To the abbot of the monastery of Holy Trinity, Lochque, and the prior of the monastery, wont to be governed by a prior, of St. Mary, Inchmacnerin (de Insula Macnery), in the diocese of Elphin, and Donald Offlannagan, a canon of Elphin. Mandate, as below. The pope has been informed by Charles Macchabrenin, clerk, of the diocese of Elphin, that Cornelius, also Maccabrehyne (?), (fn. 2) perpetual vicar of the parish church of Cyllmacallan in the said diocese, has several times committed simony, has dilapidated the movable and immovable goods of the said vicarage, has often wittingly celebrated in presence of a certain man under sentence of the greater excommunication, and has violated an interdict promulgated by the metropolitan, and that, inasmuch as he is blind, he cannot celebrate masses. The pope, therefore, hereby orders the above three, if the said Charles will accuse the said Cornelius before them, to summon the latter, and if they find the aforesaid to be true, or two of them sufficient for the purpose, to deprive and remove him, and in that event to collate and assign the said vicarage, yearly value not exceeding 10 marks sterling, to the said Charles. Erection, etc., as below. The recent petition of John Fresel, priest, of the diocese of St. Andrews, M.A., contained that upon a dispute arising between him and William, archbishop of St. Andrews, about the parish church of the place of Leswade in the said diocese, or the canonry and prebend erected therefrom in the church of St. Salvator at St. Andrews, which the said archbishop alleged had formerly been united and appropriated by papal authority, on their becoming void, to the archiepiscopal mensa of St. Andrews in perpetuity, and of which the said John alleged that provision had been ordered to be made to him by the said authority, the pope committed the cause, although not lawfully devolved to the Roman court, at the instance of the said archbishop to Gundisalvus, now [bishop] elect of Oviedo (Oveten.), then a papal chaplain and auditor; that, after the said Gundisalvus, then an auditor, had proceeded to a number of acts, upon the cessation of his office of auditor by the provision made of him by the pope to the church of Oviedo, the pope committed the said cause to Master William de Pereriis, also a papal chaplain and auditor, and then, revoking it, to Mark, bishop of Palestrina and John, bishop of Albano, who sub-committed it to Lionel, bishop of Trau (Tragurien.), resident in the Roman court, who is said to have proceeded to a number of acts, short of a conclusion; that, whilst the said suit has been pending, the said archbishop has for the sake of peace and concord given it up to the pope, and all right belonging to him in the said church or the canonry and prebend erected therefrom, by his proctor Master Peter Altissen, a scriptor of apostolic letters and a member of the pope's household, and has consented to the dissolution of the said union; and that the pope has admitted the said cession. The said petition added that if the church of the Holy and Indivisible Trinity and St. Mary the Virgin within the bounds of the parish church de Lestukyk (fn. 3) [sic] in the said diocese (which James, king of Scots, has caused to be sumptuously built at his own expense, and which he has endowed with estates and possessions (fn. 4) ) were erected into a collegiate church, with a deanery, a principal dignity, for a dean, and a convenient number of canons and prebends for as many canons, such dean and canons forming the chapter, divine worship would be greatly increased therein, etc., and the desires of the said king would be satisfied. The pope, therefore, at the petition of the said king and of the said John (who is also a licentiate in decrees, and was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and receive a benefice even with cure, and who was subsequently dispensed, after he had been made a clerk, to receive and retain for life any compatible benefices with and without cure, even if canonaries and prebends, dignities, etc., and to resign them, etc.) hereby, calling up the said cause to himself, extinguishing the said suit, dissolving the said union and appropriation, suppressing the said erection, and restoring the said church of Leswade to the state in which it was before it was united, etc., to the said archiepiscopal mensa, and before there were erected from it the said canonry and prebend (which were, in accordance with their foundation, to be collated only to a doctor or a licentiate in canon and civil law, or in one of them), erects to the praise of Almighty God and the same Holy Trinity and St. Mary the Virgin the said church of Holy Trinity and St. Mary into a collegial church, and institutes therein a deanery, a principal dignity, and a decent number of canons, in accordance with the ordinance to be made by the below-written commissaries, and at the will of the said king, with a common mensa, burse, chest (archa), seal, chapter and other collegial insignia, and makes divers ordinances regarding the presentation to the deanery (after this first turn) and to the canonries and prebends by the said king and his successors, the institution to the deanery by the pope, and to the canonries and prebends by the dean, etc., the union and appropriation by the pope of the said church of Leswade to the said deanery (the yearly value of which and of the said church of Leswade does not exceed 50l. sterling), the exemption of the dean from all jurisdiction, etc., of the archbishop of St. Andrews, and his immediate subjection to the pope and the apostolic see; with collation and provision of the deanery to the said John, and mandate executory to the abbots of Holyrood near Edinburgh [sic] and Nyubotal, in the said diocese, and John Baptista de Ferrariis, a canon of Modena, to induct him, etc. Ad perp. rei mem. To the prior of the monastery of Kylmornis[i]nna, wont to be governed by a prior, in the diocese of Elphin, and Cornelius Osgyngin and Donald Offlanygan, canons of Elphin. Mandate, as below. The recent petition of John Macgillaroyd, priest, of the diocese of Elphin, contained that formerly, on its being set forth to the apostolic see on behalf of William Ycellayd, prior or preceptor of the conventual monastery or house (fn. 5) of St. John Baptist, Reindun, of the Hospital of St. John of Jerusalem, that the fruits, etc., of the said monastery or house (fn. 6) were insufficient for the maintenance of the convent thereof, the said William, under pretext, as is alleged, of certain papal letters, obtained the union and appropriation in perpetuity to the said priory of the then void and perpetual vicarage of the parish church of Achlycgmaynagan in the said diocese, and has, without any other title or right, wrongfully detained possession of it for some years; the said petition adding also that the said fruits, etc., were then and are now sufficient for the maintenance of the said convent, at least for those resident in the said monastery. The pope has also been informed by the said John that Bernard Onel, perpetual vicar of the parish church of Cyllargualand in the said diocese, has alienated the movable goods of the said vicarage, and has committed perjury. He therefore, seeing that in accordance with the foregoing the said letters are to be deemed surreptitious, that the said vicarage of Achlycgmaynagan is still void, and that the said Bernard is unworthy of the said vicarage of Cyllargualand, hereby orders the above three, if the said John will accuse the said Bernard before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and if, after summoning the said prior and convent, they find the foregoing to be true, to declare that the said letters were and are surreptitious, and that the union made under pretext thereof was and is null and void, and moreover, in the event of their making the said deprivation, removal, and declaration, to collate and assign to the said John the said vicarage of Achlicgmaynagan, and to unite and appropriate to it, for as long as he shall hold it, the said vicarage of Cyllargualand, the yearly values of which do not exceed 8 and 3 marks sterling, respectively. To the priors of the monasteries of SS. Peter and Paul de Innocentia juxta Athluayn and Kyllmornasynna, wont to be governed by priors, in the diocese of Elphin, and Cornelius Osgyngyn, a canon of Elphin. Mandate, as below. The pope has been informed by Donald Oflannagan alias Maghigan, a canon of Elphin, that Odo Omokan, provost of the church of Elphin, has led the life of a fornicator, has dilapidated the precious movables and the immovables of the said provostship, (fn. 7) and, when under sentence of excommunication, has ministered in divine offices in contempt of the Keys, thereby contracting irregularity. The pope, therefore, hereby orders the above three, if the said Donald (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a bishop, of the Order of Friars Preachers and in priest's orders, and a married woman, (fn. 8) to be made a clerk and receive and retain a canonry and prebend of the said church, after which he was made a clerk, and obtained by collation of the ordinary such canonry and prebend, yearly value not exceeding 3 marks sterling, which he still holds, but without receiving any fruits therefrom), will accuse the said Odo before them, to summon the latter, and if they find the foregoing to be true, or two of them sufficient for the purpose, to deprive and remove him from the said provostship, and in that event to collate and assign it, a non-major, non-elective dignity with cure, yearly value not exceeding 12 marks, to the said Donald. To the abbot of St. Michael's, Mayo (de Magio), in the diocese of Tuam, and Dermit Oscara and John Ochallaid, canons of Tuam. Mandate, as below. The pope has been informed by William de Burgo, a canon of the united churches of Tuam and Annaghdown, that Edmund de Stantona, a canon of the monastery of Holy Trinity, Ballintober (de Fonte sancti Patritii), O.S.A., in the diocese of Tuam, who holds in commendam by papal grant and dispensation the rectory of the parish church of Roba [i]n Kera in the said diocese, of lay patronage, (fn. 9) has dilapidated, dissipated, and uselessly consumed the immovable goods thereof, allowed its buildings to fall into ruin, has committed simony, and has neglected to reside, celebrate, and preach in the said church. He therefore orders the above three, if the said William (who alleges that he was received as a canon of the said churches of Tuam and Annaghdown by William, archbishop of Tuam, before he had been consecrated and received the pallium, and that the said Edmund behaves as sole patron, and that the abbot and convent of the monastery of Mayo (de Magio), of the said Order and diocese, behave as patrons of the said rectory (fn. 10) ), will accuse the said Edmund before them, to summon the latter, and if they find the foregoing to be true, or one of them sufficient for the purpose, to deprive the said Edmund of the said commenda, and remove him from the said rectory, and, in the event of their so doing, to collate and assign the said rectory, yearly value not exceeding 8 marks sterling, to the said William. The pope has been informed by Rory Maccorles (?), priest, of the diocese of Elphin, that Donald Offyagna and Bernard Offlannagan, respectively perpetual vicars of the parish churches of Gorallo (?) and Baslic in the said diocese, have committed, viz. Donald simony and perjury, and both of them notorious fornication, that they have contracted irregularity, have dilapidated, dissipated and uselessly consumed the movable and immovable goods of the said vicarages, and that the said Bernard does not reside in the said church of Baslic, and does not celebrate in person or cause to be celebrated by another. The pope, therefore, hereby orders the above three, if the said Rory will accuse the said Donald and Bernard before them, to summon them, and if they find the foregoing to be true, or two of them sufficient for the purpose, to deprive and remove them, and in that event to collate and assign to the said Rory the said vicarage of Baslic, and to unite and appropriate thereto, for as long as he shall hold it, the said vicarage of Garallo [sic], the yearly value of each not exceeding 4 marks sterling. To the prior of the monastery of Kilmornasyna, wont to be governed by a prior, in the diocese of Elphin, the archdeacon of Elphin, and Donald Offlannagan, a canon of the same. Mandate, as below. The pope has learned that Ludovicus Omulynnan, a canon of the monastery of St. Mary, Locsydy, O.S.A., in the diocese of Meath, cannot with a good conscience remain there on account of the poverty (carestiam) of his canonical portion and the slenderness (tenuitatem) of the fruits of the said monastery, and on account of its distance from the place of his origin, and for other reasons, and desires to migrate (transire) to the monastery of St. Mary, Cluaintuasceartanasina, of Arrouaise (Aragacen.), of the said order, in the diocese of Elphin. The pope has also been informed by the said Ludovicus that Carbry Machigan, perpetual vicar of the parish church of Kilglas, in the said diocese of Elphin, has committed simony and notorious fornication, has turned to his evil uses the goods of the said vicarage, and, being under sentence of excommunication and publicly proclaimed as such, has celebrated divine offices in contempt of the Keys, thereby contracting irregularity. The pope, therefore, hereby orders the above three to transfer the said Lewis to the said monastery of Clua[i]ntuascear[ta]nasyna and cause him to be received as a canon thereof, etc., and moreover, if he will accuse the said Carbry before them, to summon the latter, and if they find the foregoing, or two of them sufficient for the purpose, to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, yearly value not exceeding 3 marks sterling, to the said Ludovicus, notwithstanding his illegitimacy, as the son of a canon of the said Order, in priest's orders, and an unmarried woman, on account of which the pope specially dispenses him to receive the said vicarage and retain it for life, even with his canonical portion of the said monastery of Clua[i]ntuasceartanasyna. Mandate to collate and assign to Donatus Makcly, a canon of Elphin (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents related in the fourth degree of kindred, to be made a clerk, and to be received as a canon of the said church, after which he was made a clerk and was received by the said authority as a canon of the said church, from which he has received no fruits), a canonry of Elphin anew (de novo) and the prebend called the rectory of the tenement of St. Bearach de Cluincaripi alias de Cluancarpi, yearly value not exceeding 8 marks sterling, so long void that there is no certain knowledge of the way of its voidance, and that by the Lateran statutes its collation has lapsed to the apostolic see, although Malachy, also [named] Makcly, clerk, of the diocese of Elphin, has detained possession of the said prebend for some years without any title; summoning and removing the said Malachy. To Richard Harington, (fn. 11) perpetual vicar of the parish church de Helbangefeld [sic] in the diocese of Ely. Dispensation, etc., as below. His recent petition contained that on the voidance of the perpetual vicarage of the parish church of Heslyngefeld in the diocese of Ely, the present bishop of Ely made collation and provision thereof to him, who was holding the perpetual vicarage of the parish church of Laxton in the diocese of York, and who believed that he had been sufficiently dispensed by papal authority to hold two benefices with cure or otherwise incompatible, seeing that he had previously written to the Roman court, and had sent money for the expedition of the letters of such dispensation, in virtue of which collation and provision he obtained peaceful possession of the said vicarage of Heslyngefeld, and held it and that of Laxton together for about a year, and, resigning it [sc. Laxton], held the chantry of St. Saviour founded in the church of York for the soul of the late Richard Andrew, dean of that church, together with the said vicarage of Heslyngefeld for about another year, without other dispensation, against ‘Execrabilis,’ and still does so, taking in good faith their fruits, although few, believing that he had obtained the said dispensation, whereas, through the negligence of the person to whom he had committed the matter, (fn. 12) it had not been obtained. The pope has learned that the perpetual vicarage and the rectory (which is of lay patronage) of the parish church de Arcierta (?) in the diocese of Tuam, which the late Malachy Ykellay, rector and perpetual vicar of the said church, held by papal dispensation, are void by the death of the said Malachy extra R.c., and have been so long void that by the Lateran statutes their collation has lapsed to the apostolic see, although John Ornoli [sic], clerk, of the said diocese, has detained possession of the said vicarage for between two and three years without any canonical title. The pope, therefore, at the recent petition of Odo Ytuayd, priest, of the said diocese (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy and priest's orders and hold a benefice even with cure, after which he was so promoted), hereby orders the above three (seeing that, as the said Odo alleges, he has no hope of obtaining justice in the city and diocese of Tuam), to summon the said John and others concerned, and if they find the said vicarage and rectory to be void as above or in any other way, to collate and assign to the said Odo the said vicarage, and also, summoning those interested, to unite and appropriate the said rectory to the said vicarage, yearly values not exceeding 4 and 2 marks sterling, respectively, for as long as he shall hold the latter.
