Treasurer Southampton to the Chief Baron of the Exchequer requiring his assistance in the matter of the repayments of half subsidy and Algiers duty due to be made to the merchants of London for payments by them made before the King's restoration: for which said repayment provision does not appear to have been made in the Act for tunnage and poundage: this matter having been already reported on to the Privy Council by said Treasurer and Lord Ashley, Chancellor of the Exchequer, but the said Council having by their order of 1663, Oct. 28, referred the matter back again to them for reconsideration by them with the help and advice of the Chief Baron of the Exchequer and the Attorney General. Warrant from Treasurer Southampton to the Auditor and the Receiver of Crown Revenues in South Wales for the annuity of 200l. granted to Hartgill Baron by letters patent of 1661, Dec. 21, to be paid with the arrears thereof out of the revenues of South Wales, notwithstanding the order of suspension [of the payment of pensions generally]: the same being not of the nature of a pension but a contract, until lands of that value be found out and settled on him. July 6 Warrant from Treasurer Southampton to the Customs Farmers to accept from Sir Joseph Wagstaffe the rent of 20 marks per an. for his grant for 31 years of the sole benefit of transporting lampernes alive out of England to Holland in the same way as same was enjoyed by Richard Warner. or Neil Warner; all as by the letters patent of 1663, Sept. 10: and further, for said Farmers to be allowed by the Auditor of Imprests so much money as the Custom of the said lampernes shall exceed the said rent of 20 marks. July 16 Brief abstract of a [judgment in the Exchequer Court as certified] by the Attorney General as follows:—"The information in the Exchequer was for the payment of the additional duty upon callicoes as lynnen. The question upon the evidence was whether callicoes were lynnen and being found that they were soe the judgment necessarily was to be for payment of the duty but the whole debate was whether calico was lynnen which would not be exprest in the judgment, the information being only for the payment of the duty." Ibid, X. p. 278.
Followed by a letter from Sir Philip Warwick to _. "Sir. My Lord Treasurer was soe carefull himselfe to informe his owne judgment right in this case that when I went up this morning to Mr. Attorney [General] to desire him to attend my Lord I found his [Treasurer Southampton's] footeman there upon the same errand; which his Lordship was induced to doe because [in order that] you might not be delayed in landing this commodity. Mr. Attorney could not conveniently be with my Lord Treasurer in the morning but at this instant his Lordship hath consulted my Lord Ashley who was in Court and Mr. Attorney whose resolution under his hands I send you. And therefore must conclude my Lord cannot interfere further without prejudice to the King's right. And this I made haste to tell you that you may have noe inconveniency by expecting his resolution."
July 16 Money warrant for 2,120l. to Sir John Shaw for money paid by him by the King's command for secret service. Early Entry Book V p. 164.
