April 1. Same to the Customs Commissioners. My Lords have laid before the King your presentment of March 7 last concerning the ships from S. Sebastian. His Majesty apprehends that French wines are brought from thence. He therefore directs that two officers, such as you shall approve, be sent to S. Treasury reference to the Customs Commissioners of the petition of several merchants of London and others, creditors of Thomas Brasey of Lumbard Street, goldsmith, shewing that said Brasey is indebted 20,000l. to them "and there being discovered on board a ship called the James a considerable parcel of silver amounting to about 2,000l., which ship and silver appears to belong. to him and was bound to East India" therefore [they] pray that the seizure may be taken off the said ship and silver upon [their or Brasey's] rewarding the officers [concerned in the seizure]. Same to Sir Richard Haddock et al. late Commissioners for Victualling the Navy, of the petition of Elizabeth Varley, widow, shewing that her husband was master of the vessel Prosperous of York, which was hired into the King's service in April, 1689, to transport stores to Ireland and in her voyage was cast away together with her said husband: therefore paying compensation for the loss of the said ship valued at 250l. and for hire thereof and that the late Victualling Commissioners who have enough in their hands to discharge same may come to account with petitioner. Treasury warrant to the Customs Commissioners [sic for AttorneyGeneral] to enter a noli prosequi to the information as follows against Henry Colchester and William Baynes, two of the landwaiters in London port; it appearing that in Dec. last the Duke of Ormonde and other persons of quality entered from Rotterdam, out of the ship Joseph and Ann, Thomas Wood, master, a parcel of Rhenish wine, paying custom and making oath that it was for private use and the petitioners being appointed landwaiters to the said ship delivered the wine "according to the warrant" but last term one Thomas Parsons brought an information against them on the French Act for the penalty of 500l. for delivering the wine, [the informer] pretending it to be French: as to which the Customs Commissioners are of opinion that the information is vexatious [and instituted merely for revenge] for matters done by the officers in the course of their duty. The Treasury Lords are informed that the house called the Martins Tower is within Mr. Dallow's grant of the said office [of Porter of the Mint]. Treasury reference to the Commissioners for Prizes of the petition of Joseph Waters, Captain of the Charles galley, praying to be paid (according to the King's Declaration in 1689) the gunnage and tonnage of a privateer of 22 guns which he took in Sept., 1691: said petition being referred to the Treasury from the Privy Council. Same to the Agents for Taxes enclosing a letter [missing] from the [Assessment] Commissioners for the 4s. Aid in Co. Sussex together with a letter to them from the Duke of Shrewsbury concerning the estate which lately belonged to Mr. Caryll at Knepp and now conveyed to said Duke. Please write to those Commissioners that the Treasury Lords are satisfied in what the Duke hath written and that the estate belongs to him.
Please also report on the enclosed memorial [missing] from the Commissioners for the said Aid in London concerning the taxes assessed on the Navy Commissioners and the Commissioners of Transports. Ibid., p. 80.
April 6. Treasury reference to the Customs Commissioners of the petition of Papworth Gedney of London, merchant, praying to be discharged a debt of 76l. owing for Customs and New Impositions, he being by losses at sea become unable to pay same. Reference Book VII, p. 143.
Same to [Auditor] William Aldworth of the petition of Robert Gilliver shewing that there are sundry rents in arrear for levying of which he has received encouragement from several of the King's Receivers "but cannot legally proceed therein without being first sworn" therefore praying a [Treasury] letter to the Lord Chamberlain to swear him [into office as] a messenger of His Majesty's land revenue. Same to the Customs Commissioners of the petition of John Gardner, merchant, to the King showing that he has sustained great losses since the war in many ships taken by the French by which he is disabled to prosecute his affairs and is forced to retire and is now indebted 5,000l. to the King for Customs: therefore praying to have the debt remitted, he having been serviceable to the King and government. Same to the Navy Commissioners of the petition of John Clarke shewing that the Navy Commissioners by contract hired of him a vessel to be employed in the King's service which the collector of Harwich (upon a difference between "him" [the collector] and the mariners of the ship) made seizure of whereupon he [petitioner] complained to the Navy Board who replied that the collector was not their officer and they could not redress the grievance, wherefore he was obliged to petition the King in Council and was thence referred to the Treasury and from thence to the Customs Commissioners who vindicated their officer; and during his solicitation the ship was lost: therefore praying an allowance for same. Royal warrant under the King's sign manual to the Attorney- or Solicitor-General for a great seal for a grant to William Sanderson of the yearly rent of 25 load of hay and 50 quarters of oats reserved on the existing leases of Eastcombe farm near Greenwich and of all the arrears thereof: to hold for the unexpired terms of the said leases: without account.

Same to the Clerk of the Signet for a privy seal for a grant to Mary Milburne, widow, of the sum of 68l. and the benefit of the judgment of outlawry as follows; she, having at the request and for the proper debt of Thomas Wansell and Thomas Plumer, become bound to one Palfryman, a baker, in 200l. conditioned to pay 100l. for which sum she was sued and forced to pay same; whereupon, by virtue of their counter-bond, she sued Wansell and Plumer to an outlawry and by an inquisition taken upon a capias utlagum in Middlesex, 1694, Oct. 6, before John Sweetapple and William Coles, Esqs., when high sheriffs of County Middlesex, it was found that said Wansell was possessed of 68l. in the hands and custody of Hugh North, goldsmith; for which sum she obtained judgment but the said money is still detained by said North for want of a title from the Crown to enable her to receive same: which is hereby to be granted her. Royal warrant to the Lord Deputy of Ireland to grant to William Viscount Mountjoy by way of custodiam the lands or estates of the several persons as in the schedule below: to be during the King's pleasure at the improved rents: all by reason that the said Viscount has petitioned for a grant of 1,000l. per an. or of forfeited lands to that value, in consideration of his sufferings and faithfulness to the King's interest: his petition having been referred to the Treasury Lords and thence to the Lord Deputy and thence to the Attorney-General, Ireland, which last referee has reported that it appears by the certificate of the provost and burgesses of the borough of Strabane that they were eyewitnesses of petitioner's frowardness and fidelity, several of them having been employed under his command in the Regiment which he there raised for the defence of the Country and for the King's interest; and by other affidavits it appears that the Irish army burned and destroyed the castle of Newtown Stewart and likewise the castle and town of Ramelton [Rathmelton] and wasted all the petitioner's estate: further that several of the persons in the annexed list stand outlawed for high treason; and further on application from the said Attorney-General to the Commissioners for Inspecting and Managing Forfeitures in Ireland it appears that there were no inquisitions as yet found in the Province of Connaught where the estates of the said forfeiting persons lie and therefore they can give no account thereof until commissions of enquiry are returned but that upon return of such commissions a grant as desired may be made.
With this opinion of the Attorney-General the Lord Deputy is in agreement but conceives that for the present it may be convenient to grant a custodiam of such forfeited lands during pleasure.
Such custodiam is therefore hereby directed as above.
