1449. Non. April. (5 April.) St. Peter's, Rome. (f. 76.)	To the abbots of Mothel (de Molalia) and Molana (Insula Sancti Maclanfa) and Inishlounaght (de Suuo; rectius de Surio), in the diocese of Lismore. Mandate, as below. Lately, on the present pope being informed by Gillatius (also written ‘Gillacius,’ passim) Okeyt, priest, of the diocese of Killaloe (Laonien.), that Philip Wyod, then holding the deanery of Lismore, had committed a number of excesses and crimes [not here expressed], ordered David Oflyn, precentor of the said church, his own name not being [then] expressed, if and after Gillatius accused Philip before the said precentor, to summon Philip, and if he find the above to be true, to deprive and remove him, and in that event to collate and assign the deanery to Gillatius. The recent petition of Gillatius contained that, after the said David had begun to proceed, Gillatius bargained with Philip that if he would surrender the suit and cause pending before the said David and all right in or to the deanery in favour of Gillatius, the latter would give and pay him yearly for life a fit maintenance or a certain quantity of money therefor, as a result of which Philip surrendered the suit and cause and renounced the deanery into the hands of the said David, who, admitting the said surrender and renunciation, and proceeding without observing the form of the said mandate and the order of law, by his definitive sentence, which became a res judicata, with Philip's consent deprived and removed him, and under pretext of the said letters made collation and provision of the deanery, thus void, to Gillatius, who in virtue thereof obtained possession and at present holds it, taking the fruits, and has paid the said sum to Philip, thereby incurring the sentences of excommunication etc. promulgated against simoniacs. Seeing that the collation and provision are without force, the pope hereby orders the above three to absolve Gillatius from simony and the said sentences etc., enjoining penance, dispense him on account of irregularity, if any, contracted by celebrating masses etc., and rehabilitate him, and after doing so, and if he find the said surrender and renunciation lawful, to admit the same by papal authority, and collate and assign the deanery, a major elective dignity with cure, value not exceeding 16 marks sterling, to Gillatius; whether it be void as above, or by the death of William Whyt or of John Cauerdyn, or in any other way. Mandate to dispense to marry John Hamylton, layman, and Elizabeth de Maxwellis, of his diocese, who formerly, aware that they were related in the third and third degrees of affinity, contracted espousals per verba de futuro. 1449. 10 Kal. Jan. (23 Dec.) St. Peter's, Rome. (f. 183d.)	To the abbot of Holyrood, Edinburgh, and the provosts of Dalkethe and Bethanys, in the diocese of St. Andrews. Mandate, as below. The recent petition of Richard Cady, priest, of the diocese of Glasgow, bachelor of canon and civil law, contained that after the late Thomas Greynlaw, rector of St. Laurence's in the place (loci) of Conwa, in the diocese of St. Andrews, had in virtue of letters of Eugenius IV been deprived for adhering to the so called General Council which remained in the city of Basel after the translation of the Council by that pope thence to Ferrara, and after provision had in virtue of the same letters been made to Adam Frauconare (rectius Fauconare), priest, of the diocese of St. Andrews, who in virtue thereof obtained possession and had held it in peace for some years, the said Thomas was restored thereto alike in virtue of the general letters by which the present pope restored to their benefices those who in the cities of Basel and Lausanne had adhered to Amedeus [now] bishop of Sabina, then called in his obedience Felix V, even if other persons had acquired a right in or to such benefices by papal or other collation or provision, as also in virtue of other letters of the present pope specially granted to him. The said church having become void by the death of the said Thomas, without having had possession, although the said Adam unduly detained it after the said restoration, as he still does, without any other canonical title, the pope hereby orders the above three to summon Adam and others concerned, and to collate and assign the said church, value not exceeding 40l. sterling, to Richard, removing Adam and any other unlawful detainer; notwithstanding that provision was lately successively made to Richard, by papal authority, of a canonry of Glasgow and the prebend of Torbolten therein, of which he is in possession and about which he is litigating, and by authority of the ordinary of the parish church of Lochmaban (also written ‘Lochimaban’) in the diocese of Glasgow, of which he is in possession, value not exceeding 20l. and 15l. sterling respectively, which latter he is to resign, as he has offered, upon obtaining St. Laurence's. 1449[–50]. 7 Id. Feb. (7 Feb.) St. Peter's, Rome. (f. 212.)	To John Stak, canon of Limerick. Reservation to the pope's gift, for collation to him (fn. 2) (who was lately dispensed by papal authority, notwithstanding his illegitimacy as the son of a deacon and an unmarried woman, nobles, to be promoted to all, even holy orders and hold any compatible benefices of any number and kind, with or without cure, even if canonries and prebends, dignities etc., and to resign all, simply or for exchange, as often as he pleased) of a canonry of Cloyne (Clonen.) and the prebend of Cuyllcolling and Brechmuy therein, value not exceeding 3 marks sterling, which are to become void by the promotion, recently made by the present pope, of Maurice Stak, elect of Ardfert, to that church, and by his consecration which is to be administered; notwithstanding that he holds a canonry of Limerick and the prebend of Effyng, value not exceeding 15 marks sterling; that the present pope recently granted him provision of the deanery of Ardfert, a major elective dignity with cure, value not exceeding 20 marks sterling, of which he is not in possession; that Eugenius IV, by divers letters, ordered provision to be made to him of the archdeaconry of Limerick, a non-major non-elective dignity with cure. value not exceeding 60 marks sterling, of the rectory or plebania of the parish church of Dwngarvan in the diocese of Lismore, of the patronage of laymen and value not exceeding 100 marks sterling, and of a canonry of Tuam and the prebend of the small churches of Conmacniculy and Commaenmara (fn. 3) (rectius Conmaenimara), value not exceeding 10 marks sterling, in virtue of which letters provision was made to him by the said papal authority of the said archdeaconry, of which he is not in peaceable possession, of the said rectory, which was afterwards erected into a prebend of Lismore, and of which he is in possession, together with a canonry of that church, and of the said canonry and prebend of Tuam, of which he is not in possession; and that the said pope dispensed him to receive and retain for life the said archdeaconry and any other benefice, or otherwise any two benefices, with cure or otherwise incompatible, even if dignities etc., and to resign them, simply or for exchange, as often as he pleased.
