To the archdeacon and the chancellor of Glasgow, and William Forman, canon of Dunkeld. Mandate, as below. The recent petition of abbot Richard and the convent of Calco, O.S.B., in the diocese of St. Andrews, and Thomas Penwen, priest, of the diocese of Glasgow, contained that the said abbot and convent granted and assigned, first to the late Robert Penwen the younger, priest, of the said diocese of Glasgow, for life, as a reward for his services to the said monastery, and afterwards, on his resigning them or dying, to the said Thomas Penwen, also for life, all the fruits, rents, profits, houses and goods in the same diocese of Glasgow, value not exceeding 9l. sterling, which the late Robert Penwen the elder had been wont to hold, belonging to the said monastery by reason of the parish churches of Closbarii and Morton, in the same diocese of Glasgow, canonically united to the said monastery, as is said to be more fully contained in the authentic letters of the said abbot and convent, sealed with their seal, and in public instruments, in virtue of which grants and assignments the said Robert the younger received the said fruits etc., and held the said houses and goods as, after his death, the said Thomas does at present. The pope, therefore, orders the above three, if they find the said grants and assignments lawful, to approve and confirm them, and the consequences thereof, by papal authority, causing Thomas to enjoy peaceable possession of the said fruits etc., houses and goods for life. Dispensation to him who, notwithstanding his illegitimacy, as the son of an unmarried nobleman, of a race of earls, and an unmarried woman, has been made a clerk and is in his nineteenth year, so that when he is of fit age he may be promoted to all, even holy orders and hold any compatible benefices with or without cure, of any number and kind, even if canonries and prebends, major or principal dignities etc., namely, in the case of benefices without cure forthwith (exnunc), and in the case of a benefice with cure as soon as he has attained his twentieth year, and may resign them all, simply or for exchange, as often as he pleases; notwithstanding his said defects of age and birth, etc. Vite etc. (Hug. and A. de Cortesiis. | Hug. xl. To Bernard Ochoncubayr, clerk, of the diocese of Kilfenora (Fynaboren.). Absolution from all sentences of excommunication incurred and rehabilitation, at his recent petition containing that after he had been dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried nobles, to be promoted to minor orders and hold a benefice without cure, and after he had been in virtue thereof made a clerk, on the rectory of the parish church de Kylleileach (fn. 3) et Vchtforayg alias de Glae in the diocese of Kilfenora, of lay patronage and with cure of souls, becoming void by the death of John de [sic] (fn. 4) Me(c)clancada, Thereolaus Obriain, layman, of the diocese of Killaloe (Laonien.), the patron, presented the said Bernard, who had obtained no other dispensation on account of the said defect, to Denis, bishop of Kilfenora, who instituted him, under pretext of which presentation and institution he obtained possession, and has detained it for more than ten years. Mandate, recapitulating the preceding, to collate and assign to the above Bernard, after he has resigned it, the above rectory, which is rural and whose value does not exceed 12 marks sterling, and also a certain perpetual benefice, called the prebend of Kulenne in Araym, in the church of Kilfenora, without cure and value not exceeding 3 marks sterling, void by the death of Donald Myctayghd, perpetual beneficiary called a prebendary in that church; whether they be void as stated, or the latter be void by the resignation of the late Richard Hicetfada, or whether they be void in any other way. The pope hereby specially dispenses the said Bernard to be promoted to all, even holy orders and receive and retain the said rectory and benefice, and also three other benefices with or without cure, compatible with one another and with the aforesaid, even if canonries and prebends, major or principal dignities, etc., and to resign them, simply or for exchange, as often as he pleases, and hold instead five compatible benefices; with further dispensation that for five years he shall not, provided that within the first year he be ordained subdeacon, be bound to have himself promoted to other holy orders; notwithstanding the above defect, etc. Vite etc. (P. and A. de Cortesiis. | P. xxxv.Septimo Id. To all Christ's faithful etc. Relaxation in perpetuity of five years and five quarantines of enjoined penance to all who, being truly penitent and having confessed, on the feast of SS. Cosmas and Damian and on the day of the dedication visit and give alms for the repair and conservation of the buildings of the parish church of All Saints, Baddeslay, in the diocese of Worcester. If similar indulgence, in perpetuity or for a time not yet elapsed, have been granted by the pope, the present letters shall be null and void. Splendor paterne glorie. To Ysac Omullalyd, canon of Elphin, and the official of Elphin. Mandate, as below. The pope has been informed by William Oceallaygh, (fn. 5) clerk, of the diocese of Elphin, that Bernard Oceallaygh, perpetual vicar of the parish church of Aghliag Maedhnagain in the said diocese, is a notorious fornicator, has committed simony, and has dilapidated the goods of the said vicarage. Moreover, the recent petition of the said William contained that the priory of the Hospitallers’ house of St. John Baptist, Reynduyn, in the said diocese, provision of which the pope recently ordered to be made to him, has become so much impoverished by the plundering of powerful laymen, who have driven away its cattle (fn. 6) and inflicted on it divers injuries, that the prior and brethren, in priest's orders, cannot be conveniently maintained therein, and suffers, moreover, no small lack of buildings, chalices, books and other ornaments; and that if the said vicarage were united in perpetuity to the said priory, the prior and brethren could be more becomingly maintained and more diligently repair the said house, etc. The pope, therefore, orders the above three, if William will accuse Bernard before them, to summon Bernard and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to unite the said vicarage in perpetuity to the said priory, value not exceeding 6 and 20 marks sterling respectively, whether the vicarage be void by such deprivation, or by the death of David Ychahan or Dermit Micgyllarnargh, or in any other way; so that the said William or the prior for the time being may take possession of the said vicarage and cause it to be served by a brother of the said house, in priest's orders, to be instituted by the ordinary, and may convery its fruits etc. to his own uses and that of the said prior and vicarage, etc.Ad ea per que. To the abbot of the monastery of Boudeloo in the diocese of Tournai. Mandate, as below. The recent petition of Thomas Sparke, perpetual chaplain at the altar of St. Nicholas, in the church of St. Peter de Casleten, in the diocese of Térouane (Morinen.), contained that he and Alerinus de Alneto resigned for purpose of exchange their respective benefices, viz., the said Thomas a canonry and prebend of the same church of St. Peter, by his proctor, Nicholas de Hille, clerk, of the said diocese (who made the resignation to John Kussins, canon of the said church, vicar-general in spirituals of John Vincentii, provost of the same), and the said Alerinus the perpetual chaplaincy at the said altar, making the resignation in his own person to the chapter; and that the said vicar and chapter admitted the respective resignations, and made collation and provision, the former of the said canonry and prebend to Alerinus, and the latter of the said chaplaincy to Thomas, in virtue of which collations and provisions Alerinus and Thomas obtained possession of the said canonry and prebend and chaplainey respectively. The said petition added that the values of the said canonry and prebend and chaplaincy do not exceed 60l. and 10l. of petits tournois, respectively, and that on account of such inequality, and for other reasons, Alerinus is ready to consent to the reservation of a yearly pension to Thomas of 4l. of gros of the money of Flanders on the fruits etc. of the said canonry and prebend, and of 7l. of the same money on the fruits etc. of his parish church de Caiusvilla in the said diocese, making 50l. of petits tournois, or thereabouts. (fn. 9) At the petition, therefore, of the said Thomas, who alleges that he is the almoner of Isabel, duchess of Burgundy, and that the fruits etc. of the said parish church do not exceed 84l. of petits tournois, the pope hereby orders the above abbot to reserve and assign to Thomas for life, if Alerinus consent, the above pension of 4l. and 7l. of gros of the money of Flanders, to be paid by Alerinus and his successors, from the fruits etc. of the said canonry and prebend and parish church, respectively; taking heed that there be no simony between them.
