To the abbot of the monastery of Cella nigra, Derry (Deren.), and Donald Oquervolan and Donatus Odochartaigh, canons of Derry. Mandate to collate and assign to Comedinus Omurgyssan, clerk, of the diocese of Derry (who, notwithstanding his illegitimacy, as the son of a priest and an unmarried woman, has been made a clerk) the rectory called the plebania of the parish church of Cluainkaa (fn. 2) in the said diocese, with cure, and value not exceeding 10 marks sterling, void by Nicholas, bishop of Derry's deprivation, by his ordinary authority, of Patrick Oduby, for his faults and demerits, although the said Patrick by his own temerity, and without any title, has unlawfully detained possession for about a year; summoning and removing the said Patrick and any other unlawful detainer. To the abbot of the monastery of Commor in the diocese of Down (Dunen.), and William Ocearuolan and Cornelius Ocquollan, canons of Derry (Deren.). Mandate, as below. The pope has been informed by John Macgillaerenan, clerk, of the diocese of Connor (Conneren.), that Patrick Ograffan, perpetual vicar of the parish church of All Saints, Antroia, in the said diocese, is a public concubinary, has committed simony, and has dilapidated the goods of the said vicarage, and, by neglecting to put away his concubine, has by the statutes of the church of Connor incurred sentence of excommunication, and, being bound by such sentence, and having been publicly proclaimed excommunicate, has profaned divine offices, to the shame of the priestly order. The pope, therefore, hereby orders the above three, if the said John (who notwithstanding his illegitimacy, as the son of unmarried parents, has been made a clerk, and who from fear of the said Patrick's power cannot safely meet him in the city or diocese of Connor) will accuse Patrick before them, to summon Patrick and others concerned, and, if they find the facts to be as stated, to deprive Patrick of the said vicarage, and in that event to collate and assign it, value not exceeding 4 marks sterling, to John, whom the pope hereby specially dispenses to be promoted to all, even holy orders, and receive and retain the vicarage, notwithstanding the said defect, etc. Vite etc. (Hugo and A. de Cortesiis. | Hugo. xvi. To the archdeacon of Annaghdown (Enachdunen.), and David Walsh (Valenci) and Odo Ocallanayn, canons of the same. Mandate, as below. The pope has been informed by David Macgalayn, clerk, of the diocese of Tuam, that although it is provided by the statutes of the church of Tuam that the holders of parish churches of their perpetual vicarages in the city or diocese of Tuam are bound to reside therein, celebrate in person, and exercise the cure of souls of the parishioners in person, under pain of ipso facto deprivation, without other monition, nevertheless Donald Omoleroyn, [perpetual] vicar of the parish church of Belchlair in the said diocese, has not only not celebrated in the said vicarage, nor exercised the cure of the same, which he has held for more than sixteen years, but has alienated and dilapidated many of its precious moveables. The pope, therefore, hereby orders the above three, if David, who from fear of the said Donald's power cannot safely meet him in the city and diocese of Tuam, will accuse Donald before them, to summon etc., as in the preceding, mutatis mutandis, and in that event to collate and assign the said vicarage, value not exceeding 5 marks sterling, to David. To the dean, the archdeacon, and the official of Ardagh (Ardachaden.). Mandate, as below. The pope has been informed by Bernard Macmoglay, priest, of the diocese of Ardagh, that Rory (Riodricus) Ohwvayn (or Ohwbayn), perpetual vicar of the parish church of Ryllinymary (recte Kyllinymary) in the said diocese, has committed simony, dilapidated the goods of the said vicarage, and neglected the cure of the said church and residence therein, and has committed other excesses etc., thereby incurring the sentences put forth against simoniacs, and, bound by such sentences, has celebrated or rather profaned masses and other divine offices, and taken part therein, thereby incurring irregularity, etc. The pope, therefore, hereby orders the above three, if the said Bernard will accuse the said Rory before them, to summon etc. as above, f. 210, mutatis mutandis, and in that event to collate and assign the said vicarage, with cure, and value not exceeding 7 marks sterling, to Bernard. To the abbot of the monastery of St. Mary de Clarofonte in the diocese of Derry (Deren.), and Cornelius Odube and Patrick Oquenan, canons of Derry. Mandate, as below. The pope has been informed by Phelim (Feleminus) Oqueruolan, clerk, of the diocese of Derry, that Donald Obraeny, rector of the parish church of Leacpadrag (fn. 5) in the said diocese, is excommunicate and a notorious fornicator, and has dilapidated and converted to evil uses the moveable and immoveable goods of the said church, and has not served it. The pope, therefore, hereby orders the above three, if the said Phelim, who is in or about his twenty-second year, and was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, will accuse the said Donald before them, to summon etc. as above, f. 210, mutatis mutandis, and in that event to collate and assign the said church, value not exceeding 4 marks sterling, to Phelim. He is hereby specially dispensed to receive and retain it, and to resign it, simply or for exchange, when he pleases, and not to be bound for seven years, whilst studing letters at a university, to be promoted to higher orders on account of the said church, provided that within a year he become a subdeacon; notwithstanding the said defect, etc. Vite etc. (P. and P. de Godis. | P. xx. To Master Anthony de Grassis, a papal chaplain and auditor of causes of the apostolic palace. Mandate, as below. The recent petition of Alan Cunyngham, (fn. 7) clerk, of the diocese of Glasgow, contained that a cause arose between him and the late Edward Cunyngham, clerk, about the [perpetual] vicarage of the parish church of Galston in the said diocese, which, upon its becoming void by the resignation of the said Edward to Andrew, bishop of Glasgow, the said Alan, in virtue of certain letters expectative (by which the present pope ordered provision to be made to him of one or two benefices, even if one had cure, etc., in the gift etc. of the said bishop and the dean and chapter etc. of Glasgow, and of the minister and convent of the Trinitarian house of Failfurd in the said diocese, and dispensed him, on account of his illegitimacy, as the son of a married nobleman and an unmarried woman, to receive and retain for life such benefice or benefices), accepted within the lawful period, and had provision made to him thereof, in virtue of which acceptance and provision he obtained possession, but which acceptance, provision and obtaining of possession the said Edward unjustly opposed, preventing Alan's peaceably holding possession, and alleging that the said vicarage lawfully belonged to himself. The said petition contained also that the pope, at Alan's instance, committed the said cause, although it had not lawfully devolved to the Roman court, to the above auditor, who has proceeded therein to the point of the articles proposed by the said parties (usque ad terminum ad articulandum inclusive inter partes ipsas). The said petition adding that whilst the cause was pending the said Edward has died without the said court, the pope hereby orders the above auditor to surrogate the said Alan in and to all the right which belonged to Edward in or to the said vicarage at the time of his death, and to make collation and provision to him of such right, etc., and moreover, to collate and assign to him the said vicarage itself, value not exceeding 10l. sterling. As soon as he obtains possession in virtue of these presents, the pope's said letters and their consequences shall be null as far as regards a benefice with cure, etc. Vite etc. (Hug. and Ja.
