Faculty for him, to whom the pope recently made provision of St. Mary's, to be blessed by any catholic bishop, who shall thereafter receive and send to the pope his oath of fealty etc. as usual; without prejudice to the bishop of Moray, to whom the said monastery is by ordinary right subject. Dispensation to him (whom lately, holding a canonry of London with the prebend called Totenhale (fn. 2) and having the tonsure only, the present pope dispensed not to be bound for ten years to be promoted to any other order on account of the said prebend, which some allege to be sacerdotal; who is a continual commensal member of the household of king Henry, is still within the said ten years, and still holds the said canonry and prebend) not to be so bound for life. 1443. 3 Kal. Nov. St. Peter's, Rome. (f. 78d.)	To the bishop of Ossero (Ausaren.) and Cornelius Omachan, a canon, and the official, of Achonry. Mandate as below. The recent petition of Bernard Micdonnchaid, subdeacon, of the diocese of Elphin, contained that—after Martin V's general reservation to himself and his successors of absolution from sentences of excommunication etc. against simoniacs, and after the present pope had ordered provision to be made to him (who alleged that he had been dispensed by authority of the ordinary, as the son of unmarried nobles related in the fourth degree of kindred, to be promoted to minor orders and hold a benefice without cure) of a benefice with or without cure in the gift of the bishops and the deans and chapters etc. of Elphin and Achonry, and had dispensed him, notwithstanding the said defect, to be promoted to all, even holy orders and hold such benefice with cure etc.—he, in vigour of the said letters, accepted and had provision made to him, and obtained possession, of the rectory of the rural lands of Dachorand and Mota in the diocese of Achonry, then void by the death without the Roman court of Donald Macdonchaid, and that, fearing molestation by lay power, he made by oath a promise, which he afterwards fulfilled, to give to Cornelius Maccellard (rectius Maccellaid), a clerk, of the said diocese of Achonry, a portion, worth 16 marks sterling, to be taken by him once, and to Cormac Macdonchaid, a canon of Achonry, another portion to be taken by him yearly for life, of the tithes of the said rectory, thereby incurring the said sentences etc. The pope therefore orders the above to absolve him therefrom, enjoining penance, and to rehabilitate him, bul wills that before they proceed to execute these presents he shall resign the said rectory. Mandate, recapitulating the preceding, seeing that, as the above petition added, the above Bernard's progenitors were also related in the third and third degrees of affinity, of which mention was not made in the above letters, after they have absolved etc. as above, and Bernard has duly resigned, to collate and assign to him the above rectory, still void as above, with cure and value not exceeding 25 marks sterling. The pope hereby dispenses him to receive and hold it, and grants that his above other letters and their consequences shall hold good as if they mentioned the said further relationship. VIII, pp. 643, 644] dispensed (seeing that by reason of wars etc. he had not received and had no hope of receiving anything from his said church, of which the pope had made him provision [ibid. p. 358]) to hold in commendam with the said church any benefice with or without cure, even if it were a canonry and prebend or a dignity of a cathedral or collegiate church, etc., and were of lay patronage, after which he obtained, collated to him by the ordinary, and holds in commendam, the archdeaconry of Brekenol (sic) in St. Davids—to exchange the said archdeaconry for another benefice with or without cure, without, however, a cathedral or a collegiate church, and hold such benefice in commendam for life. Mandate, at the recent petition of John Mickamayll, a canon of Clogher—containing that formerly (after he, who is of a race of dukes, had been dispensed by papal authority, as the son of a bishop and an unmarried woman, related in the double second and the first and third and the third sixfold degrees of affinity, (fn. 3) to be promoted to all holy orders and hold one, two, three or four compatible beenfices with or without cure, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleased, and hold instead four other compatible benefices, and had obtained thereafter the rectory of Ariguldaberog (sic) in the diocese of Armagh; and after Martin V's reservation to himself and his successors of absolution from sentences of excommunication etc. against simoniacs) upon the voidance (i) of the rectory of Termondcuayn in the said diocese (whose cure was exercised by a perpetual vicar, a secular priest, and which had been erected by authority of the ordinary into a prebend of the church of Armagh) by the resignation of Malachy Miceadga, priest, to the late John, archbishop of Armagh, who was perhaps ignorant that a simoniacal bargain had taken place between the said Malachy and John, (ii) of the archdeaconry of Clogher, a non-major dignity with cure, by the death without the Roman court of Maurice Mackmagnussa, the said archbishop John and Peter, bishop of Clogher, perhaps also ignorant of the said bargain, successively made collation and provision of the said rectory, erected into a prebend, and of the said archdeaconry respectively to the above John, who on account of the said bargain had incurred the said sentences etc. and who, under pretext of the said collations and provisions (fn. 4) took possession and has detained both benefices together, without obtaining any canonical dispensation, for several years against Execrabilis—to absolve the said John, who is a priest, from the said sentences etc., enjoining penance, dispense him on account of irregularity, and rehabilitate him.
