Mandate to collate and assign to Milerus Valensis, clerk, of the diocese of Tuam, the rectory of Clancuan in the said diocese, of the patronage of laymen, value not exceeding 10 marks sterling, which became and is still void because David de Burgo, priest, who is to be summoned and removed, when holding the perpetual vicarage of Achgaur (cf. below, f. 34) in the said diocese, obtained it, then void in a certain way, and detained it and the said vicarage together for more than a month without dispensation [cf. Cal. Lett. VIII, p. 425] against 'Execrabilis,' (fn. 2) and has continued to do so for about six years without dispensation, likewise against 'Execrabilis'; whether it be void as above, or by the resignation of the said David, or in any other way, and notwithstanding that the pope lately granted him provision of a canonry and prebend of Tuam, value not exceeding 5 marks. Mandate—the pope having been informed by John Macduscan, clerk, of the diocese of Clogher, that, after Martin V's renewal of, and reservation of the absolution from, all papal sentences of excommunication etc. against simoniacs, Gilibert Osychighi, priest, of the said diocese, in order that John Mackearbayll, priest, might resign in his favour possession of and all right in or to the perpetual vicarage of Ross in the said diocese (provision of which Gilibert alleged had been ordered to be made to him by papal authority [see Cal. Lett. VIII, p. 118]), promised to give and assign to him a certain part of its possessions; that, after John had thus resigned, collation had been made to Gilibert, and the said part had been assigned to John, Gilibert made and performed a like promise to Donald Ofedagan, clerk, of the said diocese, who alleged that he had a right in the said vicarage, in order that he might give up such right, thereby incurring the said sentences etc.; that Gilibert is also a public and notorious fornicator, and is involved in divers other crimes [not here named]—if the said John Macduscan, who is the son of unmarried parents and has been tonsured, will accuse Gilibert before them, to summon Gilibert, and if they find the above to be true, to declare the said collation null, or to deprive Gilibert, and in that event to collate and assign the said vicarage, value not exceeding 6 marks sterling, to John, who is hereby specially dispensed, on account of the said defect, to be promoted to all, even holy orders and hold the said vicarage. Mandate to collate and assign to Rory Mcgillavanach, perpetual vicar of Newtown (de Villa nova) in the diocese of Kilmacduagh (who is in subdeacon's orders, and was lately dispensed by papal authority, as the son of a deacon and an unmarried woman related in the second and second degrees of affinity, to be promoted to all, even holy orders and hold a benefice even with cure, by virtue of which he obtained the said vicarage) the rectory of Huaranmor in the diocese of Annadown, of the patronage of laymen and value not exceeding 10 marks sterling, so long void [in a way not stated] that its collation lapsed to the apostolic see, although Bernard Ohynneri, priest, of the said diocese of Annadown or that of Tuam, who is to be summoned and removed, has unduly detained it for more than two years without any canonical title; whether it be void as [not] above, (fn. 3) or in any other way, or by the detention of William Yhynery against 'Execrabilis,' or by the non-promotion to holy orders in the lawful time of a certain David of the sept of Burke (nationis de Burgo), or by the resignation of the said David or of a certain William Bernardi; notwithstanding that Rory holds the said vicarage, which he is, as he has offered, to resign upon obtaining the said rectory. Lett. VIII, p. 557] in the said diocese) the rectory, not named from a defined (certa) church, and of the patronage of laymen, of the rural lands of Efficaire (sic) and Beanfada in the said diocese, with cure (fn. 4) [cf. below, f. 73] and value not exceeding 15 marks sterling, so long void by the resignation of Cornelius Mirscarraigh ('Micserrayd' ibid. p. 7, Macsearraid ibid., p. 52) to Martin V that its collation lapsed to the apostolic see; whether it be void as above, or because the said Cornelius, when holding it, entered some monastery or place of a religious order and made therein his regular profession, or by the death of Cormac Iheara ('Oheadra' ibid.) without the Roman court, or his non-promotion to the priesthood, or his resignation, or in any other way; notwithstanding that Thady holds the said benefice, which is without cure and value not exceeding 3 marks. Mandate—the pope having been informed by Rory Ohorechti, clerk, of the diocese of Elphin, that Matthew Okallanan, perpetual vicar of Kylmurcun in the diocese of Achonry, has delapidated the vicarage, has for a long time not served it, and has betaken himself elsewhere for his carnal conveniences (fn. 6), is a public and notorious perjurer and fornicator, is of evil life and unhonest conversation, and is involved in very many other crimes [not here named]—if the said Rory, who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, will accuse Matthew before them, to summon Matthew, and if they find the above or enough thereof to be true, to deprive Matthew, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Rory; whether it become void by such deprivation, or be void by the resignation of the said Matthew, or in any other way. Mandate to collate and assign to Bernard Ohagra, clerk, perpetual beneficiary in the parish churches of Tuaimfaubar, Morachd and Drumirath, in the diocese of Achonry (who was lately dispensed, as the son of a bishop (fn. 7) and an unmarried woman related in the double third degree of kindred and the double third and the simple third and the fourth degrees of affinity on divers sides, first by authority of the ordinary to be promoted to minor orders and hold a benefice without cure, and then by papal authority to be promoted to all holy orders and hold another benefice even if with cure) the rectory, wont to be assigned to secular clerks as a perpetual benefice, and of the patronage of laymen, of the rural lands of Ofychary and Bennfada in the said diocese, without cure (fn. 8) [cf. above, f. 65d.] and value not exceeding 16 marks sterling, so long void by the death of Eugenius Ohagra at the apostolic see that its collation lapsed to the said see; whether it be void thus, or by the resignation of the said Eugenius, or in any other way; and notwithstanding that Bernard holds a certain perpetual benefice called a prebend, without cure, in the said parish churches, value not exceeding 2 gold florins of the camera. Reservation, for collation to him (who is a priest and also M.A., is a kinsman of king James and of the earls of Ross, Crawford and Mar, (fn. 9) and of a race of barons, and who became a licentiate in civil law by examination), of the parish church of Rathou in the diocese of St. Andrews, value not exceeding 60l. sterling, about to become void by the promotion, made by the pope, of Alexander [de Lauder, see Cal. Lett. VIII, p. 265], elect of Dunkeld, to that see, and by his consecration, which is to take place; notwithstanding that he (who was lately dispensed by papal authority to retain for life the parish church of Fethirkern in the said diocese, which he was then holding, and one other, or without the said church any two, benefices with cure or otherwise incompatible, even if parish churches, and to resign them, simply or for exchange, as often as he pleased, provided that he did not hold together two major or principal dignities, or one of each, or with one of such a parish church or a perpetual vicarage [ibid., pp. 589, 590] holds the above archdeaconry, which is a non-major dignity with cure, and the parish church of Idvi in the said diocese, value not exceeding 60l. and 40l. sterling respectively, and that the present pope lately made provision to him of a canonry of Glasgow and another of Aberdeen, with reservation of as many prebends, and of a dignity etc. of one of them [see ibid]. He is hereby specially dispensed to receive the said church of Rathou, and hold it with the said archdeaconry and church of Idvi for a year, during which he is to exchange one of the three for a compatible benefice, or, if not, is thereafter to resign Idvi. Mandate—the recent petition (fn. 10) of Tierney (Tigernacus) Maccanegheanaid, clerk, of the diocese of Clogher (who is the son of unmarried parents and is in his twenty-third year, and who, notwithstanding the said defect [of birth], has been tonsured by authority of the ordinary) containing that Magonius Olergassa, perpetual vicar of St. Tierney's, Cluancoys (sic), in the said diocese, formerly violently ravished certain goods which were in the said church, carried them away with him and converted them to his sinister uses, and has not restored them, thereby committing sacrilege, and that he is a notorious and manifest fornicator—if Tierney accuses, under penalty to be inflicted by them in default of his proving the aforesaid, (fn. 11) to summon Magonius and others concerned, and if they find the above to be true, to deprive him, and in that event to collate and assign the said vicarage, with cure and value not exceeding 6 marks sterling, whether it become void by such deprivation, or be void by the resignation of the said Magonius, or in any other way, to Tierney, whom the pope hereby specially dispenses, on account of the said defects, to be promoted to all, even holy orders and hold the said vicarage. To the official of Clogher. Mandate—seeing that the rectory of St. Eoghan (Iganus), Ceallmor, in the diocese of Clogher, became and is void (because Catholicus Obruyn, when holding the deanery, with cure, of Clandaedha in the said diocese, obtained the said rectory, canonically collated to him, and, without having obtained any canonical dispensation, for more than two years held them together against `Execrabilis,' as well as the perpetual vicarage of St. Comgallus's, Gabalyuin, in the said diocese), although Adam Ofurnan, priest, of the said diocese, has unduly detained possession of it for more than six years under pretext of an acceptance made by him and a provision made to him thereof, thus void, by vigour of certain papal letters of expectation under which it was not comprehended, and seeing that it is therefore, by the said constitution, reserved; seeing that, moreover, as the recent petition of John Ohenrachdaigh, clerk, of the said diocese, contained, if in the church of Clogher, in which there is a certain number of canons, one more canonry were created, and if into a prebend were erected the said rectory (which was otherwise for a certain time, not elapsed, erected by authority of the ordinary into a prebend, and whose cure was meanwhile exercised by a perpetual vicar), and if provision of such canonry and prebend, to be thus created and erected, were made to him, he would be more becomingly maintained, and divine worship in the said church of Clogher would be increased—if he find the facts to be as stated, and after sum- moning the said Adam and others concerned, to erect into a prebend the said rectory, value not exceeding 5 marks sterling, whether it be void as above, or by the death of Magonius Ohenrachdaigh, or in any other way, and to create one canonry over and above the said number, and in that event, to collate and assign such canonry and prebend to the said John, who for certain years has studied canon law in a studium particulare, and was lately tonsured notwithstanding his illegitimacy as the son of unmarried parents, removing from the said rectory the said Adam and any other unlawful detainer. John is hereby specially dispensed, on account of the said defect, to be promoted to all, even holy orders and hold the said canonry and prebend, and to resign them, simply or for exchange, as often as he pleases. The pope's will is that in the said church of St. Eoghan the cure of souls shall not be neglected, etc., and that on the cession or death of John or his otherwise resigning the said canonry and prebend, the said erection shall cease and expire. The pope this day made provision to David de Crannach, rector of Tannades in the diocese of St. Andrews, of that church, requiring him, as soon as he got possession of it, to resign, as he himself offered, the deanery of Brechin, a dignity, provision of which had been ordered by papal authority to be made to him, or give up all right in or to it [below, f. 212]; and, also this day, granted to John de Lichton, dean of Brechin and rector of Lundychty in the diocese of Moray, who had obtained the said deanery by a collation made to him by the said authority, that the said collation and its consequences should hold good even after the above David obtained Tannades in virtue of the above provision, even if the said deanery were then void by David's obtaining Tannades or were void in any other way; requiring John, as soon as he got possession of the deanery in virtue of the pope's said later grant, to resign Lundychty, as he himself also offered. The pope therefore orders the above three to reserve to their gift, and to collate to Andrew Dunnovyn, clerk, of the diocese of Ross, bachelor of canon law, provided that the lay patrons consent, the said church of Lundychty, value not exceeding 15l. sterling, about to become void by the said obtaining of the deanery; notwithstanding that Andrew is expecting under letters of the present pope one or two benefices, even if one have cure etc., in the gift of the bishop and the prior and chapter of St. Andrews and the bishop and the dean, archdeacon and canons and the chapter etc. of Dunkeld. Collation and provision—seeing that, for purpose of exchange, he, who is a brother of John, bishop of Brechin, has resigned to the pope, by the said bishop as his proctor, a canonry of Dunkeld and the prebend called the subdeanery (fn. 13) therein; that Thomas de Tulach (in order that an agreement made between the said David and John de Lichton, clerk, of the diocese of Aberdeen, about the deanery of Brechin, may take effect) has resigned to the pope, by himself, the above church of Tennades (sic); and that the pope has admitted the said resignations—of the said church, thus void, value not exceeding 60l. sterling; notwithstanding that David holds a canonry with the prebend of Tulinescil in Aberdeen, and a canonry with the prebend of Dumbar in Dumbar, in the said diocese [of St. Andrews], value together not exceeding 20l. sterling, is expecting a benefice with or without cure of the city and diocese of Brechin in the gift of the bishop and the dean, archdeacon and chapter and the canons etc. of Brechin, and that provision was lately ordered by papal authority to be made to him of the deanery of Brechin, a major elective dignity with cure, value not exceeding 30l. sterling, of which he is not in possession, dispensation being at the same time granted to him to hold with the said deanery one other, or if he resigned the deanery, any two other, benefices with cure or otherwise incompatible, even if two parish churches or perpetual vicarages or dignities etc., even elective and with cure, namely such dignities etc. for life, and parish churches or vicarages for two years, and to resign the said deanery and such incompatible benefice or benefices, simply or for exchange, as often as he pleased, and hold instead for life two other incompatible benefices, the pope furthermore requiring that as soon as, in virtue of these presents, he obtains the said church he shall, as he has himself offered, resign the said deanery, if he obtain it meanwhile, or give up all right in or to it. Mandate—the pope having been informed by Alexander Zong, priest, of the diocese of Aberdeen, that Walter Lowan, perpetual vicar of Gameri in the said diocese, has adhered to the Council or rather conventicle of Basel, after and against the pope's transfer thereof to Ferrara, and notwithstanding the sentences promulgated against the disobedient—to summon Walter, and if they find that he has incurred the said penalties, to proclaim him to have been and to be deprived, and in that event to collate and assign the said vicarage, value not exceeding 16l. sterling, to Alexander: notwithstanding that the pope lately granted him provision of a canonry of Aberdeen and another of Ross, with reservation of as many prebends, and of a dignity etc. of one of those churches, which grant shall, upon his obtaining the said vicarage, be null as far only as regards an incompatible benefice. Mandate—the pope having been informed by Cornelius Obuachalla, canon of Killala, that Cornelius Orothlayn, perpetual vicar of Castleconor (de Castroconchiu) in the diocese of Killala, is a simoniac, and is without the learning required to exercise the cure of souls—if Obuachalla will accuse Orothlayn before them, to summon the latter, and if they find him guilty of simony or unfit to hold the vicarage, to deprive him, and in that event to collate and assign it, value not exceeding 8 marks sterling, to Obuachalla, whether it be then void by such deprivation, or be still void by the death of Nicholas Ymaenaid without the Roman court, or by the resignation of the said Orothlayn or Nicholas, or in any other way, notwithstanding that Cornelius was lately received by authority of the present pope as a canon of Killala.
