Mandate to collate and assign to John Oherlathe, priest, of the diocese of Cork, a canonry of Cork and the prebend called the prebend of Dischret [sic] More therein, and the perpetual vicarage of Magunde in the diocese of Cork, value 14 and 8 marks sterling, respectively, so long void that their collation has lapsed to the apostolic see, although Matthew Omathuna, priest, of the diocese of Cork, has detained the said canonry and prebend for some years, and although Cornelius Machc[a]llachain, priest, of the diocese of Cloyne (Clonen.), has detained the said vicarage for between one and two years, both of them without any title or right, summoning and removing them. To the abbot of St. John the Evangelist's, Gill Abbey alias St. Finbar's Cave (de Antro sancti Fimbarri), in the diocese of Cork, and Francis de Suno, a canon of Novara, and Nicholas Garilliati, a canon of Lausanne. (fn. 2) Mandate, as below. The recent petition of Matthew Ochonchuyr, priest, of the diocese of Cloyne (Clonen.), contained that the perpetual vicarage of Clondrohyd in the said diocese having become void because Reginald Oherlaly had held it for more than a year without being ordained priest and without dispensation, and having been so long void that its collation had lapsed to the archbishop of Cashel, the metropolitan, John archbishop of Cashel made collation and provision of it to the said Matthew, who now doubts whether they hold good. The pope, therefore, hereby orders the above three to collate and assign to him the said vicarage, value 16 marks sterling. Vite etc. [2½ pp.] |

To Edmund de Stantona, Malachy Omale and Dermit Maccusurlayd [sic], canons of Tuam. Mandate, as below. The pope has been informed by Rory Omayle, clerk, of the diocese of Tuam, that John Omerayn, (fn. 3) priest, made a bargain with John Oculean, perpetual vicar of Kylgacuayr in the said diocese, to the effect that if the said John Oculean would resign in favour of the said John Ymerean he would give him a certain number of cows, after which the said John Oculean resigned the said vicarage to the archbishop of Tuam, who in ignorance (as is believed) of the foregoing admitted the resignation, and made de facto collation of the said vicarage to the said John Omerayn, who under pretext thereof obtained possession and has detained it for between four and six years, thereby incurring sentences of excommunication etc. for simony. The pope, therefore, hereby orders the above three, if the said Rory (who was lately dispensed by papal authority on account of illegitimacy, as the son of a monk in priest's orders and an unmarried woman, to be promoted to all even holy and priest's orders, and hold a benefice with or without cure, and who in virtue thereof has had himself made a clerk, and who is in or about his twenty-fourth year), will accuse the said John Omerayn before them, to summon the latter, and if they find the foregoing to be true, to declare the said collation and provision null and void, and remove the said John Omerayn, and in that event to collate and assign the said vicarage, value 3 marks sterling, to the said Rory. Mandate, as below. The recent petition of Odo Ocolen, priest, of the diocese of Cloyne (Colen., recte Clonen.), contained that (after he had obtained by canonical collation a canonry of Cork and the prebend called [the prebend] of Dunboylg with cure therein), upon the successive voidance of the rectory called a benefice (fn. 5) of the parish church of St. Mary de Raona (?), (fn. 6) and of the perpetual vicarage of the same parish church of Dunboylg, in the said diocese, which are of the patronage of laymen, the patrons presented him to the bishop of Cork, who united the said rectory and vicarage to the said canonry and prebend for the lifetime only of the said Odo; that (after in virtue of the said union he had obtained possession of them), upon the voidance of the perpetual vicarage, called [the vicarage] of St. Lafanus, of the parish church of Nysimeneyl [sic], in the said diocese, also of the patronage of laymen, the patrons presented him to the said bishop, who instituted him to the said vicarage of St. Lafanus, in virtue of which presentation and institution he obtained possession and detained the said canonry and prebend for more than a month, without having obtained any dispensation for the purpose, against ‘Execrabilis,’ thereby contracting disability, and, having resigned the said canonry and prebend and vicarages, and without obtaining any rehabilitation, has detained the said rectory for between seven and eight years, and still detains it. Seeing that by the obtaining of the said vicarage of St. Lafanus the said union was dissolved, and that by such dissolution the said rectory is void, the pope, hereby rehabilitating the said Odo, orders the above three to collate and assign to him the said rectory called a benefice, value 16 marks sterling, howsoever void, provided that the said patrons consent, but before they proceed to the execution of these presents he is to resign it to them. Mandate to collate and assign to Edmund de Burgo, clerk, of the diocese of Cashel, a canonry of Cashel and the prebend called [the prebend] of Kylaryey and Cloynfluglas [sic], value 6 marks sterling, so long void that their collation has lapsed to the apostolic see, although Maurice Ohuruayn, clerk, has detamed them for between one and two years, without any title or right, on account of whose power the said Edmund cannot safely meet him in the city and diocese of Cashel, summoning and removing the said Maurice; whether they be still void by the death of John Yduchony extra R.c. or by the resignation of the said John, or of Thomas Cor or John Micuorinyla, to whom (quibus) provision was canonically made, or be void in any other way. To John Olasci, a canon of Raphoe. Mandate, as below. The recent petition of Dermit Ocleri, perpetual vicar of the parish church of St. Mary, Calla, in the diocese of Ossory, contained that on the voidance in a certain way [not expressed] of the said vicarage, which is of the patronage of laymen, James Boteller, layman, of the said diocese, the patron, presented the said Dermit to the bishop of Ossory, who instituted him, in virtue of which presentation and institution he obtained possession and still holds it. The said petition added that he doubts whether the said presentation and institution hold good, and the pope has learned that the said vicarage is still void. The pope has also learned that in his youth the said Dermit and a certain lord of his country went with certain men-at-arms to recover certain goods or for another purpose, and that the said Dermit went with them to a certain place in which fire and rapine were committed and two of the opposite party slain, although he was not present when they were slain; that afterwards when already in holy orders, he exercised for some time a certain royal office which is wont to be exercised by laymen, not taking cognizance, however, of causes of blood, but dealing only with secular matters; that he was present in arms and with soldiers in places where fires took place. although he was about two miles distant therefrom, and although such fires were not committed by his order or counsel; that sometimes for recreation's sake he has played at dice with friends or others, but without winning anything; that he has sometimes committed fornication with two unmarried women, by whom he has had offspring, still living; that he has sometimes been negligent in regard to the administration of the sacraments, and has often taken part in hunting with hounds and hawks. (fn. 7) At the said petition, therefore, the pope (absolving the said Dermit, who is penitent, from all sentences of excommunication, etc., as far only as regards the taking effect of these presents) orders the above canon to absolve him from the said crimes, enjoining a salutary penance, rehabilitate him, dispense him on account of any irregularity contracted, and dispense him to minister in his orders, even in the ministry of the altar, and, in the event of his so doing, to collate and assign to him the said vicarage, value 24 marks sterling, notwithstanding that he holds a canonry and prebend of Ossory, value 1 mark sterling. To the prior of the monastery of St. Mary, Ross, the precentor (cantori) of Ross, and Donald Onchante, a canon of the same. Mandate, as below. The recent petition of Donatus Yhedersgeoyll, priest, of the diocese of Ross, contained that after Paul II's renewal of his predecessors’ sentences of excommunication etc. against simoniacs, and after the present pope had ordered the perpetual vicar [not named] of the parish church of Cribeach, and Eneas Ohedersgeoyll, perpetual vicar of the parish church of St. Conaldus, Tulach, in the diocese of Ross, to be deprived, and provision of the said vicarages to be made to the said Donatus, he, fearing lay power, dared not have the pope's letters executed, and received from one of the said vicars a number of cows, and from the other a certain part of the fruits for two years under the name of a yearly pension, in order that he should not molest them in virtue of the said letters, but leave them in peaceful possession, thereby committing simony and incurring the said sentences etc.; and that subsequently, upon the said vicarage of Tulach becoming void by the deprivation of the said Eneas by Odo bishop of Ross, by a definitive sentence which was confirmed by John archbishop of Cashel, the metropolitan, the said bishop made de facto collation and provision of it by his ordinary authority to the said Donatus, without his having obtained any absolution from the said sentences, etc., under pretext of which he took possession, and has detained it for about two months, taking the fruits to a sum of four ducats. The said collation and provision being therefore without force, and the said vicarage being still void as above, the pope hereby orders the above three to absolve the said Donatus (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents to be promoted to all, even holy orders and receive and retain any mutually compatible benefices with and without cure, and resign them, etc., after which he had himself so promoted) from the said sentences etc., enjoining a salutary penance, rehabilitate him, and dispense him on account of any irregularity contracted, and, in the event of their so going, to collate and assign to him the said vicarage of Tulach, value 18 marks sterling; notwithstanding that he holds a canonry of Ross, but without a prebend. To the prior of the house of St. John Baptist by le Naenach in the diocese of Killaloe (Laonien.). Mandate, as below. The pope has learned that the rectory of Leatrach in the diocese of Killaloe, with cure and of the patronage of laymen, has been so long void, because Dermit Okynnedic, priest, held it for more than a year without having himself ordained priest, and without dispensation, that its collation has lapsed to the apostolic see, although the said Dermit has detained it for more than three years since the lapse of the said year, without any fresh title. And the recent petition of Thady Ocuyrhc, clerk, of the said diocese, contained that, when already a clerk, he was present, even in arms, at certain conflicts in which divers men were wounded to the effusion of blood, but without wounding or slaying anybody with his own hand. The pope, therefore, hereby orders the above three to absolve the said Thady (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and receive and retain a benefice even with cure, and who in virtue thereof has had himself made a clerk), from the said excess, enjoining a salutary penance, etc., and rehabilitate him, dispense him on account of irregularity, and dispense him to be promoted to all holy orders and minister alike in them and in the other orders which he has received, even in the ministry of the altar, and, moreover, in the event of their so doing, to summon the said Dermit, and erect the said rectory, value 8 marks sterling, provided that the chapter of Killaloe consent, into a prebend of that church, and to collate and assign a canonry thereof and such prebend to the said Thady. To the abbot of Holy Trinity, Ballintober (de Fonte sancti Patritii), in the diocese of Tuam. Mandate, as below. The pope has learned that the archdeaconry of Tuam has been so long void by the death of Thomas Joy extra R.c., and that the rectory of Dowinmor in the diocese of Tuam, of the patronage of laymen, has been so long void, because Malachy Ihugyn, then a secular clerk, entered the Friars Minors house of Galway (Gayluie) in the diocese of Annaghdown and made his profession as a friar of the said order, that their collation has lapsed to the apostolic see, although William Brannychym, clerk, has detained the said archdeaconry for between four and five [years], and Thady Ohanly, clerk, the said rectory for between fourteen and fifteen [years], [both] without any title or right. The pope, therefore, hereby orders the above abbot to collate and assign to Walter de Burgo, clerk, of the said diocese of Tuam (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be made a clerk and hold a benefice without cure, and to whom, after he had been made a clerk, provision was de facto made by the said authority of a canonry of Tuam), the said archdeaconry, which is a non-major dignity (even if it be elective and have cure) and the said rectory, value 10 and 20 marks sterling, respectively, summoning and removing the said William and Thady. To the abbot of St. Mary's, Abbeygormacan (de Via nova), in the diocese of Clonfert, and Cornelius Ochenay (fn. 8) and Donald Omulalay, canons of Clonfert. Mandate, as below. The pope has been informed by Maurice Oroesay (?), (fn. 9) a canon of Clonfert, that Odo Maccegayn, a canon of the same church, has carnally known a certain kinswoman of his and kept her as his concubine, and has had offspring by her, even after he had been monished by Matthew, bishop of Clonfert, to put her away, and that he has committed perjury and neglected the canonical hours. (fn. 10) And the said information added that the fruits etc. of the canonry and prebend of Clonfert which the said Maurice holds are insufficient for his maintenance, and that if the rectory of Dundayre in the diocese of Clonfert, with cure and of the patronage of laymen, which is held by the said Odo for life as united to his canonry and prebend of Clonfert, were separated therefrom and united to the canonry and prebend which the said Maurice holds, for his lifetime, he would be more able to maintain himself. The pope, therefore, hereby orders the above three, if the said Maurice will accuse the said Odo before them, to summon the latter and others concerned, and if they find the foregoing to be true, to dissolve the said union to the said Odo's canonry and prebend, and deprive him of the said rectory, and remove him therefrom, and in that event to unite it, value 16 marks sterling, to the said Maurice's canonry and prebend, value 3 marks sterling, for his lifetime.
