To the abbots of Holyrood (Sancte Crucis) and Neubotel, in the diocese of St. Andrews, and the official of St. Andrews. Mandate—the pope having been informed by William de Wardelaw, perpetual vicar of Wemet (sic) in the diocese of St. Andrews, that Robert de Kymont, perpetual vicar of Cupar in the said diocese, after an exchange of words of insult with the late Neym, a layman, angrily related them to his father-in-law, William de Froscar (fn. 2), who, overcome with rage, attacked the said layman and hit him so hard with an iron-tipped staff (fn. 3), which is commonly carried in those parts, that he soon died; and that the said Robert is diffamed in those parts of perjury and other crimes and excesses [not here specified]—if Wardelaw (to whom lately, after he had been dispensed by papal authority as the son of an unmarried man, a baron and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, the present pope ordered provision to be made of a benefice with or without cure, wont to be assigned to secular clerks, in the gift of the abbots and convents of Poslai [sic] and Kelco, of the orders of Cluny and St. Benedict, in the dioceses of Glasgow and St. Andrews, and whom he dispensed to hold such benefice) will accuse Robert before them, etc., as usual, to summon Robert, and if they find the above to be true, to deprive Robert, and in that event to collate and assign the said vicarage, value not exceeding 18l. sterling, to Wardelaw; notwithstanding that he holds the above vicarage of Wemet (sic), value not exceeding 6l. He is hereby dispensed, on account of the said defect etc., to receive and retain the said vicarage of Cupar, upon obtaining which he is to resign that of Wemet (sic), and the said letters shall be void as far as regards a benefice with cure only. Mandate to collate and assign to Dermit Osyda, priest, of the diocese of Killaloe, the perpetual vicarage of Kyllsenhanleyg in the said diocese, value not exceeding 5 marks sterling, void because Donald Om(u)lluyni when holding it, obtained, collated to him by authority of the ordinary, the perpetual vicarage of Kasleanyconyng in the said diocese; summoning and removing Gillabertus alias Gillamuchulle Orodayn, priest, of the said diocese, who has for about six years unduly detained possession of it without any canonical title. Martin V—having learned that the rectory of Killnamonad in the diocese of Killaloe, commonly called Kinelbuith, (the cure of souls of whose parishioners was wont to be exercised by a perpetual vicar, and divers fruits etc. of which were being unduly detained by laymen who pretended that its patronage belonged to them) was void by the death without the Roman court of Scarlas [sic] alias Cucogrithi Ogriffa, and had been so long void that its collation had lapsed to the apostolic see; and upon its being set forth to him by Donald Yaiynd [sic], clerk, of the said diocese (to whom the said pope had ordered provision to be made of a canonry of Killaloe and the prebend of Kaithblarhmat [rectius Raithblathmac]) that if the said rectory were for his life united to the said canonry and prebend divine worship would, with the help of his friends, who were powerful in those parts, be much increased in the said church of Killaloe etc.—ordered the bishop of Killaloe, if he found the said rectory to be void as above or in any other way, and what was set forth, as above, to be true, to unite it, provided that its collation had lapsed as above, to the said canonry and prebend for as long as the said Donald should hold them. Seeing that, as the pope has been informed by Thady Ogriffa, clerk, of the said diocese, the said Donald, who holds the said canonry and prebend, and rectory united thereto by force of the above mandate, is a simoniac, perjurer and notorious fornicator and adulterer, and is involved in divers other crimes [not here specified], if Thady (who was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and afterwards to hold three others with or without cure compatible with one another and with the said rectory, etc. and to whom the present pope has by other letters ordered provision to be made of the said rectory) will accuse Donald before them, etc. as usual, to summon Donald, and if they find the above to be true, to dissolve and annul the said union and remove Donald from the said rectory, and in that event to collate and assign it, value not exceeding 10 marks sterling, to Thady. Mandate (the pope having been informed by Laurence Obuighi, clerk, of the diocese of Raphoe, that Matthew Macdalaigh, alias Macandeaghanaigh, perpetual vicar of Theachbuithin in the said diocese, is a notorious fornicator and has committed simony and divers other grave crimes [not here specified]) if Laurence (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman related in the second and third degrees of affinity, to be promoted to all, even holy orders and hold a benefice even with cure) will accuse etc. as in the preceding mutatis mutandis. Mandate (the pope having been informed by David Odrufyn, perpetual vicar of Millenach in the diocese of Ferns, that Maurice Olass(e), rector of St. Cormac's in the said diocese, has dilapidated goods of that church and celebrated masses and other divine offices in places under interdict, even in contempt of the keys) if David (who is a priest, and who was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and whom the pope hereby absolves from any sentences of excommunication etc. as far as regards obtaining effect of these presents) will accuse Maurice before them etc. as usual, to summon Maurice, and if they find the above to be true, to deprive Maurice, and in that event to collate and assign the said rectory, value not exceeding 12 marks sterling, to David; notwithstanding that he holds the said vicarage, value not exceeding 4 marks. The pope hereby dispenses David, who alleges that the said rectory and vicarage, on account of the small distance between the said churches, could be conveniently served by one person, to receive the said rectory and two, three or several other benefices with or without cure, compatible with one another and with the aforesaid [rectory and vicarage], and to hold together for life the said rectory and vicarage and other such benefices, and resign them, simply or for exchange, as often as he pleases, and hold instead six other mutually compatible benefices, notwithstanding the pope's late constitution [see above, p. 5], and the said defect of birth, etc. Vite etc. (An. and Ja. de Ugolinis. | An. xxxx. Mandate (the pope having been informed by Isaac Oculean, clerk, of the diocese of Armagh, that M[a]urice Oculean, perpetual vicar of Cluainfiecla in the said diocese, has dilapidated and converted to profane uses goods of the vicarage and, a public fornicator, has begotten offspring living, and committed many other excesses and crimes [not here specified]) if Isaac (who was lately dispensed by papal authority, as the son of unmarried parents, (i) to be promoted to all, even holy orders and hold a benefice even with cure, (ii) provision having been ordered to be made to him of a canonry, with reservation of a prebend and administration or office of the church of Armagh, and also of a benefice with or without cure, even if a canonry and prebend, administration or office in a cathedral or collegiate church, in the gift of the bishop and the dean and chapter etc. of Dromore, to receive and hold such canonry and prebend, administration or office in such cathedral church) will accuse M[a]urice before them etc. as usual, to summon M[a]urice, and if they find the above to be true, to deprive him, and in that event to collate and assign to Isaac the said vicarage, value not exceeding 8 marks sterling, upon obtaining which the above letters shall be null and void as far as regards a benefice with cure only. Mandate (the pope having been informed by Patrick Mackearbyll, clerk, of the diocese of Clogher, that Rory Macgachna, perpetual vicar of Cluaincaethyn in the diocese of Armagh, publicly keeps in his own house as his concubine a certain woman by whom he has begotten offspring living, and, although he has several times promised by oath in presence of many notable and grave persons, with his hand upon the Holy Scriptures, to put her away, has not done so, thereby causing very great scandal and incurring the guilt of perjury) if Patrick (who was lately dispensed by authority of the ordinary, as the son of unmarried parents, to be promoted to minor orders) will accuse Rory before them etc. as usual, to summon Rory, and if they find the above to be true, to deprive him, and in that event to collate and assign the said vicarage, which is of the patronage of laymen and value not exceeding 10 marks sterling, to Patrick, whom the pope hereby dispenses to be promoted to all, even holy orders and receive the said vicarage. Mandate (the pope having been informed by Dermit Maccassurlaid, clerk, of the diocese of Tuam, that John Macgyllyn alias Macindringh, perpetual vicar of Liskyauaig in the said diocese, has dilapidated and converted to profane uses goods of the said vicarage, and is a simoniac and of no learning (fn. 4) ) if Dermit (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) will accuse John before them etc. as usual, to summon John, and if they find the above to be true, to deprive him, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Dermit, if found fit; notwithstanding that the pope lately ordered provision to be made to Dermit of a benefice with or without cure, even if a canonry and prebend, administration or office, in the gift of the archbishop and the dean and chapter etc. of Tuam, and [dispensed him] to receive and hold such reserved benefice. Mandate to receive the resignation which John de Kyngorne proposes to make of his perpetual vicarage of St. Nicholas, Neuabberden, in the diocese of Aberdeen, and to collate and assign it, value not exceeding 16l. sterling, to Robert Stewart, M.A., a canon of Aberdeen, out of consideration for king James, who has petitioned the pope on behalf of the said Robert, who is his kinsman and was lately successively dispensed by papal authority, as the son of a deacon and an unmarried woman (i) to be promoted to all, even holy orders and hold a benefice even with cure, (ii) to hold three, and (iii) to hold any, other benefices with or without cure, of any number and kind, compatible with one another and with the aforesaid, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleased, and hold instead other mutually compatible benefices; notwithstanding that the said Robert (who was lately dispensed by the said authority to hold for life any two benefices with cure or otherwise incompatible, even if dignities etc., and to resign them etc. as above) holds a canonry of Aberdeen and the prebend of Dere, the parish church of Kinnettles (de Kinnetillis) in the diocese of St. Andrews, value together not exceeding 40l. sterling, and, holding by authority of other letters of the present pope a canonry of Glasgow, is expecting (fn. 6) a prebend therein and an office even if elective. The pope hereby dispenses Robert to hold together for life the said vicarage and church of Kinnettles (here de Kinettillis), and to resign them etc. as above, and hold instead two other incompatible benefices, even if they be major or principal dignities or parish churches or perpetual vicarages, or one of one sort and another of the another, notwithstanding the above ordinance etc. The archdeacon is to see that there be no corruption on the part of John and Robert in the matter of the said resignation. Mandate to collate and assign to David Odubgilla, rector of Disertkeallayd in the diocese of Kilmacduagh (who has studied canon law in Ireland for twelve years after the manner of the country, (fn. 7) and was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure) the rectory of the parish church of St. Thomas alias Kyllthomais in the said diocese, of the patronage of laymen and value not exceeding 10 marks sterling, so long void, because Maurice Oygillam entered and made his profession as a canon of the Augustinian priory of Kylheid in the diocese of Kildare, that its collation lapsed to the apostolic see; notwithstanding that he holds the said rectory of Dysertkeallayd, value not exceeding 4 marks. He is hereby dispensed, on account of the said defect etc., to hold the said rectory of St. Thomas, upon obtaining which he is to resign that of Disertkeallayd. Mandate to collate and assign to Matthew Ogriffa, clerk, of the diocese of Killaloe, who alleges that he is of illegitimate birth, being the son of a priest and an unmarried woman, the perpetual vicarage of Dyssyart Mallycalla in the said diocese, value not exceeding 10 marks sterling, so long void, by the death without the Roman court of John Odeaygy, that its collation lapsed to the apostolic see; summoning and removing Maurice Ogalleon, priest, of the said diocese, who took possession under pretext of a collation by the ordinary made after the said lapse, and has unduly detained it for about a year but less than two years.
