Mandate, at the recent petition of the present (fn. 2) abbot and the convent of the Benedictine monastery of St. [Mary without the] walls, York (containing that although to the said abbot and convent there belongs by ancient and hitherto peaceably observed custom the taking of all tithes and oblations arising within the bounds of the parish church of St. Mary, and of the chapels of the places of St. Olave (Sanctiolarii, rectius ‘Sanctiolaui’) and Fulford, without the said walls, which [church and chapels] are canonically united annexed and incorporated to the said monastery, and especially in the place called ‘le Grendykes’ situate within the bounds and tithe places of the said church and chapels; and that although the said abbot and convent from time immemorial have been and are in peaceable possession, or almost, of the right of taking, levying and having the tithes and oblations, even in the said place, nevertheless Richard Haukesworth, perpetual vicar of St. Laurence's in the suburb of the city of York, falsely alleging that the said place of [le] Grendykes is within the bounds and tithe places of the said church of St. Laurence, and that the tithes and oblations arising from the said place lawfully belong to him, has usurped and converted to his own uses certain [tithes and] oblations arising in the said place of [le] Grendikes, and has refused to restore them to the said abbot and convent, wherefore they have appealed to the apostolic see, and have petitioned for the commission of the appeal and of the principal matter to just men in those parts) to summon the said Richard and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To John Byngham, a canon of the Augustinian priory of Turgharton in the diocese of York. Grant, as below. Nicholas V dispensed him to receive and retain a benefice with cure, of any value, wont to be held by secular clerks, even if a parish church or its perpetual vicarage, or of the patronage of laymen, and to resign it, simply or for exchange, as often as he pleased. At his recent petition, containing that the person who drew up the petition for the said dispensation (fn. 3) put by mistake the name of ‘Thomas’ instead of ‘John,’ and that there is no canon in the said priory with the same name or surname, the pope hereby grants that the said dispensation shall hold good as if his said predecessor had called him ‘John Byngh[a]m,’ not ‘Thomas Byngh[a]m.’ Religionis zelus, vite ac morum. To the bishop of Durham, the abbot of Byland (de Bellalanda) in the diocese of York, and the prior of Durham. Mandate, at the recent petition of the abbot and convent of the Benedictine monastery of St. Mary without the walls, York (containing that although on account of the parish churches of the places of Burnyston, Cateryk, Forsett, Kirkb[y]kendell and Kyr[k]bylonsdell in the diocese of York, canonically united annexed and appropriated to the said monastery and situate within the archdeaconry of Richmond, which churches they and their predecessors have held to their uses from time immemorial, they owe no obedience to the archdeacon of Richmond in respect of his visitation or otherwise, but are by ancient custom exempt from his jurisdiction and from rendering obedience to him, nevertheless recently Laurence Bothe, archdeacon of Richmond, falsely alleging that on account of the said churches they were bound to render him such obedience, and that in respect thereof they had hitherto been negligent and contumacious, unlawfully and de facto extorted from them a sum of money, and unjustly endeavours to compel them to render such obedience in future, wherefore they have appealed to the apostolic see, and petitioned for the commission of the appeal and of the principal matter to just men in those parts) to summon the said Laurence and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the prior of St. Michael's Mount (de Ruppe Sancti Michaelis) in the diocese of Ardfert. Mandate, at the recent petition of John de Geraldinis, a canon of the Augustinian priory of St. Mary, Killagh (de Belloloco), in the diocese of Ardfert (containing that formerly some of his friends promised to pay a sum of money to certain noble and powerful men, to the end that they should pray and intercede with the prior and convent of the said monastery the more quickly to receive him as a canon and give him the habit, he being not ignorant thereof, but paying part of the money, after which, but not, it is believed, solely on account of the foregoing, he was so received and made his profession), to absolve him from all sentences of excommunication etc., and from simony incurred, enjoining penance etc., and rehabilitate him. The pope hereby, in the event of such absolution etc., taking place, dispenses the said John, who is also illegitimate, being the son of a priest, a prior, professed as a canon of the said order, and an unmarried woman, (fn. 4) related in the fourth degree of kindred and in the fourth and the third and fourth degrees of affinity, to receive and retain any compatible benefices with or without cure wont to be governed by canons of the said order, even if priorships, provostships, dignities etc., even if elective and with cure, and even if such priorship etc. be conventual, and to resign them, simply or for exchange, as often as he pleases, and moreover to be postulated, elected and appointed to any abbatial dignity of any monastery of the said order. Mandate (the pope having been informed by Maclerus (rectius Maelerus) de Burgo, an Augustinian canon of St. Catherine's, Eachdruim Omane, in the diocese of Clonfert, that Charles Oconcubayr, prior of the Augustinian monastery of St. Mary, de Rosbomayn (sic) in the diocese of Elphin, a public and notorious fornicator, has dilapidated and alienated etc. the fruits and goods of the said priory, committed simony with Magonius Macheochu Ycellaid, who then held it, by paying him a sum of money for the obtaining of it, and, after thus obtaining it, has held it for more than a year in peace without having himself ordained priest) if and after Maclerus (whom the pope hereby absolves from all sentences of excommunication etc., as far only as regards the taking effect of these presents, who has made his profession of the said order, and who lately, before entering St. Catherine's and making his profession, was dispensed by papal authority on account of illegitimacy, as the son of unmarried nobles, to be promoted to all even holy orders and hold a benefice even with cure) accuses Charles before the above dean, to summon Charles, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said priory, which is conventual, elective and with cure, value not exceeding 60 marks sterling, to Maclerus (sic); whether it become void by such deprivation, or be void by the deaths of Maurice Yconchubayr or William Yflannagan or John Miceaedagayn, successively its last possessors, or by the resignation of the said Charles or Magonius, or in any other way. To the archbishop of Cashel. Grant etc., as below. Nicholas V (upon being informed by Matthew Omubceayn, a Cistercian monk of St. Mary's Abington (Wothina) in the diocese of Emly, that Dermit, abbot of the Cistercian monastery of Holycross de Wochtarlamond in the diocese of Cashel, had committed homicide and dilapidated and alienated etc. many of the goods thereof, and, having been excommunicated by the collector of dues of the papal camera in those parts for non-payment of fruits etc. due from him, and having been publicly proclaimed excommunicate, had taken part in divine offices in contempt of the Keys, thereby incurring irregularity) ordered on 8 Kal. March anno 8 [1455] a certain judge [not here expressed], if and after Matthew accused Dermit before him, to summon Dermit, and if he found the foregoing to be true, to deprive and remove him, and in that event to make provision to Matthew. Inasmuch as by reason of the death of the said pope his letters were not drawn up, the present pope ordered the above archbishop, if Matthew accused Dermit before him, to summon Dermit, and if he found the foregoing to be true, to deprive and remove him, and in that event to make provision to Matthew of Holycross, whether it should become void by such deprivation or should be void in any other way. At Matthew's recent petition (containing that Dermit has committed divers other excesses and crimes not expressed in the said letters, and that he also, without having obtained any canonical dispensation, immediately succeeded his father, whose illegitimate son he was, in the rule and administration, although Odo Ograda, a monk of the said order, is said to have held possession of them, after the said father's death, but only momentarily and not for a whole natural day (fn. 5); and that, if the inquiry to be made by the above archbishop were extended to such other excesses and crimes, and if he took cognisance of Dermit's said succession etc., Matthew would more easily obtain the effect of the said letters), the pope hereby wills and grants that the archbishop may and shall, after the said accusation, make inquiry in regard to such other excesses and crimes, and take cognisance in regard to the said succession; that, if he find that Dermit committed other excesses and crimes on account of which he has deserved deprivation and removal, or that he immediately succeeded his father, he may and shall proceed to the said deprivation and removal, or decree that Dermit has no right in the said rule and administration, and that the monastery, whose value the pope wills to be as if expressed in these presents, is void; and that he may and shall execute the said other letters in every particular, as if the foregoing had been committed to him by them. Mandate, at the recent petition of abbot William and the convent of St. Mary's, Kyrkestall and Robert Mapilton, perpetual vicar of Outethorn in Haldernes, in the diocese of York (containing that a dispute arose lately between them about the taking of the [vicar's] portion of the said church, and that they at length agreed upon William archbishop of York as arbitrator, who awarded that the vicar present and future should receive and have from the abbot and convent, the [ap]propriators of the said church, by way of portion 12 marks sterling a year in equal parts at Easter and Michaelmas, and the house and mansio assigned from of old to the vicarage, with its garden and all other appurtenances, and that the abbot and convent should bear all burdens ordinary and extraordinary of the said church, except only the repair of the said mansio and of the houses and places pertaining to the same mansio, which repair should be at the expense of the vicar) to summon the said vicar and others concerned, and if he find the said award lawful, to approve and confirm it by papal authority. Mandate (the pope having been informed by Dermit Oconcubayr, an Augustinian canon of St. Mary's, Saints Island (de Insula Sanctorum), in the diocese of Ardagh, that Matthew Macoly, prior of the Augustinian monastery of St. Mary, Cluoyntuasgerthanasinna, in the diocese of Elphin, a public and notorious fornicator, has dilapidated and alienated etc. goods belonging to the priorship of the said monastery, and committed simony) if and after Dermit (who is illegitimate, being the son of a married man and an unmarried woman) accuses Matthew before the above three, to summon Matthew, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said priorship, a conventual dignity, elective and with cure, value not exceeding 40 marks sterling, whether it become void by such deprivation, or be void by the resignation of the said Matthew or in any other way, to the said Dermit, whom the pope hereby dispenses on account of the said illegitimacy to be promoted to all even holy orders and receive and retain the priory. To Eugenius Maccaedagayn, abbot of the Premonstratensian monastery of St. John Baptist de Cella parva in the diocese of Annaghdown. Grant etc., as below. Eugenius IV, upon learning that the above monastery was void by the death of Maurice, although John Omeallayd, a canon thereof, had, with the support of lay power, detained it for about two years and was still detaining it, without any tittle of canonical dispensation, ordered certain judges [not here expressed] to summon him and others concerned, and if they found the monastery to be void as above or in any other way, and its provision to belong specially or generally for any reason to the apostolic see, to remove the said John and any other unlawful detainer, and make provision to the above Eugenius; after which, as Eugenius's recent petition contained, he promised and paid a sum of money to one of the said judges in order that he should proceed the more quickly to the said removal and provision and, without having obtained any absolution and rehabilitation from the apostolic see, has for some time, since provision was made to him, acted as abbot, taking the fruits. The said monastery being in accordance with the foregoing still void, the pope hereby absolves Eugenius from all sentences of excommunication etc., and from simony etc., incurred by the said payment, dispenses him on account of irregularity contracted by celebrating masses etc., when under the said sentences, rehabilitates him, grants that the said letters and provision and their consequences shall hold good from the date of these presents, even if the said monastery, value not exceeding 20 marks sterling, be void by the death of the said Maurice, or by the resignation of Patrick Yduffing, or in any other way, and dispenses Eugenius, notwithstanding the foregoing, to retain the monastery and be abbot thereof. Dispensation to him, (who, although he has remained for several years in the above monastery, wearing the habit of the said order, and has tacitly professed it, has not expressly made his profession, although he proposes to do so; who is illegitimate, being the son of a prior, a priest professed as a canon of the said order, (fn. 6) and an unmarried woman, related in the third degree of kindred) to receive and retain, after he has expressly professed the said order, any benefice with or without cure, wont to be held by canons of the order, even if a priory etc., and to resign it, simply or for exchange, as often as he pleases. To the archdeacon of Ossory. Mandate as below. The recent petition of Thady Megirid (sic), an Augustinian canon of Frattakyreach in the diocese of Ossory, contained that after the priorship thereof, a conventual dignity, had been so long void that its collation had by the Lateran statutes lapsed to the apostolic see, and that there was no certain knowledge of the true mode of its voidance, the convent, seeing that the said monastery (which had formerly been famous, and in which hospitality was kept up to rich and poor) had fallen into great desolation and was in great need of reform and also of books, ornaments, bells and other necessaries, and hoping that the said Thady (who for the said repair and restoration had, with licence of his prior and convent, been transferred from his monastery of Incemacneri, of the said order, in the diocese of Elphin, of which he was a canon, to the said monastery of Fearttakyreach, and who had for a long time been engaged on the said repair etc.) would be of great service to the said monastery, unanimously elected him prior. The said election being without force, and the said priory being still void as above, and being still reserved in virtue of the pope's late reservation of all conventual dignities, the pope hereby orders the above archdeacon to summon Thady Ocrinam (who, as the above Thady alleges, is an Augustinian canon of Achamicairt in the diocese of Ossory, and who after the said lapse was by authority of the ordinary appointed warden or administrator of the said monastery of Fearttakyreach, and who, under pretext of the said appointment, and without any other canonical title or any tittle of right, has for more than a year but less than two years administered the said monastery and its goods) and others concerned, and if he find the facts to be as stated, and the said priory, value not exceeding 7 marks sterling, to be void as above or in any other way, and the said Thady Magriyd, who is of noble birth, to be fit, to collate and assign it, even if it have cure, provided that its collation lapsed as above, to the said Thady Magriyd (sic), inducting him, after having received from him the usual oath of fealty to the pope and the Roman church according to the form enclosed, and removing the said Thady Ocrinam and any other detainer. Mandate to receive and admit the proposed resignation, on account of old age and bodily weakness, of Alan Ocuyn, prior of the Augustinian monastery of St. Michael's Mount (Sancti Michaelis de Rupe) in the diocese of Ardfert, and thereupon to collate and assign to John Omulchonerre, a canon of the said monastery (who, although he has remained for several years therein, wearing the habit, and has tacitly professed the said order, has not [openly] made his regular profession but proposes to do so, has for more than two years studied canon law in the university of Oxford, and was lately, when a scholar and before entering the said religion, dispensed by papal authority on account of illegitimacy, as the son of a priest, a canon professed of the said order and an unmarried woman, related in the third degree of kindred, to be promoted to all even holy orders and hold a benefice even with cure), after he has openly made his profession, the said priory, which is conventual, has cure, is elective and depends on no monastery or other regular place, and whose value does not exceed 20 marks sterling; whether it be void as above, or by the death of Alan Ymulchonerre, or by his resignation or that of the above Alan Ycuyn, or in any other way. He is hereby dispensed, on account of the said defect, to receive and retain the priory, or without it any other benefice with or without cure, wont to be governed by canons of the order, and to resign it or such other benefice, simply or for exchange, as often as he pleases. Mandate to collate and assign to Charles Okellayd, a Hospitaller (who is of a noble and great race of princes, and is in his twenty-second year, is powerful for the defence of the priory of the Hospitallers’ house of St. John Baptist, Ryndun, in the diocese of Elphin, and has made his regular profession as a Hospitaller) the said priory, an elective dignity with cure, dependent on the Hospital of St. John of Jerusalem, value not exceeding 20 marks sterling, void by the death of Dermit Miccagdagan.
