Monition, etc., as below. The recent petition of Gerald (Ghieraldus), bishop of Cork and Cloyne, contained that although provision was made to him by papal authority of the said united churches on their voidance in a certain way, and although in virtue thereof he obtained possession of the rule and administration, and exereised the same for seven years in peace, nevertheless William Rochd (recte Roche), priest, has in many ways disturbed him in the said rule and administration, and has caused his subjects in the cities and diocese of Cork and Cloyne to be despoiled of all their goods by his sons John Rioque, Melerus, Thomas, David, and Edmund, has caused the city of Cloyne, especially the manse of the vicars of the church of Cloyne, to be burned, divers homicides to be perpetrated there, and many goods to be violently carried away from the said church of Cloyne and its cemetery, and that he took the said Gerald once before he became bishop, (fn. 1) and again thereafter, and put him in prison in chains, and that he has sacked the said city of Cloyne and the goods of the vicars of the church of Cloyne, (fn. 2) wherefore he and his followers were excommunicated etc. by the then archbishop of Cashel and his suffragans, regardless of which, aided and abetted by divers rectors, vicars and abbots etc. of the said cities, he has violently taken the fruits etc. of the said churches. The pope, therefore, hereby monishes the said William and all the said aiders and abettors, and also the chapters of the said churches and the clergy and peoples of the said cities and dioceses, etc., under pain of ipso facto sentence of excommunication, etc., within six days from these presents coming to their knowledge, to desist from the foregoing, etc., and make satisfaction to the said bishop; with mandate executory hereby to the abbot of St. Mary's, Middleton (de Choro benedicti), in the diocese of Cloyne, John Barri, a canon of Cork, and the official of Cloyne, who are empowered to invoke, if necessary, the aid of the secular arm; and exhortation and mandate to David, archbishop of Cashel, and all other archbishops and bishops, prelates, princes etc., knights and other temporal lords, especially James earl of Desmond, (fn. 3) John Barri, Maurice Roche, Donatus Marchati, Cormac son of Thady son of Cormac, (fn. 4) Florence Marchati prince of Carbery, (fn. 5) Donatus Omathona, and the brothers, sons and followers of the said lords, to help the said bishop to recover possession, etc.; with decree in regard to the mode of publishing the present letters, etc. Ad fut. rei mem. To Robert Boswel, a canon of Glasgow, M.A. Motu proprio collation and provision to him, who is by both parents of noble and even baronial birth, of a canonry of Glasgow and the prebend of Browent alias Balanrick, value 35 marks sterling, void at the apostolic see, and therefore reserved, by the pope's provision to John Sanclar, [bishop] elect of Caithness (Cathenen.), of that church (fn. 6); with mandate executory hereby to the bishop of Brechin, the archpriest of the church of Bologna (Bononien.), and the official of St. Andrews. To William Ochuyguyn, a canon of Killaloe (Laonien.). Mandate to collate and assign to Odo Okeraul, a canon of St. John Baptist's by le Naenh[a]c, O.S.A., in the diocese of Killaloe (who holds a place and a canon's portion, value 28 marks sterling, in the said monastery, and fears that he has incurred simony and sentences of communication etc. because, when provision had been made to him by papal authority of the said monastery, which he has now resigned, he paid Maurice Okbnedi, (fn. 7) clerk, who was molesting him, and preventing him by lay power from obtaining possession, a yearly pension in order to buy him off, (fn. 8) and whom the pope hereby absolves from such simony, and rehabilitates), the conventual priory of St. Mary, Syrkyerayn, of the said order, in the diocese of Ossory, value (with its annexed chapel of Fincora in the same diocese, which has cure), likewise 28 marks sterling, void by the death of Cornelius Macgyllapoll without the Roman court, and ipso facto reserved to the pope under his reservation of all void conventual priories. The above canon is to transfer him from St. John Baptist's to St. Mary's, with which he is hereby dispensed to retain the said place and canon's portion in St. John's for life. Dignum arbitramur. To the abbot of Holy Cross, Oterlaun, in the diocese of Cashel, John Baptista de Ferrariis, a canon of Modena (Mutinen.), and Richard Buttiler, a canon of Cashel. Mandate, as below. The monastery of St. Mary, Fermoy (de Castro dei), O. Cist., in the diocese of Cloyne (Clonen.), has become void at the apostolic see, and therefore ipso facto reserved to the pope, by his promotion of Nicholas, [now] bishop of Lismore and Waterford, to those united churches, and by his consecration, which has been performed by the pope's order at the said see. Moreover, the deanery of Cloyne has become similarly void at the same see, and reserved, by the resignation to the pope of James Philippi de Geraldinis (see above, p. 182), made by Philip Roche, prior of St. Mary's, Bridgetown (Ville pontis), O.S.A., in the said diocese, substituted by James's proctor, Gerald de Geraldinis, perpetual vicar of Killronayn in the diocese of Lismore. Furthermore, the perpetual vicarage of Kilmachan (fn. 9) in the said diocese has been so long void that its collation has lapsed to the said see, although Donald Offinacdhy, priest, has detained it for several years without any title. The recent petition of the said Gerald contained that after Paul II's reservation to himself of absolution from all sentences of excommunication etc. for simony, he, who was then holding the deanery of Lismore, bargained with Thomas Ruscel, priest, of Lismore, that if the latter would pay him a certain sum of money, he would resign the said deanery in his favour, and that in consequence thereof he resigned the said deanery to the present pope, who, in ignorance of the said bargain, made collation and provision of it to Thomas (above, p. 119), and that the latter paid Gerald the said sum, who received it, thereby incurring simony and the sentences etc. therefor, in which he has remained for between one and two years. At the said petition, the pope hereby orders the above three to absolve the said Gerald (who was lately dispensed by papal authority to receive and retain for life any two benefices with cure or otherwise incompatible, even if two major or principal elective dignities etc., who holds the said perpetual vicarage of Kilnorayn [sic], value 4 marks sterling, and who alleges that he is of noble birth, and that Thady Ochaym, a monk of the said monastery, alleging that provision of it was made to him by the present abbot of Monasteranenagh (de Magio), O.S.A., in the diocese of Limerick, has under pretext thereof, and without any title, usurped the rule and administration for between one and two years, after and in spite of the said reservation) from the said simony and sentences, etc., enjoining penance, dispense him on account of irregularity, and rehabilitate him, and in that event to collate and assign to him the said deanery of Cloyne, a major elective dignity with cure, value 24 marks sterling, and moreover, if after summoning the said Donald and Thady they find the said vicarage of Kilmachan and the said monastery, value 5 and 40 marks sterling, respectively, to be void, to unite the vicarage to the deanery, as long only as Gerald shall hold the latter, (fn. 10) and also to grant to him the said abbey of Fermoy (de Castro dei) in commendam for life; removing the said Donald [and Thady]. Mandate to collate and assign to Donatus Oconlyd, clerk, of the diocese of Cloyne, the perpetual vicarage of Rabarra in the said diocese, value 5 marks sterling, so long void that its collation has lapsed to the apostolic see, although Thomas Barra, priest, who is to be summoned and removed, has detained it for between sixteen and seventeen years since the said lapse, without any title. To the provost of Achonry (Akaden.), and Dermit Oynaghan and William Ocluan, canons of the same. Mandate to reserve to their gift, for collation to Matthew Ocallanan, priest, of the diocese of Achonry (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, in virtue of which he has been promoted to all, even priest's orders, and has had provision made to him by the said authority of the perpetual vicarage of Ymlirfada (fn. 11) in the said diocese, value 6 marks sterling, about which he is litigating without the Roman court, and of which he is not in possession), the archdeaconry of Achonry, value 3 marks sterling, which is to become void by the provision made by the pope to Thomas, elect of Achonry, of that church [above, p. 179], and by the consecration which is to be conferred on him, and, upon its becoming void, to collate and assign it to the said Matthew, and, moreover, to unite thereto, for as long as he shall hold it, the perpetual vicarage of Tomefyrd [in the said diocese] of Achonry, value 4 marks sterling, so long void that its collation has lapsed to the apostolic see, although Bernard Odarchan (?) clerk, who is to be summoned and removed, has detained it for some years without any title. He is hereby dispensed to receive the said archdeaconry and annexed vicarage, and to retain therewith for life the said vicarage of Ymlerfeda, or without them any two other incompatible or compatible benefices with or without cure, etc., and to resign or exchange them, etc. Vite etc. (In the margin: Maij.)
