Mandate, at the recent petition of William Twedi, clerk, of the diocese of Glasgow (containing that although the parish church of Mynto in the said diocese is of the patronage of William Turnbul, (fn. 2) donsel, and William Stewart, knight, of the said diocese, in such wise that the presentation belongs, at the first and second voidances to the former and at the third voidance to the latter, nevertheless, upon the said William Turnbul, (fn. 3) to whom for that turn, in accordance with the said arrangement, the patronage and presentation belonged, presenting the said William Twedi within the lawful time to John Mytton, (fn. 4) dean of Glasgow, who had been appointed by the chapter as vicar-general in spirituals of the then void see, and upon George de Sohan, clerk, of the said diocese alleging that he had been similarly presented within the like time by the said [William Stewart] knight, to the said vicar[-general], and upon a cause therefore being brought before the said vicar, not by papal delegation, he, proceeding wrongfully and abruptly in the cause, instituted the said George as rector and inducted him into possession, wherefore the said William Twedy has appealed to the apostolic see, and has petitioned for the commission of the appeal and of the principal matter to some upright men in those parts) to summon George and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the bishop of Zamora, the precentor of Ferns and William Crewach, a canon of Limerick. Mandate, at the recent petition of Thomas Farroll, priest, of the diocese of Ferns, bachelor of canon law (containing that lately, on a canonry of Ferns and‖ the prebend of Kylco(m) therein becoming void by the resignation of John Wyten to Robert bishop of Ferns,‖ (fn. 5) that bishop made collation and provision to the said Thomas, who in virtue thereof obtained possession and still holds them; and adding that he doubts whether the said collation and provision hold good) to collate and assign to Thomas the said canonry and prebend, to which is canonically annexed the parish church of Kilrane (Sancti Rodani alias Roadani) in the said diocese, and the value of which and of the said annex does not exceed 10 marks sterling; whether they be void as above, or by the death of Miles Deuros, or in any other way. To the official of Kilfenora (Fynnaboren.). Mandate, at the recent petition of Denis Yconnuyd, clerk, of the diocese of Kilfenora (containing that although formerly certain lands and possessions commonly called ‘de Nuoua,’ partly cultivated and partly uncultivated, belonging to the episcopal mensa of Kilfenora and situated in the said diocese, were wont to be granted for a certain yearly cess or rent (censu sive canone) in fee or perpetual lease alike to clerks and laymen, possession thereof is at present held by Dermit Oduauoreid and Malachy Otyernayd and certain other powerful laymen of the said diocese, without payment of any cess or rent; and that if the said lands and possessions were granted to the said Denis in fee or perpetual lease, for himself and his heirs and successors, in return for a yearly cess or rent of four marks of the money current in those parts, to be paid in perpetuity to the bishop of Kilfenora, he would with the help of his patrons and friends recover them from the said laymen, and study to improve them to the best of his power, and so the condition of the said mensa would be manifestly improved) to summon the said laymen and others concerned, and if he find the above to be true, and that such grant would be to the manifest utility of the said mensa, and if the said bishop consents, to make the desired grant to the said Denis, who is illegitimate, being the son of a bishop and an unmarried woman. Mandate, at the recent petition of Marianus Omulcoyn (rectius Omuleoyn), priest, of the diocese of Clonmacnoise (containing that formerly, on the voidance of the rectory of Maedcarnayn in the diocese of Tuam by the death of Dermit Odobelayn, Donatus archbishop of Tuam made collation and provision by his ordinary authority to the said Marianus, the validity of which he now doubts) to collate and assign to him the said rectory, value not exceeding 8 marks sterling, whether it be void as above, or in any other way. To the dean of Kilmacduagh (Duacen.). Decree etc. as below. It was set forth to Nicholas V by Dermit Ymaguaid, priest, [of the diocese of] Kilmacduagh, that a dispute having arisen between him and Denis bishop of Kilmacduagh he, on account of many injuries inflicted on him by the bishop, despoiled him of many goods and afterwards, by the advice of certain enemies of the bishop, caused him to be seized, and kept him in confinement for three nights, and laid violent hands on a number of priests and other clerks of the bishop's household and retinue, and inflicted on them and allowed to be inflicted on them other grave offences and contumelies, thereby incurring sentence of excommunication etc.; after which, repenting, he restored the bishop to liberty, submitted himself to his will and judgment, and petitioned him to absolve him, as far as he could, from the said sentence etc.; that the bishop forgave the offences inflicted on him, and, inasmuch as he could not grant Dermit absolution, remitted him, with the bishop's letters sealed with his seal, to the apostolic see in order that he might obtain such absolution etc.; wherefore the said pope, upon Dermit's alleging that he was present in the Roman court, that he was a native of the diocese of Kilmacduagh, and that unless he obtained ecclesiastical benefices he could not live becomingly, ordered on 5 Id. Jan. anno 8 [1455] a certain judge to summon the said bishop and others concerned, and to grant to Dermit, after he had made satisfaction to the bishop and the said injured parties, and after temporary suspension and penance, absolution from all sentences of excommunication etc., dispense him on account of irregularity, and dispense him to minister in his orders and to retain benefices with or without cure, provided that the said bishop consented, and to rehabilitate him, the said pope's will being further that if Dermit did not make such satisfaction etc. he should fall again under the said sentences etc. The said letters not having been drawn up on account of the said pope's death, the present pope hereby decrees that the said grant shall hold good from the date thereof, and that these presents shall suffice as proof, and orders the above dean to absolve Dermit etc. as in the said grant. To the abbot of Ballintober (de Fonte Sancti Patricii) in the diocese of Tuam alias Mayo, the archdeacon of Tuam and Dermit Ostahara, a canon of the same. Mandate, as below. Eugenius IV (upon its being set forth by Edmund (fn. 6) de S[t]antona, clerk, of the diocese of Tuam alias Mayo, that after the said pope had ordered provision to be made to him of the rectory of Roba in Chera in the said diocese, of the patronage of laymen and with cure, and had dispensed him to receive and retain it, notwithstanding his defect of age, he being in or about his twenty-second year, he obtained it in virtue of the said letters and held possession for some time in virtue of the said dispensation, even after he reached the lawful age, without being ordained priest and without having obtained canonical dispensation, and thereafter continued to do so for a year and more but less than two years, without being so ordained, taking the fruits) by other letters rehabilitated him [Cal. Papal Lett., IX, p. 498], ordered certain judges to collate and assign to him, after he resigned it, the said rectory, whether void by such non-promotion or in any other way, (fn. 7) and dispensed him not to be bound for seven years, whilst studying letters and canon law in a studium particulare, there being no university in those parts, (fn. 8) to be promoted to deacon's or priest's orders on account of the said rectory, provided that within a year after obtaining possession of the rectory he should be ordained subdeacon [ibid, pp. 498, 499]. At his recent petition, containing that without being ordained subdeacon within the said year, and without being ordained deacon and priest within the said seven years he had detained and was detaining possession unduly, but had done so for less than eight years, the present pope has by other letters rehabilitated him, and required him to resign. The said rectory being therefore still void by the said non-promotion, the pope hereby orders the above three to collate and assign to Edmund, who is by both parents of noble birth, after he has resigned it, the said rectory, value not exceeding 8 marks sterling, whether void by the said non-promotion, or by the death of Magonius Yothomays [‘Yhoumys’ in Cal. IX], or in any other way; notwithstanding that he has been received by authority of the ordinary as a canon of Tuam, and that the pope has this day granted him provision of the perpetual vicarage of Robin in the said diocese, value not exceeding 4 marks sterling, which he is hereby dispensed to hold with the said rectory, they being, as he alleges, so near that they can be conveniently served by one man, for ten years, after which he is to resign the said vicarage. Mandate to admit the resignation which Rory (Ruodricus) Ograda, a canon of Killaloe (Laonien.), proposes to make of his canonry and prebend of Tongrenyd in the said church, and to collate and assign them, value not exceeding 15 marks sterling, to Donatus, also Ograda, clerk, of the diocese of Killaloe, who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, nobles, to be promoted to all even holy orders and hold a benefice even with cure, and who has had himself made a clerk. March anno 8 [1455] ordered a certain judge to collate and assign to Thomas de Anglo, then as now (etiam tunc) a canon of Tuam, the prebend of Balla in the church of Tuam alias Mayo, value not exceeding 6 marks sterling, void by the death of Thyeus Ymurerchu, whether so void, or void by the resignation of Thomas Machelonyn, or in any other way. Inasmuch as the said pope died before his letters were drawn up, the pope hereby decrees that they shall hold good from the said date, and that these presents shall be sufficient proof of them; with mandate to the above abbot to make the collation. (who was lately dispensed on account of illegitimacy, as the son of a priest and an unmarried woman related in the second and second degrees of affinity, by authority of the ordinary to be promoted to minor orders and hold a benefice without cure, and afterwards by papal authority to be promoted to all even holy orders and hold another benefice even with cure, and subsequently to hold the said archdeaconry, provision of which was ordered to be made to him) a canonry of Clonfert and the prebend without cure (simplex prebenda) of Kyllassobaigmayclayn therein, value not exceeding 2½ marks sterling, so long void by the death of William Omuregayd that by the Lateran statutes their collation lapsed to the apostolic see, although Odo Okellayd, clerk, of the diocese of Clonfert, on account of the inordinate favours enjoyed by whom in the city and diocese of Clonfert the said Denis has no hope of obtaining justice therein, and who is to be summoned and removed, has unlawfully detained possession for about two years under pretext of a collation by authority of the ordinary after the said lapse; whether it be void as above, or by the death of David Ycallanayd, or because the said David made his profession as a Carmelite friar, or by the resignation of the said William and David, or in any other way. Mandate to collate and assign to Richard FitzEustace, priest, of the diocese of Meath, a canonry of Dublin and the prebend of Luska therein, value not exceeding 60 marks sterling, so long void by the death of William Crueys that by the Lateran statutes their collation lapsed to the apostolic see, although Michael archbishop of Dublin, who is to be summoned and removed, has by his own authority for about three years unlawfully detained possession after the said lapse, without any indult, dispensation, grant or title, from fear of whose power the said Richard cannot safely meet him within the city and diocese of Dublin.
