Lateran Regesta. Vol. DCXCV. (fn. 3)

6 Paul II.

De Dignitatibus [Vacantibus].

1470.
15 Kal. May.
(17 April.)
St. Peter's, Rome.
(f. 52.)
To the abbots of Baltinglass (de Valle salutis) and Leix (de Lege dei), in the diocese of Leighlin, and the archdeacon of Leighlin. Mandate, as below. The pope has learned that the chancellorship of the church of Leighlin is void by the death of Richard Bruni (fn. 4) without the Roman court, and that a canonry of the church of Leighlin and the prebend of Graginst in the same (fn. 1) [church] have been so long void that their collation has by the Lateran Statutes lapsed to the apostolic see, and that there is no certain knowledge of the mode of the voidance of the said canonry and prebend, although Donatus Bruni, (fn. 2) clerk, without making mention of the fact of his illegitimacy, and without having obtained any dispensation on account thereof, has for between two and three years unduly detained possession of the said chancellorship and canonry and prebend, under a collation made to him thereof by papal authority. The pope, therefore, hereby orders the above three to summon the said Donatus and others concerned, and to collate and assign to Charles Occurryn, perpetual vicar of the parish church of Lewrdruyn in the diocese of Leighlin, the said chancellorship (a nonmajor non-elective dignity with cure) and canonry and prebend, the value of all of which does not exceed 10 marks sterling, the said canonry and prebend in whatsoever way they became void, and the said chancellorship whether void as above or in any other way; removing the said Donatus and any other unlawful detainer. The pope hereby specially dispenses the said Charles to receive the said chancellorship and canonry and prebend, and to retain the chancellorship and the said vicarage together for life. Vite ac morum. (P. and A. de Moncia. | P. xxx. Quinto Id. Junii Anno Sexto. de Varris.) [3½ pp.]
8 Id. June.
(6 June.)
St. Peter's, Rome.
(f. 56.)
To the abbots of St. Mary's, Rathoy, and O'Dorney (de Kyryeleyson), in the diocese of Ardfert, and the precentor of Ardfert. Mandate to collate and assign to John Fismoris, [perpetual] vicar of the parish church of Kilmekederi in the diocese of Ardfert (who was lately dispensed by papal authority on account of illegitimacy, as the son of an unmarried nobleman and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which, having been made a clerk, he obtained by canonical collation the said vicarage), the chancellorship of Ardfert, a non-major non-elective dignity without cure, value not exceeding 10 marks sterling, so long void that by the Lateran Statutes its collation has lapsed to the apostolic see, although David Fismoris, priest, of the said diocese, has for between five and six years, without any title, but by his own temerity, detained possession thereof; removing the said David and any other unlawful detainer. The pope hereby specially dispenses the said John to receive the said chancellorship, and to retain it for life together with the said vicarage. Vite etc. (P. and A. de Montia. | P.xx. Duodecimo Kal. Julii Anno Sexto. de Varris.) [3½ pp.]

De Exhibitis.

1470.
3 Id. July.
(13 July.)
St. Peter's, Rome.
(f. 177.)
To the bishop of Urbino (Urbinat.), and the precentor and official of Dunkeld. Mandate, as below. The recent petition of Thomas Huntar, priest, of the diocese of Glasgow, contained that formerly, on the voidance of the perpetual vicarage of the parish church of Mulyn in the diocese of Dunkeld by the death of Duncan Eugenii, Thomas, bishop of Dunkeld, made collation and provision thereof by his ordinary authority to the said Thomas, who in virtue thereof obtained possession, but now doubts whether for certain causes the said collation and provision hold good. The pope therefore, having learned that the said vicarage is still void as above, hereby orders the above three to collate and assign it, value not exceeding 8l. sterling, howsoever void, to the said Thomas. Vite etc. (P. and M. Amici. | P.xxii. Tertio Decimo Kal. Augusti Anno Sexto. de Varris.) [2 pp.]

(f. 283.)
Paulus etc. dilecto filio Helie Husce rectori parrochialis ecclesie de Okeford FyzpaynSarisburiensis diocesis in utroque iure bacallario salutem etc. Litterarum scientia vite ac morum honestas aliaque laudabilia probitatis et virtutum merita super quibus apud nos fide digno commendaris testimonio nos inducunt ut te specialibus favoribus et gratiis prosequamur, i.e. the proem only, cancelled. Footnotes

  • 1. On the back of the volume is the usual modern description in Italian:Paolo ii. 1469–70. Anno vi. Lib. 1. A modern end-paper has Mgr. Wenzel's ‘An. 5. to. 13,’ and on a contemporary end-paper is the contemporary description: Primus de dignitatibus [vacantibus] et de Exhibitis anno vio domini nostri domini Pauli pape ii., the order ‘R(ecipe) F., P.,' and the corresponding ‘Rubricatus est per me F. de Suno.’ A like contemporary description: ‘Primus de dignitatibus vacantibus et de Exhibitis Anno vio ,’ etc. occurs also, as usual, on the bottom edge of the volume. There are ff. i.–cccxlii. of text. The name of the rubricator, F. de Suno, appears in the top left-hand corner of f. i., which is unusual.
  • 2. or Brunus (per obitum quondam Richardi Bruni). The ‘B’ of Bruni is a poor one. Cf. the next note but one.
  • 3. prebenda de Graginstin eadem (recte de Graginst in eadem).
  • 4. dilectus filius Donatus Bruni. The first letter of the surname is, how, ever, more like ‘S’ than ‘B.’ Cf. the precoding note but one.
