Relaxation in perpetuity of ten years and ten quarantines of enjoined penance to all who, being penitent and having confessed, visit on each of the feasts of St. Mary the Virgin and SS. Christopher the Martyr and Martin the Confessor the parish church of St. Mary de Solomiac in the diocese of Lombez (Lombariensis diocesis) and the chapel dedicated to the said SS. Christopher and Martin which Gilbert Ranfrow, donsel, of the diocese of Aberdeen, dwelling in the realm of Charles king of France, has built in the said church, and who give alms for their repair etc., each time they do so; with further faculty to the chaplain of the said chapel to grant to the said Gilbert and those related to him in any degree of kindred or affinity, or his domestic servants, who visit the said church and chapel on the said days and give alms as above, after hearing their confessions, absolution from all their sins, even in cases reserved to the apostolic see [once only], and enjoin salutary penance, and in cases not so reserved to do so as often as opportune. To Thomas archbishop of Canterbury. Faculty, as below. His recent petition contained that he excommunicated and caused to be publicly [proclaimed] excommunicate Thomas Baker alias Sherman of Lewis, layman, of the diocese of Chichester, because he, in a certain place subject to the archbishop's jurisdiction, violated a sequestration lawfully made by the archbishop of the goods of the late Amice Writher of Clive, immediately subject to the said jurisdiction, and removed the said goods from the said place, not only in contempt of the said jurisdiction, but to the prejudice of the liberty and rights of the church of Canterbury; and that the said Thomas, heedless of the said sentence, has not made satisfaction. At the archbishop's petition for faculty to proceed to heavier penalties against the said Thomas, the pope, hereby annulling any commissions and papal letters already made by the pope or papal legates or any others in the matter of the absolution of the said Thomas from the said sentence, or any such commissions etc. to be made in future which do not make full mention of these presents, as also all consequences thereof, except in so far as he gives satisfaction in respect of the foregoing, grants to the archbishop faculty to aggravate as often as expedient the processes made by him against the said Thomas, invoking, if necessary, the aid of the secular arm, etc. Ad ea libenter. Grant, at the recent petition of the master and brethren of the hospital or God's house of Dover, commonly called the ‘Maison Dieu,’ of the order of St. Mary, in the diocese of Canterbury (containing that on account of an unwonted pestilence in the said hospital or house (fn. 13) and other misfortunes the number of brethren in priest's orders is diminished, and that on account of the fewness of priests divine worship is not held in the church of the said hospital or house as becomingly as is wont, and that there are sometimes brethren in the said house very fit [for promotion] to holy even priest's orders, who cannot be promoted thereto on account of defect of age) that the present master and his successors may, as often as seems to them expedient, present to the ordinary, [for promotion] to all holy orders, two brethren every year or three brethren every two years, even under age, provided that they have attained their twenty-third year; with dispensation hereby to all brethren thus presented to be promoted to all such holy orders and minister therein. Annulment etc., as below. The pope repeats the contents of his late mandate to the archbishop of York [Reg. Vat. CCCCLIX, f. 157, above, p. 129], in regard to the cause between abbot John and the convent of St. Mary's, York, and Richard Hawkesworth (spelt ‘Haukesworth’ ibid.), vicar of St. Laurence's in the suburb of York, in the matter of their opposing claims to the tithes and oblations arising within the bounds of the parish church of St. Mary and the chapels of St. Olave and Fulford and especially of the place called ‘Grenedickes’ (cf. ibid.), viz. the commission of the cause by the pope to Robert bishop of Durham, and that bishop's sentence of excommunication against Richard; the recourse by Richard to Richard Tone (cf. ibid.), official of York; the said official's inhibition to bishop Robert to proceed further, his excommunication of a monk of St. Mary's, and his absolution of the said vicar Richard; the appeal of the said abbot and convent to the pope, and the pope's commission of the appeal etc. (notwithstanding the pope's previous commission of the said vicar's appeal to William bishop of Oloron, then holding the place of a papal auditor) to master Peter de Valle, a papal chaplain and auditor, with power to inhibit the said official, etc., which auditor is said to have proceeded short of a conclusion; and the pope's mandate to the above archbishop, at the petition of Henry king of England, to resume all the causes pending, hear them further and decide them in accordance with the customs of the realm, causing his decision to be observed by ecclesiastical censure etc., notwithstanding etc. as above, loc. cit. The recent petition of the said abbot and convent contained that William archbishop of York proceeding wrongfully [in several ways described], promulgated an unjust definitive sentence, by which he condemned them to pay certain sums of money to the said vicar and official, from which they appealed to the apostolic see, but that the archbishop, in contempt not only of the said appeal (of which he was not ignorant, and for the prosecution of which the abbot and convent were well within the lawful time) but also of the inhibition made to him by letters of the said auditor Peter (to whom, at the instance of the said abbot and convent the pope, not being fully informed of the said sentence, had given a commission to proceed in the cause, notwithstanding the pope's above calling up of the cause and his commission of it to the archbishop), is said to be endeavouring to proceed to execution of his aforesaid null and unjust sentence, to the contempt of the pope and the apostolic see and the great prejudice and hurt of the abbot and convent. (fn. 15) The pope, therefore, absolving hereby the said abbot and all the monks etc. of the said monastery from sentences of excommunication etc. delivered by the said archbishop or his official etc., and from prosecution by the said vicar and official, (fn. 16) revokes and annuls the said sentence and all its consequences, and decrees it to have been and to be null and void, and monishes the said archbishop, vicar and official, and all others to whom the goods of the said monastery have come, to restore them within six days after these presents have been affixed to the doors of the church of York or other eminent place, and not to proceed further in the said cause or meddle with it, under pain, in case of disobedience, after the lapse of the said six days, in the case of the archbishop of suspension and interdict, in the case of the vicar and official etc. of sentences of excommunication. Confirmation (he having been dispensed by authority of letters of Eugenius IV. to receive and retain for life with the said church any one other benefice with or without cure or otherwise incompatible, even if a parish church or its perpetual vicarage, or a dignity etc., provided that it were not a major or principal dignity, and to resign both, simply or for exchange, as often as he pleased; in which letters he, through ignorance of the law, alleged himself to be of noble birth, whereas he is not noble, wherefore he doubts whether the said letters and their consequences hold good) of the said dispensation; with grant hereby to use and enjoy the said dispensation and letters, as if he had not made the said mention.
