Mandate to collate and assign to James Obrogay, (fn. 2) archdeacon of Clonfert (who asserts that he hopes by his own power to recover from the hands of laymen to clerical rule the below-named rectory; that he is notably skilled in canon law, and that he was lately by papal authority dispensed, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and, upon provision of the archdeaconry of Clonfert being made to him by papal letters [Cal. Lett. VIII, pp. 545, 546], to receive and hold it) the rectory of the parish church de Lochluacha alias de Dealuaacht in the diocese of Cloyne, value not exceeding 40 marks sterling, which is void and has been void so long that there is no certain knowledge of the mode of its voidance, and has been and is at present in the possession of divers lay persons, summoning and removing the present lay possessors; notwithstanding that he holds the said archdeaconry, a non-major elective dignity with cure, value not exceeding 12 marks sterling, with which he is hereby dispensed to hold the said rectory for life. Mandate (the pope having learned that the rectory of Dundagre in the diocese of Clonfert, of the patronage of laymen and value not exceeding 10l. sterling, became void by the resignation of Donatus Omurigay made to James Obregay [rectius Obrogay], archdeacon of Clonfert, who had special power from the apostolic see, and has been by the said resignation so long void that its collation lapsed to the said see, although the said Donatus has detained it for about nine years after his said resignation, without any canonical title) to collate and assign it, the said Donatus being summoned and removed, to John Macnamyn, priest, of the said diocese, who was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself so promoted, and who from fear of the said Donatus's power has no hope of obtaining justice in the city or diocese of Clonfert; whether it became void as above, or by the death without the Roman court of Theobald de Burgo, or in any other way. Mandate to collate and assign to Rory Omochan, clerk, of the diocese of Achonry—who is of noble race and has studied for several years in canon law, and who was lately dispensed by authority of the ordinary, as the son of an unmarried nobleman and an unmarried noblewoman related in the third and fourth degrees of affinity, to be promoted to minor orders only and hold a benefice without cure, and who was afterwards (provision having been ordered by papal letters to be made to him of a canonry of Elphin and another of Achonry with reservation of as many prebends, and also of the provostship of Elphin, then void) dispensed by papal authority to hold the said canonries and prebends and provostship—the rural rectory (fn. 4) of Cuilofind and Ranna in the said diocese, of the patronage of laymen and value not exceeding 10 marks sterling, void because Rory Ogara held it for more than a year without having himself ordained priest and without dispensation; notwithstanding that the pope lately ordered provision to be made to him of the said provostship, a non-major dignity with cure, value not exceeding 12 marks sterling, and by other letters made him provision of a canonry of Elphin and another of Achonry, with reservation of as many prebends. Mandate (the pope having been informed by John Bremicham, priest, of the diocese of Tuam, that Thomas Obinen [sic], perpetual vicar of Athinari in the said diocese, has committed simony and perjury and other excesses and crimes [not here specified], and been a public fornicator) if the said John, who is by both parents of noble birth, will accuse Thomas before them etc. as usual, to summon Thomas, and if they find the above or enough thereof to be true, to deprive Thomas, and in that event to collate and assign the said vicarage, of the patronage of laymen and value not exceeding 15 marks sterling, to John; notwithstanding that the present pope lately ordered provision to be made to him of a benefice with or without cure, even if a canonry and prebend, dignity etc., in the gift of the archbishop and the dean, archdeacon, provost and chapter etc. of Tuam, which mandate shall, upon his obtaining the said vicarage, be null as far as regards only a dignity or personatus, or an administration or office with cure. To the abbot of Ballintober (Villa fontis [S. Patricii]) in the diocese of Mayo. Mandate as below. Martin V (upon learning that the perpetual vicarage of Omy in the diocese of Tuam alias Mayo was void by the deprivation for his demerits of Malachy Ocearna by the late John, archbishop of Tuam, and had been so long void that its collation had lapsed to the apostolic see, although the late John de Standona, priest, had detained it, collated to him by authority of the ordinary after the said lapse, for about two years without any other canonical title, and was still unduly detaining it) ordered the abbot of St. Michael's, Mayo, in the said diocese, and two colleagues to grant in commendam for life the said vicarage, whether void as above or in any other way, to Thomas Oronayn, an Augustinian canon [now] of the monastery of Holy Trinity, Ballintober (Sancte Trinitatis Ville fontis Sancti Patricii) in the said diocese, then of the said monastery of St. Michael. Afterwards, as the recent petition of Philip Micronbay, clerk, of the said diocese contained, Odo, [now] bishop of Mayo, then abbot of St. Michael's, granted the said vicarage in commendam to the said Thomas, who had then migrated from St. Michael's to Holy Trinity, and who in virtue of the said commenda obtained the said vicarage, which he still holds; subsequently to which the pope ordered provision to be made to the said Thomas of the said monastery of Holy Trinity, with the condition that as soon as he obtained possession of it the said commenda should cease. Seeing that therefore the said commenda is hoped shortly to cease, and that as soon as it ceases the said vicarage will be still void as above, the pope orders the above abbot to collate and assign to the said Philip, who was lately dispensed by authority of the ordinary, as the son of a priest and an unmarried woman, to be promoted to all minor orders and hold a benefice without cure, if found fit, the said vicarage, value not exceeding 3 marks sterling, if and after it become void by the cessation of the said commenda, even if it be actually void by the free resignation of the said Malachy, or in any other way. VI, p. 115] that its collation lapsed to the apostolic see, summoning and removing Thady Ohanly, priest, of the said diocese, who has unduly detained it for about four years under pretext of letters of the present pope of which the impetration was null and surreptious because the vicarage's true detainer at the time was not duly expressed, or because the said Thady had not cleared himself of his simoniacal entry therein; whether it be void as above, or because Odo Macaedadgayn (sic), clerk, when in possession, was not ordained priest [within a year], without being dispensed, or in any other way. Mandate (the pope having been informed by Cornelius Otomolthan, clerk, of the diocese of Derry, that Cornelius Ohyrmegaych, rector of Ardseraha in the said diocese, has dilapidated its goods, is a public fornicator and perjurer, and has committed other crimes and excesses [not here named]) if Otomolthan (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who, because in the city or diocese of Derry there reside few judges not suspect to him, has no hope of obtaining justice) will accuse Ohyrmegaych before them etc. as usual, to summon Ohyrmegaych, and if they find the above or enough thereof to be true, to deprive him, and in that event to collate and assign the said rectory, value not exceeding 12 marks sterling, to Otomolthan. To Maurice Olergassa and Nelanus Maguyr, canons, and the official of Clogher, Mandate—the pope having been informed by Magonius Olergassa, perpetual vicar of St. Tierney's (Sancti Tyernaci), Cluaneyes, in the diocese of Clogher, that Eugenius Macmachaun, perpetual vicar of the parish church called the plebs of Clandcellaychmicmoekuonach (fn. 6) in the said diocese, is a notorious fornicator and (being a perjurer and irregular, and having been excommunicated and publicly proclaimed excommunicate at the instance of a creditor on account of certain debts which, although he had sufficient means, he neglected to pay at the date fixed by a competent judge, and not having been absolved) has celebrated and taken part in masses and other divine offices, even in contempt of the keys—if Magonius (who was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and subsequently, when provision had been made to him by papal letters of a canonry of Clogher, to hold it) will accuse Eugenius before them etc. as usual, to summon Eugenius, and if they find the above or enough thereof to be true, to deprive him, and in that event to collate and assign the said vicarage, value not exceeding 3 marks sterling, to Magonius; notwithstanding that he holds the said vicarage of St. Tierney's, value not exceeding 6 marks, and the said canonry, which has no value. He is hereby dispensed to hold together for twenty years the said two vicarages, which he says are near one another, notwithstanding the said defect etc. Within the said period he is to exchange one of them for a benefice compatible with the other; if not he shall, upon its expiry, resign St. Tierney's. Mandate (the pope having been informed by Rory Otomoltan, clerk, of the diocese of Derry, that formerly Patrick Macgorke, perpetual vicar of Termuncumyn in the diocese of Armagh, promised and paid a sum of money to Denis Olucarean, priest, in order that he might resign the said vicarage and that collation and provision thereof might be made to Patrick, thereby incurring the sentences etc. promulgated against simoniacs, after which Denis resigned of his own accord, as he said, the said vicarage to archbishop John, who, perhaps ignorant of the said bargain, admitted the resignation and made collation and provision of the vicarage, thus void, to Patrick, who under pretext thereof obtained possession), seeing that the said collation and provision are therefore without force, and that the vicarage is still void as above, to summon Patrick and others concerned, and if he find the above to be true, to decree the said col- lation and provision null and void and remove Patrick, and in that event to collate and assign to Rory (who was lately dispensed by authority of the ordinary, as the son of a priest and an unmarried woman, to be tonsured) if found fit, the said vicarage, value not exceeding 5 marks sterling. Mandate (the pope having been informed by Magonius Oconualayd, clerk, of the diocese of Clogher, that formerly John Osychygy, rector of the parish church of St. Congal, Gabaluyn, commonly called the plebs of Dartraigy, in the said diocese, after simonical bargains got collation and provision made to him thereof by authority of the ordinary, on its voidance by the resignation of James Macmachaun, made of his own accord, as he said, and admitted by the said authority, thereby incurring the sentences etc. promulgated against simoniacs; and that John is moreover a perjurer and a public fornicator, and has committed divers other crimes and excesses [not here mentioned]) if Magonius, who asserts that few judges reside in the said city or diocese of Clogher whom he does not hold suspect, and that he has therefore no hope of obtaining justice, will accuse John before them as usual, to summon John (who under pretext of the said collation and provision obtained possession), and if they find the above or enough thereof to be true, to decree the said collation and provision null and void and deprive John, and in that event to collate and assign the said church, value not exceeding 20 marks sterling, to Magonius. Mandate to collate and assign to John Stak, canon of Limerick (who was lately dispensed by papal authority, as the son of a deacon and an unmarried woman, to be promoted to all, even holy orders and hold any mutually compatible benefices with and without cure, of any number and kind, even if canonries and prebends, dignities etc., and resign them, simply or for exchange, as often as he pleased) the rectory or plebania of the parish church of Dwngarwan in the diocese of Lismore, of the patronage of laymen and value not exceeding 100 marks sterling, so long void by the death without the Roman court of Maurice Ocogorayn that its collation lapsed to the apostolic see; whether it be so void or because Ralph Beldesford and Gerald son of Maurice son of Richard, knight, de Geraldinis, successively held it without being ordained priest within a year and without dispensation, or be void in any other way; and notwithstanding that John holds a canonry of Limerick and the prebend of Effyng, and that provision was lately ordered by papal authority to be made to him of the archdeaconry of the same church, a non-major non-elective dignity with cure, value not exceeding 15 and 60 marks sterling respectively, and that the present pope lately dispensed him to hold for life the said archdeaconry and any other, or otherwise any two, benefices with cure or otherwise incompatible, even if dignities etc., and to resign them, simply or for exchange, as often as he pleased. Mandate to collate and assign to Cornelius Otreanlannayn alias Odonnamayn (cf. f. 164), clerk, of the diocese of Ardfert (who, without mention of his defect of birth as the son of a priest and an unmarried woman, had himself tonsured, and who was afterwards, also without making the said mention, dispensed by papal authority to be promoted to all, even holy orders and hold a benefice with or without cure) the perpetual vicarage of Dissert Odriaellach in the said diocese, value not exceeding 3 marks sterling, void by the resignation of Maurice Ykathayl to Nicholas, bishop of Ardfert, summoning and removing the said Maurice, a priest, of the said diocese, who without any right has since the said resignation detained possession for more than three years but less than four, and from fear of whose power Cornelius has no hope of obtaining justice in the city or diocese of Ardfert. The pope hereby dispenses Cornelius to act as a clerk and, the said dispensation remaining in force, to receive and hold the vicarage, and resign it, simply or for exchange, once only. (fn. 8) Mandate—the pope having been informed by Gerald Odaly, clerk, of the diocese of Meath, that Richard Whytehacre, perpetual vicar of Kyllucone in the said diocese, neither understands nor can intelligibly speak the language spoken by the parishioners, has dilapidated and taken away the goods of the said church, is ignorant, and is held suspect (pernotatus) by good and grave men in those parts of many vices and excesses [not here named]—if Gerald, who on account of Richard's power has no hope of obtaining justice in the city (sic) or diocese of Meath, will accuse Richard before them etc. as usual, to summon Richard and if they find the above to be true, to deprive him and in that event to collate and assign the said vicarage, of the patronage of laymen and value not exceeding 40 marks sterling, to Gerald; whether it become void by such deprivation, or be void by the free resignation of the said Richard, or in any other way. Mandate—the pope having been informed by Donatus Otreanlannayn alias Odannamayn (cf. f. 145d.), priest, of the diocese of Ardfert, that Gillacius Omulcluchy, [perpetual] vicar of Gaylly in the said diocese, simoniacally got himself presented by the patrons of the said vicarage on its voidance by the death without the Roman court of John Mickelgeoid, and instituted by authority of the ordinary, that he obtained possession under pretext of the said presentation and institution, and still unduly detains it; and that he is publicly held suspect (notatus) by good and grave men in those parts of divers crimes and excesses [not here named]—if the said Donatus (who, without mention of his defect of birth as the son of a priest and an unmarried woman, had himself tonsured, (fn. 9) and who was afterwards dispensed by papal authority to be promoted to all, even holy orders and hold a benefice even with cure; and who fears that Nicholas, bishop of Ardfert is favourable to Gillacius, and therefore, and for other reasons, doubts whether he can obtain justice in the city or diocese of Ardfert) will accuse Gillacius before the above dean etc. as usual, to summon Gillacius and if he find the above to be true, to declare the said presentation and institution null and void, and remove Gillacius, and in that event to collate and assign to Donatus, if found fit, the said vicarage, value not exceeding 6 marks sterling; whether it become void by such removal etc., or be void because Maurice son of Gerald Fitzmuris held it [for more than a year] without being ordained priest and without dispensation, or be void in any other way. The pope hereby, decreeing (censentes) the said dispensation valid as if it mentioned that Donatus had been tonsured, dispenses him to act as a clerk and minister in the orders which he has received, and receive and hold the said vicarage and any other compatible benefice, and to resign both, simply or for exchange, as often as he pleases, and hold instead two other compatible benefices. Mandate—the pope having been informed by John Walsche, dean of Cork, bachelor of canon law, that Thomas Tyrri, rector of the parish church of Little Island (Sancti Lappani de Inysmemele alias Parve insule) in the diocese (fn. 11) of Cork, has remained for several years under a sentence of excommunication pronounced by authority of the ordinary and, although publicly proclaimed excommunicate, has celebrated masses and other divine offices, and has committed perjury and fornication—if John will accuse Thomas before them etc. as usual, to summon Thomas, and if they find the above or enough thereof to be true, to deprive Thomas and in that event to collate and assign the said rectory, of the patronage of laymen and value not exceeding 6 marks sterling, provided that the said patrons assent, to John; whether it become void by such deprivation, or be void by the free resignation of the said Thomas, or in any other way, and notwithstanding that John holds the said deanery, which is a major elective dignity with cure, for the performance of whose burdens the dean is bound to keep two priests, and whose value does not exceed 12 marks sterling. VIII, p. 5], and that, holding a canonry in the said church of Ardfert, he is expecting a prebend and dignity etc. therein and a benefice in the said gift, by vigour of the pope's said letters.
