Mandate to receive from John Odubyun, priest, of the diocese of Derry (who has resigned in the Roman court before John Treronit, clerk, of the diocese of [St. Pol-de-] Léon (Leonien. [sic]), notary public, and witnesses, the perpetual vicarage of the place of Domprackyidri [sic] in the diocese of Derry, and to whom the pope lately granted provision of the deanery (fn. 3) of Derry, a major dignity, yearly value not exceeding 40 marks sterling), the said resignation, by papal authority, if they find it lawful, and if it has not been duly made, and to admit the same, and thereupon to collate and assign the said vicarage, yearly value not exceeding 4 marks sterling, to the same John. As soon, however, as he has obtained peaceful possession of the said deanery, (fn. 4) in virtue of the other letters which are to be drawn up, he is to resign the said vicarage, or give up all right in or to it. To the abbots of Kelso (de Calco) in the diocese of St. Andrews and Inchasfora [sic] in the diocese of Dunblane, and the provost of Corstorphin in the diocese of St. Andrews. Mandate, as below. Upon a canonry of the church of St. Salvator at St. Andrews and the prebend called the prebend of Lesuaide therein, which Robert, [now] bishop of Glasgow, formerly bishop of Aberdeen, was holding at the time of his promotion by Sixtus IV to the latter church, becoming void by the lapse of the canonical time for the consecration of bishops, the said pope, upon its being alleged to him by John Fresel, priest, of the diocese of St. Andrews, licentiate in decrees, that William, archbishop of St. Andrews, had detained possession of the said canonry and prebend for between two and three years, without any title or right, and was still detaining them, ordered certain judges in those parts to summon the said archbishop and others concerned, and to collate and assign the said canonry and prebend, whether void as above, or void in any other way, to the said John. The recent petition of the latter to the present pope contained that no mention was made in the letters of pope Sixtus that when the said canonry and prebend were expected to become void by the said promotion and impending consecration, pope Sixtus granted provision of the same when they should become void as above, or in any other way, even if they were already void, to the said John; that, before the papal letters of grant had been drawn up, the said John gave up the said grant to the said pope, who admitted it; that, at the instance of the said archbishop, pope Sixtus, likewise before the date of the said letters, united the said canonry and prebend, when they became void, even if they were already void, to the archiepiscopal mensa of St. Andrews in perpetuity, so that the said archbishop could take possession of them by his own authority, etc.; that the said John failed to cause the said archbishop to be summoned before judges within six months from the date of the said letters granted to the said John, and the cause to be determined within a year, as he ought to have done in accordance with an ordinance of the said pope Sixtus, (fn. 5) and that a year and some months have now elapsed since the said date, so that it is alleged that the said letters cannot avail him, and that he has incurred the penalties contained in the said ordinance, and that the truth is that the said letters granted to the said archbishop (in which there is no mention that the said pope Sixtus, when, at the petition of the said Robert, and before their said voidance, he erected the said canonry and prebend out of the parish church of St. Mary, Lesuaide, in the said diocese, which the said Robert, then of lower rank, (fn. 6) was holding, ordained that their holder for the time being should be bound to pay 5 marks a year of the money of Scotland from the fruits, etc., of the said church of St. Mary, then erected into a prebend, to the common fund (fn. 7) of the daily distributions of the said church of St. Salvator, and that no one should be able to hold the said canonry and prebend when in future they became void, otherwise than by the resignation of the said Robert, simply or for purpose of exchange, unless he were a doctor or licentiate in one of the laws) are surreptitious and invalid, and that the said canonry and prebend are really still void as above, although, whilst the letters of the said union have been lying in the papal Camera, the said archbishop has for between three and five years wrongfully detained possession of the said canonry and prebend, as he still does, as being united to the said mensa, under pretext of the said letters of union, which letters he has never had nor seen, to the injury of the said Camera, to which he ought to pay for their expedition an annate at the rate of 40l. sterling. The pope, therefore, at the petition of the said John (who alleges that the said archbishop ought to be deprived, that he has lodged at the apostolic see an extra-judicial appeal from the said archbishop's detention, and that he has intimated it to the said archbishop; and who has been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be made a clerk, and be promoted to all, even priest's orders, and receive and retain for life, first, one benefice with cure, and afterwards, any benefices with and without cure, compatible with one another and with the said benefice, and along with them any two benefices with cure or otherwise incompatible, even if such compatible benefices be canonries and prebends, and even if they and such incompatible benefices be dignities, etc., even major dignities, etc., and to resign them all, etc.), hereby orders the above three to summon the said archbishop, and others concerned, hear, determine, and decide the said appeal cause and that of the principal matter, decree that the said letters of pope Sixtus granted to the said John shall hold good in future and avail him, and proceed to the complete execution thereof, as if it had been stated in them that the said archbishop had wrongfully detained and was still detaining possession of the said canonry and prebend, under pretext of the said union and of the said letters granted to him, which he had not expedited and which were surreptitious, as above, and as if they and the said statements had been directed to the said three from the beginning, and as if the letters of union granted to the said archbishop, which are in the said Camera, had not emanated from the said pope; even if the said canonry and prebend, to which pertains the cure of souls of the parishioners of the said sometime church of St. Mary, and the fruits, etc., of which do not exceed a yearly value of 50l. sterling, be still void as above, or by the resignation of the said bishop Robert, or be void in any other way, etc. Litterarum sciencia, vite etc. [6⅓ pp. See Cal. To the abbot of Fermoy (de Castro dei), and the priors of Bridgetown (Ville pontis) and St. Thomas by Buttevant (iuxta Butoniam), in the diocese of Cloyne (Clonen.). Mandate, as below. After Sixtus IV's reservation of all major dignities in cathedral churches, void and to become void, the deanery of Cloyne, a major dignity, became void by the deprivation of Philip Roche by the late John, archbishop of Cashel, the metropolitan, during a visitation of his province; and the present pope declared that dignities and other benefices void at the death of his said predecessor, and by him reserved, remained reserved. The pope, therefore, having learned that the said deanery is still void, as above, and that the perpetual vicarage of the parish church of Connach alias Tempukoayn [sic] in the said diocese is also void, and has been void so long that its collation has by the Lateran statutes lapsed to the apostolic see, although Richard Byketh, priest, has detained possession for a certain time, without any title or right; and the recent petition of Maurice Odahyll (fn. 8) containing that if the said vicarage were united to the said deanery for his lifetime it would be greatly to his benefit, the pope hereby orders the above three to summon the said Richard and others concerned, and if they find the said deanery and vicarage, yearly values not exceeding 25 and 5 marks sterling, respectively, to be void as above, or the deanery by the free resignation of the said Philip, or of James [son] of Philip de Geraldinis, or by the death of Gerald de Geraldinis, or void in any other way, to unite to it the said vicarage for the lifetime only of the said Maurice, and to collate and assign to him the said deanery and vicarage thus annexed, removing the said Richard and any other unlawful detainer; notwithstanding certain surreptitious letters obtained by Nicholas Sprinscos [sic], priest, etc. Vite etc. [6¼ pp.] |

To the abbot of Monasterevan (de Rossevalle) in the diocese of Kildare (Daren.), the dean of Kildare, and James Obecayn, a canon of the same. Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Baleycheyn in the diocese of Kildare is void by the death of Rory Oclymassa extra R.c. He has also been informed by Gilbert Omayna, clerk, of the said diocese, that Edmund Oflayn, perpetual vicar of the parish church of Carbria in the said diocese, has dilapidated and alienated the precious moveables of the said vicarage, has committed perjury and simony, and is a notorious fornicator. And the recent petition of the said Gilbert contained that, in self-defence only, he has laid violent hands on a certain priest, to the effusion of blood, thereby incurring sentence of excommunication, but was not guilty otherwise than as aforesaid, and regrets the foregoing, and that if the said vicarage of Baleycheyn were erected into a simple prebend of Kildare, and if the said vicarage of Carbria were united thereto for as long as he holds such erected prebend, if collated to him, it would benefit both the said church of Kildare and himself. At the said petition, therefore, the pope hereby orders the above three to absolve the said Gilbert (who alleges that he has been made a clerk, notwithstanding his illegitimacy as the son of a priest and an unmarried woman) from the said sentence, enjoining a salutary penance, dispense him on account of irregularity contracted, and dispense him to be promoted to all, even holy orders, and receive and retain a canonry and the said prebend to be erected and vicarage to be united, and rehabilitate him, and, in the event of their so doing, to make provision to him of a canonry of the said church of Kildare, erect the said vicarage of Baleycheyn for the lifetime of the said Gilbert into a simple prebend thereof, with consent of the chapter, and, when thus erected, to collate and assign it to him, and moreover, if he will accuse the said Edmund before them, to summon the latter, and if they find the foregoing or enough thereof to be true, to deprive and remove him, and in that event to unite the said vicarage of Carbria to that of Baleycheyn, yearly values not exceeding 30 and 3 marks sterling, respectively, for as long as Gilbert shall hold the latter. The pope has learned that the rectory of the parish church of St. Fintan, Duruuy (?), and that of St. Mogessus [sic], Kylermy, which latter is of lay patronage, in the diocese of Ossory, have been so long void that their collation has by the Lateran statutes lapsed to the apostolic see, although Eugene Offillan and Donatus Omulcaly, priests, have respectively detained possession of them for some years without any right. And the recent petition of Cornelius Ybergyn, clerk, of the said diocese, contained that the rectory of St. Mugessus [sic], Acscollyn [sic], being void, and having been void so long that by the Lateran statutes its collation had lapsed to the apostolic see, John, bishop of Ossory, made him collation and provision thereof by his ordinary authority, under pretext of which he took possession of it, and detained it for between three and five months, taking but few fruits therefrom, thereby incurring disability, and that he afterwards resigned it. The said petition adding that if a canonry were erected in the church of Ossory, and the said rectory of Killermy erected into a simple prebend for the lifetime of the said Cornelius, and if to them were united the said rectory of Durmuiy [sic], likewise for his lifetime, and if provision were made to him of such canonry and prebend, it would be to his benefit and that of the church of Ossory, the pope hereby rehabilitates him, and orders the above three to summon the said Eugene and Donatus, and if they find the facts to be as stated, to erect, with consent of the chapter, and others concerned, a canonry in the church of Ossory, erect the said church of Ky[l]ermy into its prebend for the life of the said Cornelius, and unite to them the said rectory of Drumuy (?), (fn. 10) yearly values not exceeding 8 and 12 marks sterling, respectively, likewise for his lifetime, and, in the event of their so doing, to collate and assign the same to him, removing the said Eugene and Donatus, etc. Sedes apostolica, pia mater. The pope has learned that the rectory of the parish church of St. Mary, Ratou, in the said diocese, of lay patronage, has been so long void that there is no knowledge of the true way of its voidance, and that its collation has by the Lateran statutes lapsed to the apostolic see, although Malachy Odolayn, priest, sub-collector of the Camera in those parts, has detained possession for some time without any title or right. The pope, therefore, hereby orders the above three to summon the said Malachy, and, if they find the said rectory to be void in any way, and provided that it has lapsed, to erect it, with consent of the chapter of Ossory, into a simple prebend without cure (fn. 11) in that church, separate the cure of souls from the said rectory for the lifetime only of the below-named William, and apply it to the perpetual vicarage of the said parish church, and to collate and assign a canonry of Ossory and such erected prebend, their yearly value not exceeding 30 marks sterling, to William Macgollafadrig, clerk, of the diocese of Ossory, who, notwithstanding his illegitimacy as the son of an unmarried man and a ravished unmarried woman, (fn. 12) related in the third degree of kindred, has had himself made a clerk by authority of the ordinary; removing the said Malachy and any other unlawful detainer. To the dean and the archdeacon of Kildare (Daren.), and James Obecayn, a canon of the same. Mandate, as below. The recent petition of John Omaena, priest, of the diocese of Kildare (Daren.), contained that on the voidance of the rectory of the parish church of Gesselle in the said diocese, of lay patronage, by the death of Thady Omayna extra R.c., the patrons presented Donatus Okellayn, clerk, of the said diocese, to the then bishop, who instituted him; that after the said Donatus had obtained possession of the said rectory in virtue of such presentation and institution, and after he had held it for about a year, it became void by his resignation to the said bishop, whereupon the patrons presented the said John (who had been dispensed by papal authority on account of illegitimacy, as the son of the said Thady, who was a priest, and an unmarried woman, to be promoted to all, even holy orders and [receive and] retain a benefice even with cure, after which he was made a clerk and was so promoted) to the same bishop, who instituted him, in virtue of which presentation and institution he obtained possession, and still holds it. The said petition added that he fears lest the said presentation and institution do not hold good, especially because after the death of the said Thady, his father, he resolved to have the said rectory, if he could canonically obtain it, and because the said defect of birth standing in the way, and also the fact that no mediate person had intervened, he did his best to get provision made to the said Donatus of the said rectory, (fn. 13) which is, as the pope has learned, still void as above. The pope has also been informed by the said John that Maurice Ohycalayn, prior of the priory of St. Mary, Killehe, O.S.A., in the said diocese, has alienated and dilapidated divers immovable goods of the said monastery, allowed its buildings to fall into ruin, committed theft, and turned its fruits, etc., to evil uses. The pope, therefore, at the petition of the said John, who alleges that the yearly values of the said priory and rectory do not exceed 24 and 30 marks sterling, respectively, hereby orders the above three, if he will accuse the said Maurice before them, to summon the latter, and if they find the foregoing or enough thereof to be true, to deprive him of the said priory, and remove him, and in that event to receive the said Maurice (recte John) as a canon in the said monastery, give him the regular habit thereof, and receive his profession as a canon of the same, and thereupon to collate and assign to him the said priory, which is conventual, and to unite thereto the said rectory for as long as he shall hold the said priory. The pope recently ordered David Lythoun, a canon of Aberdeen, to be received as a canon [sic] in the monastery of St. Thomas of Canterbury, de Abirbrothot [sic], O.S.B., in the diocese of St. Andrews, the habit thereof to be given to him, and his profession to be received. Seeing that a canonry of Aberdeen and the prebend of Murthlayk therein, yearly value not exceeding 20l. sterling, are therefore about to become void, the pope reserves them to his gift, for collation to the above Alexander; with mandate hereby to the dean of St. Valery in the diocese of Sion, the provost of Holy Trinity near Edinburgh, in the diocese of St. Andrews, (fn. 14) and the chancellor of Moray, to collate and assign them to him on their becoming void. The pope has been informed by Donatus Ocombay, priest, of the diocese of Cloyne, that Charles alias Keanfela [sic] Otuoma, perpetual vicar of the parish churches of Mathehy and Clonhyrinhy in the said diocese, has committed perjury and fornication, and has dilapidated and alienated divers immovable goods of the said vicarages. And the recent petition of the said Donatus contained that after he had been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents. to be promoted to all, even holy orders and receive and retain a benefice even with cure, and after he had been so promoted, he obtained by the same authority the perpetual vicarage of the parish church of Drissoan (?) in the diocese of Ardfert, and obtained the union thereto for his lifetime of the perpetual vicarage of the parish church of Kachlilin in the said diocese of Cloyne, by the same authority; that, having resigned the said vicarages, he obtained by authority of the ordinary, and without any other dispensation on account of the said defect, collation of the said vicarages of Mathehy and Clonhyrynhy, detained them for about three years, taking their fruits, and afterwards resigned them. The pope, therefore, hereby orders the above canon, if the said Donatus will accuse the said Charles before him, to summon the latter and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event to unite the said vicarages of Mathehy and Clonhyrinhy, yearly values not exceeding 6 and 4 marks sterling, respectively, for as long only as the said Donatus shall hold them, and moreover to collate and assign them to him. To the abbot of St. Mary's, Hueyny, in the diocese of Emly, and Charles Macbreyn and William Okayll, canons of Emly. Mandate, as below. The pope has been informed by Philip Okennedyg, priest, of the diocese of Killaloe (Laonien.), that Lucanus Ochogury, precentor of Killaloe, has carnally known a certain kinswoman related to him in the third degree of kindred or affinity, and has openly kept her as his concubine, and that Cornelius Obreyn, perpetual vicar of the parish church of Lisbon(n)y (fn. 15) in the diocese of Killaloe, is a notorious fornicator, and has committed simony. At the petition of the said Philip, who alleges that he is of noble birth by both parents, the pope hereby orders the above three, if he will accuse the said Lucanus and Cornelius before them, to summon them, and if they find the foregoing to be true, to deprive and remove them from the said precentorship and vicarage, respectively, and in that event to collate and assign to the said Philip the said precentorship, which is a non-major elective dignity with cure, and also the said vicarage, yearly values not exceeding 12 and 8 marks sterling, respectively, and moreover, summoning those concerned, to unite to the said vicarage, for as long as the said Philip shall hold it, the rectory, if he obtain it, of the parish church of Disserthethyny alias Balygybun in the said diocese, value not exceeding 5 marks, provision of which has been made to him by papal authority, but of which he has not yet got peaceable possession; notwithstanding any indult granted by papal authority to the bishop and chapter of Killaloe, and to the prior and convent of the priory of Chonnayl. O.S.A., in the diocese of Kildare (Daren.), to whom the presentation to the said vicarage by ancient custom belongs, etc. The pope further dispenses the said Philip to receive and retain for life the said precentorship and vicarage and its said annex, and with one of them any one benefice with cure or otherwise incompatible, and without them any two such benefices, even if parish churches, etc., and to resign them, etc., and also dispenses him not to be bound for life to reside in person in the church of Killaloe and the said vicarage of Lysbonni, whilst having them served by fit substitutes. The recent petition of John Ygingyn [sic], clerk, of the diocese of Ossory, contained that on the voidance of the perpetual vicarage of the parish church of St. Mary, Radoyny, in the said diocese, of lay patronage, by the deprivation of Dermit Ohely, priest, made by John, bishop of Ossory, the said bishop, with consent of the patron, made collation and provision of it to [the said] John Odygyn, clerk, of the said diocese, and that in virtue thereof the said John Odygyn obtained possession, and still holds it. The said petition added that the said John Odygyn fears lest the said collation and provision do not hold good, and lest the said vicarage be still void, as above; and also added that the rectory [of the parish church] of St. Nicholas ad [sic] Aglanyssincol, in the said diocese, has been so long void that by the Lateran statues its collation has lapsed to the apostolic see, although Eugene Ofilan, priest, has detained possession for some time, without any title or right. At the petition, therefore, of the said John Vgi(n)gin [sic] (who alleges that he has been dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest and an unmarried woman, to be made a clerk and hold a benefice without cure, and by papal authority to be promoted to all, even holy orders and hold another benefice even with cure, and that in virtue of the said dispensation he has had himself made a clerk), the pope hereby orders the above prior, inasmuch as from fear of the power of the said Eugene and Dermit the said John Ody(n)gyn cannot safely meet them in the city and diocese of Ossory, to summon the said Eugene and others concerned, and if he find the said vicarage to be void as above, and the said rectory to be void in any way, and if he find the said John [Odygyn] to be fit, to erect, with consent of the said bishop and chapter, the said rectory, yearly value not exceeding 3 marks sterling, into a simple prebend, which shall be without cure, (fn. 16) in the church of Ossory, and to unite thereto the said vicarage, yearly value not exceeding 15 marks, for the lifetime only of the said John Vgygyn [sic], (fn. 17) and moreover to collate and assign a canonry of the said church and the said erected prebend, with its said annex, to the said John Odi(n)gyn, removing the said Eugene. To Donatus Okenedyg, clerk, of the diocese of Killaloe (Laonien.). Grant, as below. The pope has learned that the priorship of the monastery or house of St. John Baptist juxta le Neanach, O.S.A., in the diocese of Killaloe, wont to be governed by a prior, is void by the death extraR.c. of Maurice Yglessayn. And the recent petition of the above Donatus contained that the buildings of the said monastery or house, in which no canon is at present conventually residing, are in great need of restoration and repair, and its possessions uncultivated and neglected, and that inasmuch as he is a native of the place, (fn. 18) he hopes with the help of his friends to repair and restore the said buildings, induce the canons to reside, increase divine worship, and otherwise remedy the miserable state of the said monastery or house. The pope, therefore, hereby grants to him (who alleges that he is by both parents of a great race of nobles, is in or about his twentieth year, and is studying canon and civil law), (fn. 19) in order that he may be able to continue the said study and be more easily maintained, the said priory, yearly value not exceeding 90 marks sterling, in commendam for life, so that, after bearing its due and wonted burdens, he may dispose of its remaining fruits, etc., as the priors for the time being could or ought to have done; with mandate hereby to the dean of Segovia (Segobien.), the chancellor of Killaloe, and John Omera, a canon of the same, to induct him, etc. Nobilitas generis, vite etc. [3¾ pp.] |
