(who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted and obtained by canonical collation the perpetual vicarage of St. Munchins (Sancti Munchini) in the diocese of Limerick, value not exceeding 5 marks sterling, possession of which he has been despoiled of by a certain adversary, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) the perpetual vicarage of Duynchriyd [also written ‘Druynchriyd’ (rectius ‘Druymchriyd’) and ‘Drumchriayd' and ‘Druimchyd’ (rectius ‘Druimchryd’) and ‘Drumchyd' (rectius ‘Drumchryd’)] in the said diocese, value not exceeding 4 marks sterling, void because the late Laurence Ochirnaid, when holding the perpetual vicarage of Rathmacuomayn in the same diocese, obtained it by canonical collation and held it for some time against ‘Execrabilis' together with the said vicarage of Rathmacuomayn, without dispensation, and therefore reserved to the apostolic see; whether it became void as above, or by the death of the said Laurence, or by his resignation or that of Fergal Yconryd (or Ycomyd), clerk, or in any other way. To the prior of St. Mary's, Druymlethan, in the diocese of Kilmore (Triburnen.) and John Magamran and Fergal Ofyrgussa, canons of Kilmore. Mandate, as below. The pope has learned that two lands or possessions called the ‘coledeatuus (sic) de Gart Elagachan’ in the diocese of Clogher, wont to be assigned as a title of a perpetual benefice to secular priests called ‘culdees’ (coledei), who are present at divine offices in the church, reputed a collegiate church, of St. Laserianus de Damynys, in the said diocese, are void and have been so long void that (fn. 2) there is no certain knowledge as to the true and last mode of voidance, and that their collation has by the Lateran statutes lapsed to the apostolic see, although Nolanus (i.e. Nelanus) Othalaich, a married clerk of the said diocese, usurping them as if they belonged to him like hereditary goods, has unduly detained possession for some years, taking the fruits. The pope therefore (holding to be expressed by these presents the quality and condition of the said Nolanus. and the number of years during which he has detained the said lands or possessions, and the specific and determinate cause from which it is clearly evident that he has no right in the said lands or possessions) hereby orders the above three to collate and assign to Bernard Ocathasaich, priest, of the said diocese (whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents, and who from fear of Nolanus's power has no hope of obtaining justice in the city and diocese of Clogher) the said lands or possessions, to which appointment has from of old been made by election, their value not exceeding 3 marks sterling, summoning and removing the said Nolanus; notwithstanding that the pope lately ordered provision to be made to Bernard of a certain perpetual vicarage, with cure, of the said church [of St. Laserianus], value likewise not exceeding 3 marks sterling, with which he is hereby dispensed to receive and retain for life the said lands or possessions. Collation and provision to him, who lately, notwithstanding his illegitimacy as the son of an unmarried man and a married woman, had himself made a clerk, the rectory of St. Patrick's de Druynguin (also written ‘Druymguim’) alias de Macharym Nybayr (also written ‘Nybar’) in the diocese of Kilmore (Triburnen.), without cure and value not exceeding 6 marks sterling, of which, upon its voidance at the apostolic see, and its consequent reservation, by the death there of Patrick Maconnayng, the present pope granted provision to the late John Magiuuran, clerk, of the said diocese, who has died at the said see without the papal letters having been drawn up, so that the said rectory is still void and reserved as above. Mandate (the pope having been informed by John Olanru, priest, of the diocese of Ossory, that John Odubgynd, perpetual vicar de Schayrt in the said diocese, a public and notorious fornicator, has publicly and shamelessly, and in contempt of the monitions etc. of the ordinary, kept a concubine, by whom he has begotten offspring still alive (fn. 7), and has dilapidated and alienated and uselessly consumed and converted to the debased (pravos) uses of the said concubine and offspring a number of the possessions of the said vicarage, to the shame of the priestly order) if and after Olanru (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself so promoted) accuses Odubgynd before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 5 marks sterling, to Olanru, whom the pope hereby dispenses to receive and retain it, and to resign it, simply or for exchange, as often as he pleases (fn. 8), notwithstanding the said defect etc. Vite etc. (P. and B. de Monte. | P xx. To the archbishop of Armagh, the abbot of St. Mary's, Mellifont (Mellifontis), in the diocese of Armagh and Patrick Okynagan a canon of Armagh. Mandate, as below. The pope lately [above, p. 556] ordered certain executors [not here named] to cause Thomas Macreuayr, [now] abbot of the Augustinian monastery of SS. Peter and Paul, Armagh, then a secular priest, and holding the rectory of Teachdampnada in the diocese of Clogher, to be received as a canon of the said monastery, and to receive his regular profession, and thereupon to make him provision of the said monastery; and willed that, as soon as he made such profession, he should resign the said rectory, whereby it became reserved, in accordance with the pope's late reservation of all benefices whose holders he should require to resign. Subsequently, as the recent petition of James Ohannrachdich, clerk, of the said diocese [of Clogher] contained, upon the said rectory becoming void by the said Thomas making his profession and by provision being made to him of the said monastery, Roger bishop of Clogher, perhaps ignorant of the said reservation, with the consent of the chapter of Clogher created in that church (in which there is a certain number of canons, but not holding prebends) a new canonry, and erected the said rectory, thus void, into a prebend thereof, and made collation and provision of the said new canonry and prebend to William Macreuayr, priest, of the said diocese (fn. 9). The said collation and provision being therefore without force, and the said rectory, thus erected into a prebend, being therefore still void and reserved, the pope hereby orders the above three (inasmuch as from fear of William's power James has no hope of obtaining justice in the city and diocese of Clogher) to summon the said William and others concerned, and if they find the said erection to have taken place (fn. 10), to confirm it by the pope's authority, make provision to the said James (who alleges that William, under pretext of the said collation and provision, has unduly detained for about (fn. 11) a year possession of the said rectory erected [into a] prebend; who lately, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, had himself made a clerk, and was afterwards dispensed by papal authority to be promoted to all, even holy orders and hold a benefice even with cure; to whom provision was afterwards made by the said papal authority of the said rectory, as being void by the resignation of the said abbot Thomas, made after his said profession had been made and received; and who has for several years studied canon law, and intends to study it in future) of another canonry of the said church, and moreover to collate and assign to him the said rectory thus erected into a prebend, its net yearly value not exceeding 6 marks sterling. Mandate to collate and assign to Gilbert Smerles, perpetual vicar of Inche in the diocese of Aberdeen, M.A. (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and whom the present pope, upon ordering provision to be made to him of one or two benefices, even if one had cure or were a dignity etc. in a cathedral church, or each of them were a canonry and prebend in a collegiate church, etc., in the collation etc. of the bishop and the dean and chapter etc. of Glasgow and the abbot and convent of the Benedictine monastery of Kelsow in the diocese of St. Andrews, dispensed by the same letters to receive and retain such benefice or benefices, and who afterwards had himself promoted to all the said orders) the rectory of Vygton in the diocese of Whiteherne, value not exceeding 30l. sterling, void by the death without the Roman court of Hugh Kenedy; whether it be so void, or be void by the resignation of the said Hugh, or be void in any other way (fn. 12); notwithstanding that Gilbert holds the said vicarage of Inche, value not exceeding 9l. sterling, that he is still expecting by the said letters a benefice without cure, and that he is illegitimate as above. VII, pp. 162–164), and the perpetual vicarage of Boyllocene (sic) in the said diocese, value not exceeding 3 marks sterling, void by the free resignation of Maurus Yconnbayd, the said resignations having been made to Denis bishop of Kilfenora without the Roman court and by him admitted without the said court, by his ordinary authority; summoning and removing John Margranayster (sic) and the said Maurus, clerks, of the said diocese, who, respectively, have unduly detained possession of the said chancellorship for between three and four years, and the vicarage for between one and two years, without title or tittle of right; whether they be void as stated, or the chancellorship be void by the death of John Ydelaid, and the vicarage by the death of Thomas Ycallanayn, clerks, without the Roman court, or by the resignations of the said Nemeas and Maurus or other without the said court, even before notary public and witnesses, or they be void in any other way. Mandate (the pope having been informed by Odo Otchegan (sic), clerk, of the diocese of Derry, that Peter Ocaeylti, perpetual vicar de Raythluraych alias de Raythia in the said diocese, a public fornicator, has dilapidated and alienated and otherwise uselessly consumed a number of the possessions of the said vicarage, and committed simony) if and after Odo (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which, having been made a clerk, he obtained by canonical collation the rectory of Kyllerunechan (sic) in the said diocese, which he afterwards resigned, and to whom the present pope subsequently ordered provision to be made of a benefice with or without cure, even if a canonry and prebend, dignity etc. in the collation etc. of the bishops and deans and chapters etc. of Derry and Connor, dispensing him by the same letters to receive and retain such benefice and to resign it. simply or for exchange, as often as he pleased; and whom the pope hereby absolves from all sentences of excommucation etc. as far only as regards the taking effect of these presents) accuses Peter before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 6 marks sterling, to Odo. Mandate (the pope having been informed by David Ocoyulerga, a canon of Achonry, that Henry Omothan (rectius Omochan), perpetual vicar of Kyllarraccha in the diocese of Achonry, a public and notorious fornicator, has dilapidated and alienated and uselessly consumed a number of the possessions of the said vicarage and, being excommunicate and publicly proclaimed excommunicate by authority of the ordinary, has celebrated or rather profaned masses etc. in contempt of the Keys, incurring irregularity to the shame of the priestly order) if and after David, who is a priest, accuses Henry before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to David; whether it become void by such deprivation, or be void by the deprivation and removal lately made of the said Henry by authority of the metropolitan, or be void in any other way.
