To Gerald Macchoyd, canon of Cloyne (Clonen.). Grant etc., as below. Pius II (on being informed by Dermit Machmachona, clerk, of the diocese of Limerick, that formerly, a canonry and the prebend of Archanne in Limerick being void by the death of William Rustel, and having been void so long that by the Lateran statutes their collation had lapsed to the apostolic see, Thomas Omulm[y]kyl, (fn. 2) clerk, of the diocese of Cashel, in virtue of a collation and provision by authority of the ordinary, made to him after the said lapse, obtained possession of the said canonry and prebend, about which a suit was then going on in Ireland (in partibus), under a papal commission, between [the above] Dermit Macmachona and Thomas Arthur, clerks, of the said diocese of Limerick; that with the said Dermit, after he had won a definitive sentence against the said Thomas Arthur, the said Thomas Omulmykyl made a simoniacal agreement that if Dermit would give up in his favour all his right in or to the canonry and prebend he would pay him a sum of money, which he afterwards did; that as a result of the agreement Dermit gave up all his right to William, bishop of Limerick, who, probably ignorant of the said agreement, made collation and provision anew (de novo) of the said canonry and prebend to Omulmykyll, who under pretext thereof remained in his de facto possession, thereby incurring the sentences etc. for simony, notwithstanding which he took part in divine offices, in contempt of the Keys, thereby contracting irregularity), granted a mandate to a certain judge, under date 3 Id. Aug. anno 6 [1464], if the said Dermit would accuse Omulmykyl before him, to summon him and others concerned, and if he found the foregoing to be true, to declare the said collation and provision to Omulmykyl null and void, and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 8 marks sterling, to the said Dermit; whether they were then void by such removal, or were void by the death of John Purstel, or in any other way. Seeing that, by reason of the said pope's death, his said letters were not drawn up, the present pope hereby decrees that the said grant etc. shall take effect from the said date, as if the letters thereof had been drawn up, and that these presents shall be sufficient proof thereof; with mandate hereby to the above canon, if Dermit (who from fear of Ymulmykyl's power fears to meet him in the city and diocese of Limerick) will accuse Omulmykyl before the canon, to summon Omulmykyl and others concerned, and if he find the foregoing to be true, to declare the said collation and provision to Omulmykyl to have been and to be null, remove Omulmykyl, and in that event to collate and assign the said canonry and prebend to Dermit.Rationi congruit. To Denis Odeachid, canon of Killaloe (Laonien.). Collation etc., as below. Pius II made provision to Matthew, [now] bishop of Killaloe, then a canon of Limerick, of the said see, whereby his canonry of Limerick and prebend of St. Munchin's (fn. 3) became void at the Roman court (where by the said pope's order he was consecrated), and ipso facto reserved to the said pope, so that, inasmuch as that pope died without having disposed thereof, they remain void and reserved to the present pope, although William Alsard alias Acglabard, priest, of the said [sic] diocese [sc. Limerick], without any canonical title or any other right, has detained the said canonry and prebend for about a year. The pope therefore orders the above canon to summon the said William and others concerned, and collate and assign the said canonry and prebend, value not exceeding 12 marks sterling, to Bernard Obryen, clerk, of the diocese of Limerick, who from fear of William's power cannot safely meet him in the city and diocese of Limerick, removing William and any other unlawful detainer. Wenzel's ‘An. 1 to. 10.’ A contemporary end-paper has the contemporary description: Primus de prebendis vacantibus anno primo domini nostri domini Pauli pape ii., and also the contemporary order: ‘R(ecipe) Rugia, H.’, and the rubricator's answering ’Ruya rubricauit.’ The above contemporary description ‘Primus de prebendis …’ is repeated, as usual, on the bottom edge of the volume.
