Mandate to dispense John [son] of William Crosse, layman, and Beatrice [daughter] of Andrew Rede, of the dioceses of Térouane and Durham, dwelling in the said town, to remain in the marriage which they formerly, after the publication of banns, contracted per verba legitime de presenti, without subsequent copulation, in ignorance that Beatrice's father had been godfather to John at his baptism, whence arises an impediment of spiritual relationship; declaring legitimate the offspring to be born of the said marriage. To William Layburn, perpetual vicar of the parish church of Pittington in the diocese of Durham. Dispensation, as below. His recent petition contained that after he, then a scholar, had been ordered to be dispensed by papal authority on account of illegitimacy (as the son of a priest, who had made his profession as a Premonstratensian canon, and a married woman), to be promoted to all, even holy orders and receive and retain a benefice even with cure, he without presenting the letters of the said dispensation, and without mentioning the said defect, had himself promoted to all minor orders and ministered therein; after which he was dispensed by papal authority, notwithstanding the said defect, to minister in the orders thus received, be promoted to all holy orders and retain one other compatible benefice in a cathedral, even metropolitan, or a collegiate church, but below a canonry and prebend [in a cathedral or a metropolitan church], and a canonry and prebend of a collegiate church, and to resign it, simply or for exchange, once only, (fn. 2) after which latter dispensation he was promoted to all holy orders, even priest's orders, and obtained the above vicarage and a canonry of Chester [le Street] in the same diocese and the prebend of Byrcly (recte Byrtly) therein, (fn. 3) value together not exceeding 20l. sterling. The pope hereby dispenses him to receive and retain one other benefice with or without cure compatible with the foregoing, even if a canonry and prebend or an office in a cathedral, even metropolitan, or a collegiate church, and even if it be elective, and have cure, and to resign all, simply or for exchange, as often as he pleases, and hold instead not more than three mutually compatible benefices. To the priors of Dover (de Douaria) and Folfton (recte Folston, i.e. Folkestone) and the provost called the master of God's house, Ospringe, in the diocese of Canterbury. Mandate, as below. The recent petition of the abbot and convent of Faveiysham (sic), O.S.B., in the diocese of Canterbury, contained that although the tithes of all fruits in the lands and places within the parish of Ulcombe in the said diocese belong by ancient custom to the abbot (abbatum, recte abbatem) and convent, and that the present abbot and his predecessors and the convent have from time immemorial been in peaceable possession thereof, nevertheless Thomas Wikeham, rector of the said church, falsely alleging that they belong to him, has brough the abbot and convent before John Stokes, LL.D., auditor-general of the court of Canterbury, who, wrongfully and unjustly proceeding in the cause, has promulgated an unjust definitive sentence in favour of the rector and against the abbot and convent, and condemned the latter in costs, from which sentence the latter have appealed to the apostolic see, but on account of a legitimate hindrance have not prosecuted their appeal within the lawful time. The pope therefore hereby orders the above three to summon the said rector and others concerned and, notwithstanding the said lapse, if they find the said impediment lawful, to hear both sides, taking cognizance of the principal matter also, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. Mandate to dispense Florence Meckaairhe, layman, and Helen Inyswelan, of his diocese, who have several times committed fornication and incest with one another and had offspring, to marry, notwithstanding that they are related in the third and seven-fold fourth degrees of affinity, and notwithstanding also the impediment of quasi-affinity (publice honestatis iusticia), arising from the fact that Dermit Ohedershoil, layman, of the diocese of Ross, who is related to Florence in the second and third degrees of kindred, contracted espousals with Helen, and afterwards contracted marriage per verba legitime de presenti with another woman; absolving the said Florence and Helen from the said incest, enjoining a salutary penance, and declaring legitimate the said and future offspring of the marriage.   • 1. On the back of the volume is the usual modern description in Italian:Paolo II. 1465. Anno 1. Lib. 4, and on a modern end-paper is Mgr. Wenzel's ‘An. 1. to. 18.’ A contemporary end-paper has the contemporary description: Quartus de diversis formis anno primo domini nostri domini Pauli pape ii, the order ‘R(ecipe) Ru., P.’ and the corresponding ‘Rubricatus est presens liber per me Matheum de Ruya.’ There is also the contemporary ‘Quesitus pro Poncio,’ and a contemporary scribble ‘Paulus seruus seruorum dei dilecto filio Dalmatio de Fossis c[i]ui Beneuentan. in (?) illa magis in ulla magis.’ The above contemporary description: Quartus de diversis … is repeated, as usual, on the bottom edge of the volume. There are ff. i.—cccviii. of text.
