church should be excused from keeping henceforward a chaplain to serve the said chapel. Dispensation to him, who is a papal minor penitentiary in the basilica of the Prince of the Apostles, Rome and is of noble birth, to receive and hold for life any benefice with cure wont to be governed by secular clerks, even if a parish church or a perpetual vicarage, and to resign it, simply or for exchange, as often as he pleases. To the bishop of Glasgow. Mandate, as below. Upon the voidance by the death of William Brown of the Benedictine priory of Wrchart in the diocese of Moray, which is conventual, bishop John, (perhaps ignorant of Eugenius IV's reservation of all conventual priories) made by his ordinary authority collation and provision of the priory (which in the absence of papal reservations belonged to the presentation of the abbot and convent of Dunfermlyn, of the said order, in the diocese of St. Andrews) to John de Benale, a monk of Dunfermlyn, under pretext of which he took possession and at present holds it, taking the fruits in good faith. The said priory being still reserved, in virtue of the present pope's continued reservation of benefices reserved by his said predecessor, and the said collation and provision being without force. and the priory being therefor still void, the pope hereby orders the above bishop to collate and assign it, clective, dependent on Dunfermlyn, and wont to be governed by monks of the latter. value not exceeding 40l. sterling, to the said John Benale. To the abbots of St. Mary's Cong (de Congha) and Holy Trinity, Ballintober (de Fonte Sancti Patricii), in the diocese of Tuam. (fn. 7) Mandate, as below. The pope exemplifies Eugenius IV's letters Exhibita nobis. dated at St. Peter's. Rome, 1443, Id. Nov. anno 13, and addressed to the above two abbots, ordering them, at the petition of the prior and convent of the Augustinian monastery of St. Mary, Clonthuasgerat Omayne, in the diocese of Clonfert (containing that although they are not bound to give any money to ordinaries on account of visatitions or of procurations, but only victuals, nevertheless some of the ordinaries, such as the bishop and archdeacon of Clonfert, have hitherto extorted sums of money on account of the said visatitions and procurations, and still try to do so, and under pretext thercof have promulgated divers sentences of excommunication etc. against the prior and convent and their chaplains) to cause such extorted sums to be restored, and not allow them henceforward to be compelled by the said bishop and archdeacon or any others to pay such money, and to absolve the prior and convent from such sentences, after they have made satisfaction to the ordinaries. The pope hereby orders the above two abbots to proceed to the execution of the said letters, as if they had been presented to them during the life of the said pope, and as if they had begun to proceed to execution. Confirmation, at the instance of the abbot and convent of the Benedictine monastery of St. Albans in the diocese of Lincoln, of pope Boniface VIII[I]'s letters Ad fut. rei mem. Sincere devotionis affectus, dated at St. Peter's. Rome, 4 Non. Oct. (4 Oct.) anno 6 [1395], which the pope has caused to be diligently inspected in the apostolic chancery, and which themselves, at the petition of Richard, king of England and the said abbot and convent, confirm and exemplify pope Honorius III's bull of privileges Religiosam vitameligentibus, addressed to William, abbot of St. Albans and his brethren present and future, dated at the Lateran by the hand of Ranerius, vice-chancellor of the holy Roman church, 10 Kal.
