Eugenius IV dispensed him to hold for life with the mastership of the poor hospital of St. Thomas the Martyr in Suthwerh (sic) in the diocese of Winchester, any benefice wont to be governed by secular clerks, even if a parish church or its perpetual vicarage, provided that its fruits etc. were converted to the subvention of the poor of the said hospital [see Cal. Lett. VIII, p. 519]. At his recent petition (containing that he obtained the said parish church by collation of the ordinary, and has held it for some time with the said hospital, converting the fruits to such subvention; and adding that he has resigned the said mastership and retained the said church, and doubts whether, if he must convert the said fruits as above, he can be conveniently maintained) the pope grants to him, who is a quinquagenarian or thereabouts, and has in many ways repaired the house and buildings of the said hospital and ameliorated its condition, that he is in no way bound to convert as above; with indult to retain the said church or, if he resign it, to hold any other secular benefice with cure, even if a parish church etc. and resign it, as often as he pleases. To John, cardinal priest of St. Balbina's. Mandate, as below. The recent petition of Thomas, bishop of Bath and Wells contained that a dispute arose between him and Nicholas, abbot of the convent of St. Mary, Glastonbury, about the right of correcting and punishing excesses and crimes of both clerks and laymen within the bounds of the archdeaconry of Glastonbury, of proving wills and the goods of those who died intestate therein, and the claim of the said abbot and convent that all clerks and laymen dwelling within the said bounds were exempt from the jurisdiction of the bishop; that, upon the cause being introduced by appeal of the abbot and convent to the Roman court, pope Eugenius committed the cause of the appeal and of the principal matter, at the instance of the abbot etc., to Master Malatesta de Capitaneis, now, as then, a papal chaplain and auditor, and subsequently committed to the above cardinal (by letters in which it was added that he should deprive the said abbot) the said appeal cause and also the cause which the said bishop intended to bring against the said abbot and convent and the rectors or (seu) perpetual vicars within the said archdeaconry in the matter of the non-ringing of bells. Seeing that, as the said petition added, some allege that the said pope Eugenius called up the said causes to himself and extinguished the suit, annulled the said letters, and ordered bishop Thomas, under pain of excommunication, not to molest the said abbot and convent and monastery in regard to the foregoing, and seeing that the said bishop desires the said causes to be ended, the pope orders the above cardinal to summon the said abbot and convent, and hear and decide the causes about the right of jurisdiction, exemption and the ringing of bells, enforcing his decision by ecclesiastical censure.
