To the abbot of the monastery of St. Mary, Abbeyleix (de Lege dei), in the diocese of Leighlin, and the prior of the monastery of St. Mary, Monaincha (de Insula viventium), wont to be governed by a prior, in the diocese of Killaloe (Laon[i]en.), and William Odyayn, a canon of Killaloe. Mandate, as below. The pope has been informed by John Ocerwall, clerk, of the diocese of Killaloe, that Donatus Ohaegayn, rector of the parish church of Kynethy alias Kynealarga, called [a church] in lay fee, (fn. 2) in the said diocese, has committed perjury, of which he has been judicially convicted, and has openly kept a concubine in his house, by whom he has had offspring, and still keeps her. And the recent petition of the said John contained that, a suit being pending by papal delegation before the above three between Matthew Mackarry alias Obeolayn, priest, and Rory Ocerwall, clerk, of the said diocese, about the rectory of the parish church of Birra in the same diocese, of lay patronage, it is alleged that neither of them has a right in or to the said rectory. The said petition adding a prayer for the erection of a canonry in the church of Killaloe for the life of the said John, and of the said rectory of Kinealarga, which also is of lay patronage, into a simple prebend of the same, and also for the union and appropriation of the said rectory of Birra to such erected canonry and prebend, also for the life of the said John; and the said John adding that he is of noble birth by both parents, and that supernumerary canons have been wont to be received by both papal and ordinary authority in the said church of Killaloe, and that in the said church of Kynethy there are two rectories and one vicarage, the pope hereby orders the above three, if the said John will accuse the said Donatus before them, to summon the latter, and, if they find the foregoing to be true, to deprive and remove him from the said rectory of Kynealarga, in lay fee, and in that event, and if by the result of the said suit they find that neither of the said Matthew and Rory has any right in or to the said rectory of Birra, and if the patrons of the said rectories and others interested consent, to erect a canonry, and for its simple prebend the said rectory of Kynealarga, in lay fee, in the said church of Killaloe, for the lifetime only of the said John, and collate and assign them to him, yearly value not exceeding 12 marks sterling, and to unite etc., thereto, for as long only as he shall hold them, the said rectory of Birra, yearly value not exceeding 50 marks.
