To the bishop of Adria. Mandate as below. The recent petition of Nemeas Ohenractaich, canon of Clogher, contained that although he formerly obtained, by collation and provision made to him by papal authority, the rural rectory called a comorbanship (plebania canorbania [sic] nuncupata) of St. Tierney's (Sancti Tygernaci), Cluaincoyr, (sic) and subsequently the rectory of St. Maeldoid's (Melldotus), Mucnam, both in the diocese of Clogher, on their successive voidance by the death of Henry Megmachuna and Philip Micgilaceanan, and was dispensed by the said authority to hold both together for life, in virtue of which collation and provision and dispensation he had held them for a number of years, nevertheless Thomas Ohe[n]rachtaych, clerk, of the said diocese, asserting that the rectory of St. Maeldoid's was void in a different way and that he had impetrated it from the apostolic see, prevented Nemeas's peaceable possession, and brought him before John Osyhig, canon of Clogher, as executor of papal letters in the matter of the said impetration; that Nemeas appeared before the said executor, and at his mediation agreed by oath to hold St. Maeldoid's for a year and more and to procure meanwhile at his own expense another benefice for Thomas of like value, failing which the said executor should proceed to execute the said letters and induct Thomas to St. Maeldoid's; and that Nemeas, keeping possession of St. Maeldoid's for such year and more, and taking the fruits, and considering the said agreement unlawful and simoniacal, did not observe the said oath nor procure such benefice. The said petition adding that Nemeas has resigned the said rectory, Thomas having obtained possession, and that he fears, on account of the aforesaid, to be molested in regard to St. Tierney's, the pope orders the above bishop to relax Nemeas's said oath, to absolve him from the guilt of perjury and from excommunication etc., enjoining penance, to dispense him on account of irregularity and rehabilitate him, and to grant to him, who has studied canon and civil law for several years, that the said collation and provision of St. Tierney's, value not exceeding 30 marks, shall hold good from the date of these presents, in whatsoever way it became void; notwithstanding that he was lately received by authority of the ordinaries as a canon of Clogher and of Armagh. To the archdeacon of Ossory. Mandate, at the recent petition of the dean and chapter of the church of Leighlin—containing that the Augustinian priory of St. Stephen, Leighlin, founded and endowed by the said church, has been void for about forty years by the death of prior Richard Walsche; that it is exposed to ruin; that its fruits etc. are reduced to not more than five marks; and that there has long been a dispute as to the right of taking the tithes in the lands of the manor of Wodstock and from the glebe in the diocese of Leighlin, belonging to the bishop for the time being or his mensa; and praying for the suppression of the said order in the priory, the extinction of the name and dignity of a priory, and its appropriation to their capitular mensa—seeing that in the city and diocese of Leighlin there are no fit persons to whom it is possible to write in the matter, to summon the bishop of Leighlin and others concerned, and if he find the facts to be as stated, to appropriate to the said church, for the daily distributions, the said priory, with its annexed churches and chapels and all its rights and appurtenances, and to apply and grant the said tithes to the said capitular mensa, value not exceeding 2 and 40 marks respectively, so that the said dean and chapter may take possession of the said priory, tithes, rights and appurtenances. The pope wills that the priory's said fruits shall be perpetually divided and converted into such distributions, and that the dean and chapter shall cause its cure of souls to be exercised by a fit priest, to be appointed and removed at their sole pleasure. Confirmation, with exemplification, at the recent petition of the master of the hospital of St. Cross of the town of Stratford on Avon (supra Abonam), of the ordinance ‘Univ.sancte matris… Noverit universitas vestra’ of Thomas [Polton], bishop of Worcester, sealed with his seal and dated in his manor of Hillyngden, 22 Feb. A.D. 1428 [-9], the third year of his translation, put forth by him in order to appease dissensions between the warden or guardian of the collegiate church of the said bishop's town (ville nostre) of Stra[t]ford on Avon and the chaplains in the oratory or chapel of the said hospital, the said warden or guardian alleging that the said chaplains are bound to take oath to him to observe the contents of a provincial constitution put forth by archbishop Robert Wynchelsey beginning ‘Presbyteri,’ and the said chaplains denying that they are bound to do so, in accordance with their foundation and the statutes and ordinances of Godfrey [Giffard], sometime bishop of Worcester. |
| Bishop Thomas ordains (i) that the said priests, present and future, shall take oath to the commissary of the bishop, (fn. 2) in presence of the said guardian or his proctor, that on Sundays and greater feasts when the people assemble for divine offices, or when a dead body is present or an anniversary is celebrated in the said church, they shall not begin their masses in the chapel of the said hospital before the Gospel at High Mass in the said collegiate church has been read, unless by the malice of the guardian the High Masses there be inordinately postponed in order to prevent the celebration of divine offices in the oratory of the said hospital; provided that if on the said Sundays and feasts any of the said priests or other neighbouring honest persons are obliged to go forth early in the morning, one mass only may be celebrated for them, privately and without any bellringing, by one of the said chaplains in their oratory; (ii) that they shall swear not to stir up strife, but rather to do their best to make concord, between the said guardian and his parishioners; (iii) that they shall swear not to hear confessions of the parishioners of the said guardian, nor of one another (nec inter se ipsos), without his licence, except by licence of superiors; (iv) that they shall swear not to receive for their own use, but to hand over in full to the said warden or his proctor all oblations made in the said chapel or oratory; (v) that they shall swear not to administer to any parishioners, nor to one another (nec inter se) any sacraments or sacramentals, except by licence of the said guardian or his proctor, nor celebrate nor receive trentals (tricennalia) to his prejudice; (vi) that they will not entice parishioners of the said collegiate church from hearing divine offices therein, but sustain its honour and do nothing to the prejudice of it or its warden; (vii) that if the said warden goes to their place, or if they meet him, they will salute him with reverence and behave to him fittingly and honestly; (viii) that once a year at least, namely on the wake (in foro scilicet dedicacionis) of the said church divine offices shall totally cease in the chapel of the said hospital, and all its priests and clerks shall assemble at the said collegiate church and assist at divine offices in their surplices, obey the warden or his deputy, and make their oblations at the principal mass, in order thus to show themselves to be parishioners of the said church. Martin V reserved to his gift, to be held by Griffin in commendum until he should obtain possession of the administration of the goods of his said church of Ross, or of another church, three or four benefices with or without cure, secular or regular, even if priories, of any patronage, in the province of Reims or Tours; after which, as his petition to the present pope contained, in the cause long ventilated before a certain auditor of causes of the apostolic palace between him and William Cherpin, then a monk of the Benedictine monastery of Saint-Jacut in the diocese of Dol, about the Benedictine priory of Locminé (de Loco monachorum) in the diocese of Vannes, which Griffin had obtained in commendam in virtue of the said letters, the said William obtained a definitive sentence by which the said priory was collated and adjudged to him, and perpetual silence imposed on the said bishop, who was absent from the Roman court and undefended, from which sentence, as soon as he heard of it, he appealed to the apostolic see, although after ten days from its promulgation.
