1428. 7 Id. June. SS. Apostoli, Rome. (f. 25.)	To the archdeacon of Achonry, and the priors of St. Coman's, [Roscommon], and St. Mary's, Dorrean, in the diocese of Elphin. Mandate to collate and assign to Maurice Macquedian, perpetual vicar of Ballyntobayr in the diocese of Elphin, the rectory of Raharanan sive Sylumkuayn in the diocese of Tuam, of the patronage of laymen, value not exceeding 12 marks, so long void because William Ofloynn held it for more than a year without being ordained priest that its collation has lapsed to the apostolic see, although the said William, who is to be summoned and removed, and on account of whose power Maurice has no hope of obtaining justice in the city and diocese of Tuam, has unduly detained possession for more than two years since the said lapse; notwithstanding that Maurice holds together by a papal dispensation granted to him for life the perpetual vicarages of Ballyntobair and Baslyg in the diocese of Elphin, value together not exceeding 8 marks, and that the present pope has lately made provision to him of a canonry of Elphin with reservation of a prebend. Collation and provision to him, who is a licentiate of canon law by examination, of the perpetual vicarage of Kyrkben in the diocese of Glasgow, value not exceeding 12l. sterling, void and reserved by the death at the apostolic see of Finlay (Fynlans, cf. Cal. Lett. VII, p. 496) de Ka; notwithstanding that he holds the perpetual vicarage of Inverlownam in the diocese of St. Andrews, value not exceeding 8l. sterling, with which he lately received papal dispensation to hold for life any benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, and that provision was lately made to him by papal authority of a canonry and prebend of Glasgow, previously reserved, value not exceeding 10l. sterling, of which he does not know whether he is in possession. Mandate to collate and assign to Dominic Patricii, deacon, of the diocese of Sodor (who lately received papal dispensation, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure), the parish church of St. Connanus de Waternys in the said diocese, of the patronage of laymen, value not exceeding 4 marks sterling, so long void by the death of Dominic Margillakannyth (sic) that its collation has lapsed to the apostolic see, although Andrew de Bute, on account of whose power Dominic has no hope of obtaining justice in the city (sic) and diocese of Sodor, and who is to be summoned and removed, has without canonical institution unduly detained possession for more than five years; whether it became void in the way stated, or because the said Dominic Macgillakannyth, having obtained it by canonical collation, held it for more than a year without being ordained priest, or became void otherwise. Mandate to collate and assign to Nicholas Oflannagan, priest, of the diocese of Clogher (who lately received papal dispensation, as the son of a canon professed of the order of St. Augustine, priest, and an unmarried woman, (i) to be promoted etc. as in the preceding, (ii) to receive and hold, and resign, simply or for exchange, the rectory or plebania, called the comorbanship, value not exceeding 10 marks, provision of which the pope ordered to be made to him, of the secular and collegiate church, which is parochial, of St. Lasrianus de Damynys in the said diocese), the sacristship of the Culdees (Coledeorum) of the said church, an elective office with cure, value not exceeding 3 marks, void by the death of Cornelius Osladdan (sic), although Tierney Okathassayd, who is to be summoned and removed, has without canonical institution unduly detained it, void as stated, for more than five years, and has so detained it together with the perpetual vicarage of the said church of Damynis without canonical dispensation; whether it became void in the way stated, or because the late John Macgugyr held it [for more than a year] without having himself ordained priest and without dispensation, or otherwise; notwithstanding that Nicholas holds, collated to him by authority of the ordinary, the lands of Fanagrain called ‘Caladeatas,’ value likewise not exceeding 3 marks, of which the pope orders provision to be made to him anew. He is hereby dispensed to receive the said sacristship, and to hold it for life together with the said rectory and the said lands ‘seu coledeatibus,’ and to resign the said sacristship and the said rectory or plebania or any other incompatible benefice, simply or for exchange, as often as he pleases, and hold instead two incompatible benefices. Mandate to collate and assign to John Angussii, clerk, of the diocese of Argyll, the rectory of St. Conganus's de Ar[d]namurchan in the said diocese, of the patronage of laymen, value not exceeding 9 marks sterling, so long void because Dugald (Dugallus) Alexandri held it for more than a year without being ordained priest that its collation has lapsed to the apostolic see; notwithstanding that the pope lately ordered provision to be made to him of a benefice with or without cure in the common or several gift of the bishops and the deans and chapters of Argyll and Sodor, which mandate shall, upon his obtaining the said rectory, be null so far only as regards a benefice with cure. 17 Kal. April. SS. Apostoli. Rome. (f. 90.)	To the dean, and Solomon Macreauair and John Oschygy, canons, of Clogher. Mandate to collate and assign to Maurice Olergassa, clerk, of the diocese of Clogher, the rectory of Teachcalan in the said diocese, value not exceeding 6 marks, void by the death of William Ocairyll, although Comidinus Oschyghy, priest, of the said diocese, who is to be summoned and removed, has unduly detained possession for more than two years, under pretext of papal letters which made no mention of the person who detained it at the time of the date thereof, as is required by a constitution of the present pope [Ottenthal, Regulæ Canc. Apost., p. 219, No 127 of the Regulæ Mart. V]; notwithstanding that the pope recently [below, Reg. CCLXXXI, f. 229d] ordered provision to be made to Maurice of the perpetual benefice called the vicarage Castri sive de Lochthayd in the said diocese, with cure and value likewise not exceeding 6 marks. He is hereby dispensed to hold for ten years the said two, or any two benefices with cure or otherwise incompatible, and to resign them, simply or for exchange, as often as he pleases. Mandate to collate and assign to John Rossell', priest, of the diocese of Brechin, the perpetual vicarage, value not exceeding 6l. sterling, of the united parish churches of Lathyrn and Dumbeth in the diocese of Caithness, void because William de Suthirlandia held it for more than a year without being ordained priest, although the said William, who is to be summoned and removed, has continued to unduly detain possession after the lapse of the said year, and has done so for more than seven years. Mandate to collate and assign to Philip Macabrechim, perpetual vicar of Ardcarrna in the diocese of Elphin, priest, the perpetual vicarage, value not exceeding 6 marks, of Kylhonan (sic) in the diocese of Ardagh (Ardakaden.), so long void by the death of George Oduigeannan that its collation has lapsed to the apostolic see, although Sagart Oduigrannan (sic), priest, of the diocese of Ardagh, on account of whose power Philip has no hope of obtaining justice in the city and diocese of Ardagh, and who is to be summoned and removed, has unduly detained possession, under pretext of a collation by the ordinary made to him after the said lapse, for more than three years; whether it became void in the way stated, or because Cornelius Oduigrannan (sic) or Philip Orodochan held it for more than a year without being ordained priest, or in any other way; notwithstanding that Philip holds the said vicarage of Ardcarria (sic), value not exceeding 8 marks. 1428. 2 Id. July. Genazzano. (f. 132d.)	To the abbot of St. John Baptist's de Cella Parva, in the diocese of Annadown, and the archdeacon and Cormac Okallanayn, canon, of Annadown. Mandate to collate and assign to Bernard Oflaharthay, clerk, of the diocese of Annadown (who is of a great noble race, and who lately received papal dispensation, as the son of an unmarried layman [cf. above, p. 2] and an unmarried woman related in the fourth and fourth degrees of kindred, to be promoted to all, even holy orders and hold four compatible benefices with or without cure, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleased (fn. 2) ), the rectories, of the patronage of laymen, value not exceeding 12 and 14 marks respectively, of Gnobeg and Gnomor in the said diocese, the former void because Odo Ohallbarayn held it for more than a year without being ordained priest, and the latter void and reserved because Cornelius Odallay obtained collation of it by papal authority when holding the perpetual vicarage of Kylerduyn in the same diocese, and held both together without dispensation against ‘Execrabilis,’ the said Odo and Cornelius being summoned and removed. Bernard is hereby dispensed to hold for life the said two rectories or any two benefices with cure or otherwise incompatible, and to resign them, simply or for exchange, as often as he pleases. Mandate to collate and assign to Oddo Oheghyn, clerk, of the diocese of Meath, who was lately dispensed by authority of the ordinary, as the son of a priest and an unmarried woman, to be promoted to minor orders and hold a benefice without cure, the rectory of Laymcala in the said diocese, to which a number of chapels are annexed, value not exceeding 40 marks, void because Donald Omaelmhuaigh, who is to be summoned and removed, has held it for more than a year without being ordained priest. 5 Id. April. SS. Apostoli, Rome. (f. 204.)	To the dean of Clonmacnoise, and the archdeacon and John Ocuyrryn, canon, of Leighlin. Mandate as below. The pope has been informed by Donald Okynach, clerk, of the diocese of Ferns, that Patrick Okyrngen, priest, of the said diocese, rector of Carnbvega in the same diocese, has divided the fruits etc. thereof with John Ocullyng, clerk, of the same diocese, who pretends to have a right in the said church, has committed adultery and, being under excommunication for disobeying the monition of the ordinary to show a canonical title to the said church, has publicly celebrated mass and other divine offices. Seeing that the said Donald is unable to meet Patrick in the city or diocese of Ferns in order to accuse him, especially because the judges of the said diocese are much suspect to Donald and too favourable to Patrick, the pope orders the above to summon Patrick and others concerned, and if Donald (who is the son of a priest and an unmarried woman, and has been tonsured by authority of the ordinary) will accuse Patrick before them, and if they find the said charges, or sufficient of them to be true, to deprive Patrick, and in that event to collate and assign the said church, value not exceeding 24 marks, to Donald, whom the pope hereby dispenses on account of the said defect to be promoted to all, even holy orders and hold it. Mandate—the pope having been informed by William Visart, canon of Orkney (Ocardien.), that Hugh —, rector of Adzel in the diocese of St. Andrews, although suspended by bishop Henry for refusing to pay a sum of money which he owed to Henry Guth[r]ey, clerk, of the said diocese, in contempt of the suspension publicly celebrated mass and other divine offices for more than three years—if William will accuse Hugh before him, to summon Hugh and others concerned, and if he find the above to be true, to deprive Hugh, and in that event to collate and assign the said church, value not exceeding 20l. sterling, to the said William, who is a priest; notwithstanding that he holds the canonry and prebend of Sanda in Orkney (Orcadien.) and the perpetual vicarage of Aberellot in the diocese of St. Andrews, value not exceeding 4l. and 9l. sterling respectively, which latter he is to resign upon obtaining Adzel. Mandate to collate and assign to Dominic Patricii, deacon, of the diocese of Sodor (who lately … even with cure, as above, f. 53d), the rectory of St. Moluog de Trentornys in the said diocese, value not exceeding 7 marks sterling, of the patronage of laymen, so long void by the death of John Johannis that its collation has lapsed to the apostolic see, although Cristinus Macmarkys, priest, of the said diocese, on account of whose power the said Dominic has no hope of obtaining justice in the city (sic) or diocese of Sodor, and who is to be summoned and removed, has unduly detained possession for more than eight years under pretext of a collation made to him by the ordinary after the said lapse; notwithstanding that the pope has ordered [above, ibid.] provision to be made to him of the rectory of St. Comanus's de Watternys in the same diocese, value not exceeding 4 marks sterling. Mandate to collate and assign to Robert de Dernweke, priest, perpetual chaplain in the parish church of Holy Trinity, St. Andrews, priest, the perpetual vicarage of Carale in the diocese of St. Andrews, value not exceeding 30 marks sterling, void and reserved by the promotion, made by the pope, of George, bishop of Lismore, to that see, and by his consecration, which has taken place by the pope's order; although Alexander de Casteltaris, priest, of the said diocese, who is to be summoned and removed, has unduly detained possession for about five months; whether it be void in the way stated, or by the resignation of Thomas Archir, or in any other way, and notwithstanding that Robert holds the said chaplaincy, without cure, value not exceeding 8 marks sterling. Id. July. Genazzano. (f. 296.)	To the priors of St. Coman's, [Roscommon], and St. Mary's, Doirean, in the diocese of Elphin, and John Macoili, canon of Elphin. Mandate as below. Lewis Macbranan, canon of Elphin (who is of a race of dukes, and lately received papal dispensation, as the son of an unmarried man and an unmarried woman, related in the third and third degrees of affinity and the third and fourth degrees of kindred, to be promoted etc. as above, f. 53d), has informed the pope that Raynald Odubunra, perpetual vicar of the united parish churches of Cluaynffynlacha and Cluaynnagalleach in the diocese of Elphin, has committed perjury, laid violent hands on ecclesiastics and for several years publicly celebrated mass and other divine offices when excommunicate. The pope therefore orders the above three, if Lewis will accuse Raynald before them, and if they find the aforesaid or enough thereof to be true, to remove Raynald, and in that event to collate and assign the vicarages of the said churches, value not exceeding 5 marks, to Lewis; notwithstanding that in virtue of papal letters provision has been made to him of a canonry of Elphin, and that he is expecting one, two or more, or as many as do not exceed in value 18 marks, of the benefices without cure which are wont to be assigned to canons of Elphin, in the gift of the chapter, and that the pope has dispensed him to hold the said canonry and such benefice or benefices, and to resign them, simply or for exchange. Mandate to collate and assign to Solomon Odukanaydh, rector of Ardsrachan in the diocese of Derry, who lately received papal dispensation, as the son of a priest and an unmarried woman, to be promoted etc. as above, f. 53d, the rectory of Ceapach in the said diocese, value not exceeding 8 marks, void because John Ocassalydh, perpetual vicar of Furnaghi in the same diocese, when holding the rectory obtained by collation of the ordinary the said vicarage; although Donatus Macriarta, priest, of the said diocese, who is to be summoned and removed, intruded himself by his own temerity and has held it without any right for more than eight years, and notwithstanding that Solomon holds the said rectory, value not exceeding 8 marks.
