Indult to them and those who shall join their fraterity during the next five years, that the confessors of their choice (namely in the case of lay members their curates or own priests, or seculars or regulars of any orders having licence therefrom, and in the case of ecclesiastical members seculars or regulars of any orders) may hear their confessions and absolve them from all sentences of excommunication etc., and from crimes etc., except in cases reserved to the apostolic see, and enjoin penance; may commute vows of pilgrimage, except those of pilgrimage to the Holy Land, Rome and Santiago [de Compos ela], and may commute vows of abstinence (fn. 3); and may dispense such of them as are ecclesiastics on account of irregularity and rehabilitate them. They are to make satisfaction to whom they owe it: if not, they shall eo ipso fall again under their former sentences; with the usual clause providing that the present indult shall be vain in case of its being abusively taken advantage of. Mandate, at the recent petition of John Rogeri, a Friar Preacher—containing that formerly (relying on certain letters which had emanated from the apostolic see, by which he was dispensed to receive and retain any benefice with cure, even wont to be held by secular clerks, even if a parish church or a perpetual vicarage, and which were by many judged false) he obtained, otherwise canonically collated to him, a certain parish church in the province of Canterbury under pretext of the said letters, which seem to have all the signs commonly wont to be attached to papal letters; and adding that by reason of the aforesaid many try to assert (fn. 5) that he contracted disability, whereas very many others are of the contrary opinion—if he find the facts to be so, to declare and decree that John has incurred no disability on account of the above, and that he could and can retain the said church, and to grant that he may resign it and receive instead and retain for life another benefice, even if it be a parish church or a perpetual vicarage. To the abbot and convent of the Cistercian monastery of Pypwell in the diocese of Lincoln. Grant, at their recent petition—containing that to the vicarage of the parish church of Geydyngton near their monastery are united and appropriated four chapels, distant from the monastery about two miles of those parts, one in each of the towns (ville) of Little Newton, Great Ocle, Great Newton and Barforde, and that the perpetual vicar is bound to keep at his expense a secular priest in the chapel of Little Newton and one in that of Great Ocle, and one in each of the others, which have cure, in order to celebrate mass and other divine offices daily and administer the sacraments to the parishioners dwelling in the said towns; and adding that the fruits etc. of the said vicarage are so much diminished that the said vicar cannot keep the said priests, and that in consequence the burden of doing so falls entirely upon the abbot and convent, to whom the said parish church is united and whose many other burdens are daily increasing—that they and their successors may appoint monks of their monastery to celebrate the said masses etc. in the said parish church and chapels. Mandate (the pope having been informed by Maurice Ocenedyg, an Augustinian canon of the Arroasian (Argacen.) house of Achemycarth in the diocese of Ossory, (fn. 6) that Cornelius alias Concoger Macgillapoil, prior of the monastery or house of St. John Baptist's by le Naenach in the diocese of Killaloe, has committed simony, publicly kept a concubine and dilapidated the goods of the said priorship, and is deeply implicated in other crimes and excesses of which he is held suspect in those parts) if Maurice will accuse Cornelius before the bishop etc. as usual, to summon Cornelius, and if he find the above or two of them true (fn. 7), to deprive Cornelius, and in that event to collate and assign the said priory, a conventual dignity, with cure and elective, value not exceeding 50 marks sterling, to Maurice; whether it become void by such deprivation, or be void by the free resignation of the said Cornelius or of Dermit Yhaath, or in any other way. Grant, at their recent petition (containing that the statutes etc. of the said order provide, under certain pains etc., that no religious thereof shall eat without the refectory or sleep without the dormitory of the house or place where he is for the time being; and adding that their said house of St. Anthony, in whose church they are bound to divine offices, is without any refectory or dormitory) that, the fundamentals of the said order being observed, they may, without incurring such pains etc., like honest priests remain and eat, drink and sleep in decent and honest places of the said house, until there be such refectory and dormitory. Mandate, at the recent petition of John Broune alias Persone, a canon of the Augustinian priory of St. Mary, Connall, in the diocese of Kildare (containing that he formerly, without licence of his superior, went forth from the said priory, in which had made his profession, betook himself to divers secular places and wandered about, and, wearing however his habit, has lived laudably in the world for about thirteen years) to absolve him from sentences of excommunication etc. and from the note of apostasy incurred, enjoining penance, dispense him on account of irregularity and rehabilitate him. Mandate to him (whom the pope has this day (fn. 8) ordered as in the preceding, here recapitulated), the above priory having become void by the death without the Roman court of Maurice Medwede (fn. 9) during the life of Martin V and therefore, being conventual, reserved to that pope, who died without disposing thereof, so that it still remains void and reserved, to collate and assign it, elective and with cure, dependant on no monastery, and value not exceeding 50 marks sterling, to the above John, after he has been duly dispensed etc. as ordered above; whether it be void as stated, or by the death without the said court of John Greuis (fn. 10), or by the free resignation of Philip Scoyle or Robert Laules, or in any other way; summoning and removing Nicholas Bayly alias Mcnulli who, as the said John alleges, under pretext of an election made by the convent after the said reservation, and of the confirmation thereof by authority of the ordinary, has for more than five years but less than six unduly detained possession. Mandate (the pope having been informed by Maurice Oheelayn, an Augustinian canon of St. Mary's, Connayl (fn. 15), in the diocese of Kildare, that Maurice Ocolgayn prior of the Augustinian priory or house of St. Mary, Kylley, in the said diocese, has publicly kept, sometimes within and for the most part without its precincts, a concubine by whom he has begotten offspring still living (fn. 16), dilapidated the goods thereof, and committed other crimes and excesses [not here specified]) if the said Oheelayn (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) will accuse Ocolgayn before the above prior etc. as usual, to summon Ocolgayn, and if he find the above to be true, to deprive Ocolgayn, and in that event to collate and assign to Oheelayn the said priory, conventual, with cure, and elective, dependent on the Augustinian monastery or priory of Durmmach in the diocese of Meath and wont to be governed by monks thereof and value not exceeding 10 marks sterling; whether it become void by such deprivation, or be void by the free resignation of the said Ocolgayn, or in any other way. To the abbots of Pypwell and Sawtry, and the prior of St. Andrew's, [Northampton], in the diocese of Lincoln. Mandate as below. The recent petition of the Cistercian abbot and convent of Bitlesden in the diocese of Lincoln contained that although by special privilege granted to them by Boniface VIII they ought to be exempt from paying tithes of fruits growing on their lands, alike those which they cultivate with their own hands and those which they rent to others, and have been in peaceable possession of the said exemption from the time of the granting of the said privilege, nevertheless the Augustinian abbot and convent of Oseneye in the said diocese, who hold the parish church of Stowe in the said diocese as appropriated to them, claiming, on the ground of the said church, the right to take the tithes of fruits growing on lands within its bounds, despoiled the said abbot and convent of Bitlesden of the right of the said exemption, and exacted and still detain wrongful possession of the tithes from the fruits growing on certain lands situate within the said bounds and belonging to the said monastery [of Bitlesden]; and that William, abbot of Westminster near London, appointed by papal letters conservator of the Cistercian order, before whom the abbot and convent of Bitlesden caused the abbot and convent of Oseneye to be summoned, gave a definitive sentence, which became a res judicata, in favour of the former, decreeing them to be exempt from the payment of tithes of fruits growing on their lands within the said bounds which they had cultivated and should cultivate with their own hands, and on those which they had, for a moderate time, fixed by him at twenty years, rented or should rent to be cultivated by others in return for yearly pensions, the said abbot William further condemning the said abbot and convent of Oseneye in the tithes which they had taken from the said lands since the time of the said spoliation. The pope therefore, at the said petition, orders the above two abbots and prior to cause the said sentence to be observed, without appeal, invoking the aid of the secular arm etc. Humilibus supplicum votis. Mandate (the pope having been informed by William River, prior of the hospital or house of St. John Baptist without the walls of Drogheda of the order of Crouched friars (extra muros Pontane ordinis Cruciferorum) in the diocese of Meath, that James Cotyfe (fn. 19), prior of the priory of the house of St. John Baptist without the new gate of Dublin, immediately belonging to the Roman church, of the said order, has dilapidated the goods of the said priory and, being a public fornicator, has begotten offspring and cherished it (fn. 20) ), if William will accuse James before the above canon etc. as usual, to summon James, and if he find the above to be true, to deprive James, and in that event to collate and assign to William the said priory, which does not depend on any regular place, value not exceeding 400 marks sterling; whether it become void by such deprivation, or be void by the death without the Roman court of John Water, or in any other way.
