Vatican Regesta, Vol. DCLXXIII.

Liber Decimus Quartus Bullarum Diversarum.

9 Sixtus IV.

1480.
16 Kal. Sept.
(17 Aug.)
St. Peter's, Rome.
(f. 280r.)
Monition, etc., as below. It was formerly set forth to the pope by Alexander Vaus, priest, of the diocese of Whiteherne, (fn. 1) M.A., that (after licence had been given to Thomas Vaus, then a continual commensal member of the household of William, [cardinal] bishop of Ostia, to resign all his benefices to the ordinaries, or to ecclesiastical dignitaries or cathedral canons of his choice, simply or for purpose of exchange, faculty being given to such ordinaries, etc. to carry out exchanges of such benefices with other persons, or make provision of such benefices as he resigned simply), he and the said Thomas resigned, for purpose of exchange, the perpetual vicarage of St. Nicholas's, Aberdin, (fn. 2) in the diocese of Aberdeen, and the precentorship (fn. 3) of Moray, respectively, to Martin Vaus, dean of Ross, chosen by Thomas in virtue of the said licence and faculty, and that the said dean carried out the exchange by the said papal authority, but that Alexander doubted whether the collation and provision thus made to him held good; wherefore the pope ordered provision to be made to him of the said precentorship, a non-major dignity, as being void and previously reserved under the pope's general reservation of benefices of members of the households of cardinals, because Thomas was a continual commensal member of the household of the said [cardinal] bishop and an acolyte of the pope and the apostolic see. It having been recently set forth to the pope by Alexander that possession of the said precentorship is being wrongfully detained by James Kynardi, (fn. 4) clerk, or other intruder, the pope hereby monishes the said James and any other intruder, and their aiders and abettors, etc., under pain of ipso facto sentences (expressed), to admit Alexander to possession within six days after these presents come to their knowledge, etc.; with mandate executory to the abbot of Der and the prior of Monimusk, in the diocese of Aberdeen, and the official of Moray, etc. Ad fut. rei mem. Pastoralis auctoritas. (In the margin: Aug.) (fn. 5) [4⅓ pp.]

10 Sixtus IV.

1480[–1].
3 Kal. Mar.
(27 Feb.)
St. Peter's, Rome.
(f. 406v.)
Monition, etc., as below. The recent petition of Edward, king of England, and the inhabitants ecclesiastical and secular of the islands of Guernesey, Gersey and Annerey (sic), and the islands adjacent thereto, in the diocese of Coutances, contained that divers pirates, etc. frequently attack the said islands, the church called St. Peter's Port in the said island of Guernesey, and other churches and monasteries in that and the said other islands, (fn. 6) the inhabitants of the said islands, and the merchants who go to and from the same, carrying off booty (including chalices and other ornaments for divine worship) and prisoners, and wounding and slaying, etc. The pope, therefore, hereby monishes and orders the said pirates, etc., and their abettors to abstain from such attacks, etc., under pain of eo ipso sentence of excommunication, anathema, eternal malediction, confiscation, etc.; with mandate to the archbishop of Canterbury, the bishop of Salisbury and the archpriest of the basilica of the Prince of the Apostles de Urbe, to publish these presents, and cause them to be executed, restitution to be made, etc., and faculty for the said executors to absolve those who make satisfaction, enjoining penance, etc. Moreover, in order that the pope's processes may come to the knowledge of all, he orders the papal letters containing them to be posted (fn. 7) on the doors of the said basilica and of the churches of Canterbury, London, Salisbury, Nantes, St. Pol-de-Léon, Tréguier, (fn. 8) and St. Peter's Port in the said island of Guernesey. Ad perp. rei mem. Ad bonorum tutelam. (In the margin: Mar.) [11½ pp.] Cf. Cal. Papal Lett., XI., p. 603.]
6 Kal. Feb.
(27 Jan.)

(f. 435v.)

Mandate, at the recent petition of Dominic Linche, layman, and Juliana alias Ciliana Dene, mulier, of the diocese of Annaghdown (containing that, dwelling in the same house, and not in ignorance that they were related in the simple second and in the second and third degrees of kindred, and in the simple third and simple fourth degrees of affinity, (fn. 9) they have often committed fornication and have had offspring), to absolve them from the crime of incest, enjoining penance, etc., and to dispense them to marry, notwithstanding the said impediments, decreeing past and future offspring legitimate.
